Van Milligen, City Mana�er-- - � ��!,(i FROM: Gus Psihoyos, City Engineer � �G� �`��� � John Klostermann, Public Works Director SUBJECT: lowa Department of Transportation Local Primary Highway Maintenance Supplemental Agreements DATE: September 10, 2018 INTRODUCTION The purpose of this memorandum is to request approval of several lowa Department of Transportation (lowa DOT) Supplemental Agreements for Local Primary Highway Maintenance, Pavement Markings, Julien Dubuque Bridge Sidewalk Maintenance, Street Sweeping Maintenance and Traffic Signal Maintenance (collectively referred to as Supplemental Agreements) between the lowa DOT and the City of Dubuque (City). BACKGROUND Every five years a "master agreement" is prepared by the lowa DOT and distributed to all lowa municipalities that have State primary highways within its corporate limits. Acceptance of this master agreement is necessary in order to coordinate the maintenance of the State roadways located within the municipality jurisdictions. The City has executed the Five-Year Maintenance Agreement for Maintenance and Repair of Primary Roads in Municipalities between the lowa DOT and the City on May 16, 2016 for the time period of July 1, 2016 to June 30, 2021. The Supplemental Agreements are required annually for specific areas that are not included in the Five-Year Maintenance Agreement. Public Works Director John Klostermann and Assistant City Engineer Robert Schiesl have reviewed and approved the Supplemental Agreements. DISCUSSION The Supplemental Agreements between the lowa DOT and the City are as follows: Local Primary Highway Maintenance This agreement concerns various primary road extensions within the corporate city limits, a combined distance of 9.54 miles, during the period of July 1, 2018 through June 30, 2019. • Locust Street (IA 946) from Charter St to Locust St • Locust Street Connector (IA 946) from Locust St to US 61 • 9tn Street (SB & NB US 52) from Central Ave to East 911 Connector - Centra! Avenus (�� U� 52) from 9tn Street to Ruby Street • 11th Street (connects SB US 61 to NB US 52) from US 61 SB off ramp to White Street • White Street (NB US 52) from 9th Street to 21 St Street • 21St Street (NB US 52) from White Street to Central Avenue • East 911 Connector/Pine Street (carries SB US 52 to NB US 61) from 9t" Street to 11 th Street Pavement Markings This agreement concerns one application for the traffic line markings on US 61/151, US 52, US 20, IA 946 & IA 32 during the period of July 1, 2018 through June 30, 2019. • Hwy 61/151: Elmwood Drive to Twin Valley Drive • Hwy 52: Twin Valley Drive to 9th Street Exit Ramp • Hwy 61/151: 11th Street Exit Ramp to Wisconsin Bridge • Hwy 52: 9t" Street Exit Ramp • IA 32: Hwy 20 to Hwy 52/3 • Hwy 20: Illinois Bridge to Barrington Drive • IA 946: Hwy 52 to Hwy 61/151 Julien Dubuque Bridge - Snow Removal This agreement concerns the removal of snow and ice from the portion of the sidewalk on the Julien Dubuque Bridge that is within Illinois during the period of July 1, 2018 through June 30, 2019. • The City of Dubuque will hire a contractor to remove snow and ice from the portion of sidewalk on the Julien Dubuque Bridge that is within Illinois. • Snow and ice removal will be in accordance with the City's standards for snow and ice removal on the lowa portion of sidewalk on the Julien Dubuque Bridge. Street Sweeping Maintenance This agreement concerns sweeping of curbed/barrier lane on US 20 & US 61/151 in Dubuque, including the Julien Dubuque Bridge, Wisconsin Bridge and all ramps during ' the period of May 1, 2018 through November 1 , 2019. • The City of Dubuque will provide a street sweeper and operator three (3) times a year for sweeping curbed/barrier wall lanes. • The three (3) occurrences must be provided before Memorial Day, the Fourth of July and Labor Day. Traffic Signal Maintenance This agreement concerns the maintenance and monitoring/adjusting of the signal timing as needed for the traffic installations at two locations during the period of July 1, 2018 through June 30, 2019. • US 52/61/151 at the intersection with Twin Valley Drive. • lowa 3/US 52 at the intersection with lowa 32 (Northwest Arterial) BUDGETIMPACT Per the terms of the Five-Year Maintenance Agreement for Maintenance and Repair of Primary Roads in Municipalities between the lowa DOT and the City and the associated annual Supplemental Agreements, the City will be reimbursed based on the following schedule: Maintenance Responsibility Reimbursement Cost Local Primary Highway Maintenance $22,896.00 Street Sweeping Maintenance $5,623.42 Pavement Markings Based on Actual Costs Julien Dubuque Bridge - Snow Removal Based on Actual Costs Traffic Signal Maintenance Based