1981 Resolution No. 52-81 Jackson Park Revitalization ApplicationsRESOLUTION NO. 52 -81 A RESOLUTION APPROVING THE TAX EXEMPTION APPLICATIONS OF JACKSON PARK URBAN REVITALIZATION AREA PROPERTY OWNERS AND AUTHORIZING THE TRANSMITTAL OF THE APPROVED APPLICATIONS TO THE CITY TAX ASSESSOR. WHEREAS, the Urban Revitalization Act, as enacted by the 68th General Assembly of the State of Iowa, allows cities to give property tax exemptions for improvements made to properties in a designated revitalization area; and WHEREAS, the Urban Revitalization Act requires,each property owner to submit a written exemption application by February 1 of the assessment year for which the exemption is first claimed, 'and further requires the governing body of the city to approve all applications that meet the requirements of the adopted urban revitalization plan and forward the approved applications to the local assessor for review by March 1 of each year; and WHEREAS, pursuant to the requirements of said Urban Revitali- zation Act, City Ordinance 74-80, adopted December 22, 1980, estab- lished the Jackson Park Area as an urban revitalization area; and WHEREAS, the City Clerk of the City of Dubuque, as of February 1, 1981, received tax exemption applications from owners of property as follows: Aquarius Investments (by David Bisenius, General Partner) for improvements to property at 1669 Main Street, Norma M. Denlinger for improvements to property at 1535-1537 Bluff Street, Edward Feyen for improvements to property at 1610 Iowa Street, Francis Wm. Henkels for improvements to property at 326 W. Locust Street,, and Dennis Naughton for improvements to property at 1631 Main Street; and WHEREAS, staff of the City's Housing Services Division have reviewed the above described applications and inspected the properties, and have determined that the applications and the improvements conform to all requirements of the Jackson Park Urban Revitalization Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1.' That the above described tax exemption applica- tions meet all requirements of the Jackson Park Urban -Revitalization Plan. Section 2. That the above described tax exemption applica- tions are hereby approved by the City Council, subject to the review and the approval of the City Assessor. Section 3. That the City Clerk of the City of Dubuque is hereby authorized to forward the above described tax exemption applica- tions to the City Tax Assessor. 1981. SUBJECT: PURPOSE Kenneth Gearhart, City Manager Tax Exemption Applications from Jackson Park Urban Revitalization Area Property Owners This memorandum transmits for your consideration three items regarding property tax exemptions under the Dubuque Urban Revitalization Program: Five applications for property tax exemptions for improvements made to properties located in the Jackson Park Urban Revitalization Area; A communication from Bruce Cowhig, Housing Rehab ilitation Supervisor, certifying that the Jackson Park properties have been inspected and are in '--4 compliance with the Dubuque Housing Code; and -` A proposed resolution approving the five applica- tions and authorizing their transmittal to the City Assessor. BACKGROUND The Urban Revitalization Act, passed by the Iowa General Assembly in 1979, authorizes cities to give property tax exemptions to property owners who make assessable improvements to properties located in des- ignated urban revitalization areas. The Act requires that property owners apply for the tax exemption by February 1 of each assessment year. The applications must then be reviewed by City staff to deter- mine (1) that the property is located within a designated urban revi- talization area, (2) that the improvements are in conformance with the revitalization area plan,. and (3) that the improvements were made within the allowable time period. The Act further requires that, by March 1, the City Council approve all eligible tax exemption applica- tions and transmit them to the City Assessor for his review and final determination. DISCUSSION The Dubuque Urban Revitalization Program offers a ten-year tax exemption for one -hundred percent of the assessed value of improvements made to property used for residential purposes and located within designated Memorandum re: Tax Exemption Applications February, 1981 Page - 2 urban revitalization areas. In