The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Commissioner Norton recused himself.
The applicant spoke in favor of the request, reviewing the location of the property and that
bank financing was contingent on platting Lot 1 as only 1.5 acres.
Staff reviewed the staff report, noting that the plat is being jointly reviewed by both the City
and County of Dubuque as the property is within two miles of the corporate limits. Staff
reviewed the previously submitted plat for the property, noting how access will be provided
to each parcel.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it appropriate.
Recommendation
By a vote of 4 to 0 with one abstention, the Zoning Advisory Commission recommends that
the City Council approve the request.
A simple majority vote is needed for the City Council to approve the request. I

INTRODUCTION
The submitted Plat of Survey of BGJ Kremer Place No. 2 resubdivides 39.51 acres of
property into two parcels of land. The property is located in Dubuque County near
Highway 151 just north of the Airport. The submitted Plat of Survey is being jointly
reviewed by both the City and County of Dubuque as it is within two miles of the city of
Dubuque corporate limits. A previous Plat of Survey for the subject property was
reviewed and approved in May of 2018.
DISCUSSION
The submitted Plat of Survey of BGJ Kremer Place No. 2 resubdivides existing property
into two new parcels to facilitate the sale of the property. The Zoning Advisory
Commission is reviewing this simple lot split as Lot 1 will not have frontage on a public
or private street. However, Lot 2 contains the existing farm house and related farm
buildings, and has an existing gravel lane that has served the property for many years.
Lot 1 is a new building lot that will be sold in the future, and does not have frontage on a
public or private street. By County standards, two lots can be served by an access
easement. Once a third lot is created, the access easement must be improved to a 66-
foot right-of-way easement for public access.
The submitted Plat of Survey is in all other respects in compliance with the City of
Dubuque subdivision regulations contained in the Unified Development Code.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Plat
of Survey of BGJ Kremer Place No. 2 and recommend approval as submitted, waiving
the lot frontage requirement for Lot 1.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF BGJ KREMER PLACE NO..2 IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey BGJ Kremer Place No. 2 in
the Dubuque County, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or approved
private street, where 50 feet of street frontage is required by Section 11-14 of Title 16 of the City
of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission and its
approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is waived to allow 0 feet of frontage on a public or an approved private street
for Lot 1.
Section 2. That the Plat of Survey BGJ Kremer Place is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque,
Iowa upon said Plat of Survey.