on Actual Costs ACTION TO BE TAKEN I recommend that the City Manager be authorized to execute the Supplemental Agreements for for Local Primary Highway Maintenance, Pavement Markings, Julien Dubuque Bridge Sidewalk Maintenance, Street Sweeping Maintenance and Traffic Signal between the lowa DOT and the City. The parties hereby desire to enter into this roadway maintenance agreement concerning the following roadway: bridge/ramps on US 20 & US 61/151 within City of Dubuque 1. ROUTINE MAINTENANCE A. Party of the First Part will perform the following routine maintenance: Routine maintenance not applicable with respect to this agreement B. Party of the First Part will perform the above described routine maintenance in compliance with the Iowa Department of Transportation's standard maintenance policies and procedures which include, but are not limited to, the Department's standards for maintenance activities and instructional memorandums. Particularly, Party of the First Part shall comply with: N/A C. Party of the Second Part will perform the following routine maintenance: Routine maintenance not applicable with respect to this agreement 2. SPECIAL MAINTENANCE A. Party of the First Part will perform the following special maintenance: The City of Dubuque will provide a street sweeper and operator three (3) times a year for sweeping 16.6 curbed/barrier wall lane miles (LM) on US 20 & US 61/151 highways in Dubuque, not limited to but including the Julien Dubuque Bridge, Wisconsin Bridge and all ramps. The three (3) occurrences must be provided before the following dates: Memorial Day, the Fourth of July, and Labor Day B. Party of the First Part will perform the above described special maintenance in compliance with the Iowa Department of Transportation' s standard maintenance policies and procedures which include, but are not limited to, the Department' s standards for maintenance activities and instructional memorandums. Particularly, Party of the First Part shall comply with: C. Party of the Second Part will perform the following special maintenance: Provide traffic control for the sweeping operation, provide haul truck for sweeper to dump into and pay landfill fees. 3. PAYMENT A. It is agreed that payment for the routine maintenance operations will be made after the work has been completed for the fiscal year ending June 30, and payment for maintenance operations will be made after the work has been completed. It is also understood and agreed that the right is reserved by both Parties to review, adjust, or terminate this Agreement at any time, provided however that written notice be given either Party at least thirty days prior to such review, adjustment, or termination. B. Payment for routine maintenance at the rate of $ XX per lane mile per year. Total lane miles XX at $ XX per lane mile = $ XXXX C. Payment for special maintenance shall be made as follows: 16.6 LM x $112.92 (equipment/labor rate) x per occurrence = $1,874.47. Not to exceed 3 occurrences (max payment of $5,623.42). The City of Dubuque shall invoice the Iowa Department of Transportation after each occurrence or after all occurrences have been completed for the season. 4. AGREEMENT TIME PERIOD Beginning Date: May 1, 2018 Ending Date: November 1, 2018 5. Party of the First Part agrees to indemnify and save harmless the Party of the Second Part, the State of Iowa, and its agents or employees from any and all causes of action, suits, at law or in equity, for losses, damages, claims or demands, and from any and all liability and expense of whatsoever nature (including reasonable attorney fees), arising out of or in connection with the execution, performance, or attempted performance of this Agreement and work provided herein. 6. If any section, provision or part of this Agreement shall be found to be invalid or unconstitutional, such judgment shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional. 7. Party of the First Part will follow all federal and state laws and regulations with regard to worker safety and the handling and disposal of hazardous waste and/or substances in performing any maintenance task. 8. Any subsequent change or modification to the terms of this Agreement shall be in the form of a duly executed addendum or amendment to this Agreement. AGREEMENT: I. This Agreement supplements the Agreement for Maintenance and Repair of Primary Roads in Municipalities entered into by the parties on May 26 , 2016 , and in effect from July 1, 2016 , to June 30, 2021 II. The Municipality agrees to perform and accept all responsibility for those maintenance activities listed in Sections 1.6.1, 1.6.3, 1.6.4 and I.C.1 of the basic Agreement, with respect to the primary roads within