addition to the minimum value-r,equire- ments, all properties receiving the tax exemption for new improvements must be in compliance with the Dubuque Housing Code. As of February 1, 1981, the Jackson Park Area was the one officially designated urban revitalization area in the City of Dubuque. Five property owners submitted tax exemption applications for improvements underway in their Jackson Park Area properties. Staff has reviewed the five applications, inspected the properties, and found each appli- cation in conformance with all requirements of the Jackson Park Urban Revitalization Plan. TheActauthorizestheCityCounciltodesignateareasof thecityas urbanrevitalizationareas. Improvementstoqualifiedrealestatewithinthesedesignatedareasmaythenreceivesa totalor partialexemptionfrompropertytaxesfora specifiednumberofyears. Theexemptionsareintendedto stimulateprivateinvestmentby reducingtaxincreasesthatusuallyattendpropertyimprovements.Themainpurposefordesignatingurbanrevitalizationareasis to helpcreatea long-termincreaseor stabilizationin thetaxbasecausedby newimprovementsto thedesignatedarea. Additionally,designationismeantto improvetheeconomicviabilityor neighborhoodlivabilityof thearea.TheUrbanRevitalizationActalsoauthorizestheprovisionof lowinterestcreditby permittingthecityto issuerevenuebondsforresidential,commercial,industrialor non-profitprojectswithintherevitalizationareas.In orderto implementtheprovisionsof theAct,thecitymustpreparea planandensurethatcertaincriteriaaremetandthatspecificproceduresarefollowed.An areamustmeetatleastoneof thefollowingcriteriainorderto be eligiblefordesignationas an urbanrevitalizationarea.1. Theareais detrimentalto thepublichealth,safety,or welfarebecausea majorityof thebuildingsin theareaaredilapidated,overcrowded,unsanitary'orundesirableforsimilarreasons.2. Theareaisdetrimentalto thepublichealth,safetyor welfarebecauseof taxdelinquencies,defectivetitles,inefficientland1 usesor othersimilarconditions.3. Theareahasa predominanceof buildingsor improvementswhich,becauseof age,history,architectureor significance,shouldbepreservedor restoredto productiveuse.The ensuingnarrativedescribesthereasonsforselectingtheJacksonParkAreaas an urbanrevitalizationarea,andalsodescribestheplanto befollowedinan attemptto realizethepotentialbenefitsof designation.THEJACKSONPARKREVITALIZATIONAREALocationTheJacksonParkAreaencompassesapproximatelytwelvecityblocksimmediatelynortheastof thedowntownbusinessdistrict.ItseasternboundaryadjoinsthecommercialactivitieswhichlineCentralAvenue.Thewesternandnorthernboundariesof theareaarephysicallydelimitedby steepbluffs,whosetopsarecoveredwithresidentialstructures.Map#1 on page3 highlightsthelocationof theJacksonParkArearelativeto theentireRevitalizationTargetAreaas identifiedin theUrbanRevitalizationProgramproposedfortheCityof Dubuque.ZoningMap#2 on page4 depictstheexistingzoningclassificationsin theJacksonParkRevitalizationArea. Theseveralblocksnorthof West17thStreetfallwithintheR-4ResidentialZoningDistrict.Thiszoningclassificationprovidesformoderate-densityresidentialhousing.Single-familyhomesandmulti-familystructurescontainingnotmorethantwelvedwellingunitsaretheprincipalpermitteduses. TheremainingblocksfallwithintheOR-12 0'100'JACKSON PARK: URBAN REVITALlZATtON DISTRICT ----------------DISTRICTZONING------CITY OF DUBUQUE, IOWA residentialzoningclassification,primarilya high-densitydwellingdistrictpermittingmixedprofessionalofficeuse. Bothzoningclassificationsareusedas bufferor transitionaldistrictsbetweenlowerdensityresidentialdistrictsandcommercialor institutionaldistricts.NozoningchangesareanticipatedfortheJacksonParkArea.LandUseandResidentCharacteristicsMap#3 on page6 depictstheexistinglanduseintheJacksonParkArea. TheJacksonParkAreais a predominantlymulti-familyresidentialneighborhood,withapproximately70 olderresidentialstructurescontainingnearly260dwellingunits.About190of theunitsarerenter-occupied,andmostarelowor moderatelypriced.Itappearsthatthesocialandeconomiccharacteristicsof thear~ahavenotchangedmarkedlysince1970whenone-thirdof thearea's460residentswereover62yearsof age. Theareastillprovideshousingfora significantnumberof theCity'slowandmoderateincomerenters,manyofwhomareelderly.Besidescontaininga largenumberof