the corporate limits of the Municipality specifically described in this section. In consideration thereof, the Department agrees to pay the Municipality at the rate of $2 400.00 / lane mile for acceptable work at the end of the fiscal year ending on June 30th: Route From To Lane Miles Total Cost *See reverse side of agree ment for route descriptions Pavement maintenance does not include full depth patching and bituminous resurfacing. I.C.1 does not include traffic services and painting and structural repair to bridges. III. Particularly, Party of the First Part shall comply with: Snow and ice removal to be in accordance with city standard's for snow and ice removal on the Iowa portion of sidewalk on the Julien Dubuque Bridge. C. Party of the Second Part will perforin the following special maintenance: None 3. PAYMENT A. It is agreed that payment for the routine maintenance operations will be made after the work has been completed for the fiscal year ending June 30, and payment for maintenance operations will be made after the work has been completed. This Supplemental Agreement shall be in effect from July 1, 2018 to June 30, 2019 unless re -negotiated or terminated. AGREEMENT: I. This Agreement supplements the Agreement for Maintenance and Repair of Primary Roads in Municipalities entered into by the parties on May 26 , 2016 , and in effect from July 1, 2016 , to June 30, 2021 II. The Municipality agrees to perform and accept all responsibility for those maintenance activities listed in Sections 1.6.1, 1.6.3, 1.6.4 and I.C.1 of the basic Agreement, with respect to the primary roads within the corporate limits of the Municipality specifically described in this section. In consideration thereof, the Department agrees to pay the Municipality at the rate of N/A / lane mile for acceptable work at the end of the fiscal year ending on June 30th: Route From To Lane Miles Total Cost Pavement maintenance does not include full depth patching and bituminous resurfacing. I.C.1 does not include traffic services and painting and structural repair to bridges. III. The Municipality further agrees to perform additional maintenance for the Department on primary roads as specifically described below: The City of Dubuque will provide routine maintenance and monitor/adjust the signal timing as needed for traffic installations at the locations listed below. Maintenance will be in accordance with the City's guidelines for the "Annual Maintenance of Traffic Signals and Cabinets", attached as Exhibit "A". Locations: 1. U.S. 52/61/151 at the intersection with Twin Valley Drive. 2. Iowa 3/U.S. 52 at the intersection with Iowa 32 (Northwest Arterial). In consideration thereof, the Department agrees to pay the Municipality the following amounts after the work has been completed: The cost of labor will be billed back to the State based on the wages of the personnel involved. The cost of parts will be billed back to the State on an actual cost basis. The City of Dubuque shall submit to the State of Iowa an annual accounting of costs upon which reimbursement will be made. IV. This Supplemental Agreement may be terminated at any time by either party upon 30 days written notice. V. This Supplemental Agreement shall be in effect from July 1, 2018 to June 30, 2019 unless re -negotiated or terminated. Buol, Mayor BY Date Septemberl7, 2018 Date District Engineer last updated April. 2012 EXHIBIT "A" Annual Maintenance of Traffic Signals and Cabinets Yearly maintenance shall consist of: Signals • Exterior cleaning of signal heads if needed. • Check angle of alignment of each head (try to align all heads) • Observe for broken or extremely faded back plates • Check operability of pedestrian buttons • Observe Walk / Don't Walk status, lenses etc • Inspect exterior equipment, note in log if painting, replacement, etc is necessary • Wash camera lenses • Replace any burned out incandescent or LED signal lamps • Observe signal timings - note any needed adjustments to Engineering • Confirm correct operation of microwave vehicle detection Cabinet • Vacuum • Replace Filter • Check/Clean exhaust fan • Log Make, Model and Serial numbers of the following: - Cabinet Controller Conflict Monitor Video detection equipment and monitors Pre-emption systems - Battery Backup Devices • Perform Test of Conflict monitor and attach printout to log, Note any failures immediately to Engineering • Oil Locks and Hinges • Tighten electrical connections • Note any changes to timings or Video detection. Notify Engineering of changes so data can be backed up electronically • Check if accurate phase diagram is present in cabinet • Update database sheet printout and return to Engineering once maintenance is complete.