residences,theareaalsohasseveralhighlyvisibleandarchitecturallyappealinginstitutionalbuildings,includingtheDubuqueGirls'Club,SchoolAdministrationBuilding,andseveralchurches.Smallofficesandfuneralhomesarealsoscatteredthroughoutthearea. Thereappearto be noconditionswithintheneighborhood(e.g.,burglary,arson,trafficaccidents,etc.)thatwoulddictatea measurableincreasein servicelevelat thistime.AreaProb1emsTheJacksonParkAreaiscurrentlyexperiencingtheincipienterosionof itshousingstock. Mostof thestructuresin theareaareoverone-hundredyearsold,withthestructuralandfunctionalsystemsof manyof theseunitswornorobsolete.Somebuildingsarealreadyvacantandwillrequiremajorrehabilitationif theyareto be reoccupied.Thequalityof theareahousingstockis furtherdiminishedby numerousinstancesof deferredmaintenanceasindicatedby a fieldsurveyof theareaconductedby PlanningDepartmentstaff.Theneedfora varietyof exteriorrepairsincludingmasonryrepair,porchreconstruction,painting,andchimneyrepairwasnotedin a visualinspectionof thearea.REVITALIZATIONGOALSTheJacksonParkAreacontainsa predominanceof buildingsthatareworthyofpreservation,anda significantnumberof deterioratingbuildingswhoseconditionindicatessubstandardhousing.In an effortto reversethedynamicscurrentlyat workin theneighborhood,it is appropriatethattheJacksonPark7 Areabe designatedas an UrbanRevitalizationArea. Thedesignandimplementationof a JacksonParkUrbanRevitalizationPlanwillfocuson thepreservationandrestorationof theneighborhood'smoderatelypricedhousingstock. Inthismanner,thePlanseeksto haltandreversetheerosionof thepropertytaxbase,andtheoveralldeclineof theneighborhood.THEREVITALIZATIONPROGRAMApplicabilityThetaxexemptionprovisionssetforthon pages9 through13 of thisPlanareapplicableonlyto improvementsmadeto qualifiedrealestateassessedaseitherresidentialorcommercialpropertythatlieswithinoneor moreof theparcelsdescribedas follows:All of CityLots453thru455,inclusive;allof CityLots462and462A;allof CityLots463and463A;allofCityLots470thru475,inclusive;CityLot470A;allofCityLot664;allof Lot1 of CityLot667;allofCityLot671;allofCityLots672and672A;allofCityLots673and673A;allofCityLot674;andallof Lot7 ofCityLot675.Allof Lots14 thru17,inclusive;allbeinginDorgan'sSubdivision.Allof Lots1 through15,inclusive;allbeinginD. Thenamesandaddressesof areapropertyownersarealsoincluded.8 "Qualifiedrealestate"meansrealproperty,otherthanland,whichis locatedin theJacksonParkRevitalizationAreaandtowhichimprovementshavebeenadded,duringthetimetheareais so designated,whichhaveincreasedtheactualvalueby at leastfifteenpercent.or at leasttenpercentinthecaseof realpropertyassessedas residentialpropertyor whichhave,in thecaseof landuponwhichislocatedmorethanonebuilding,andnotassessedasresidentialproperty,increasedtheactualvalueof thebuildingstowhichtheimprovementhasbeenmadeby at leastfifteenpercent."Improvements"includerehabilitationandadditionsto existingstructures.However,if suchrehabilitationor additionswerebegunoneyear (365days)priorto theadoptionby theCityCouncilof theJacksonParkUrbanRevitalizationAreaPlan,thevalueaddedby suchrehabilitationor additionswillnotconstitutean increaseinvalueforpurposesof qualifyingforpropertytaxexemptionsundertheUrbanRevitalizationAct. Anyimprovementsthatwereassessedbeforetheareawasofficiallydesignatedwillnotbeeligibleforexemption.Improvementsto an existingstructuremustresulti~thatstructuremeetingapplicablehousingcoderequirementsof theCityof Dubuque.The "actualvalueadded"by theimprovementsmeanstheactualvalue,asdeterminedby thelocalassessor,as of thefirstyearforwhichthetaxexemptionsarereceived.9 "Qualifiedtenant"meansthelegaioccupantof a residentialdwellingunitwhichis locatedwithina designatedrevitalizationareaandwhohasoccupiedthesamedwellingunitcontinuouslysinceoneyearpriorto thecity'sadoptionof theresolutionestablishingtherevitalizationarea.TaxExemptionScheduleThe ownersof qualifiedrealestateeligibleforthepropertytaxexemptionmayelectto taketheapplicableexemptionslistedbelow. Oncean exemptionhasbeenselectedby thepropertyownerandgrantedby theCity,theownerisnotpermittedtochangetheexemption.10Ii 1. Allqualifiedrealestateassessedas residentialpropertyiseligibleto receivean exemptionfromtaxationbasedon theactualvalueaddedby theimprovements.Theexemptionis fora periodoftenyears. Theamountof theexemptionis equalto a percentof theactualvalueaddedby theimprovements,determinedas follows:One-hundredpercentof thevalueaddedby theimprovements.However,theamountof theactualvalueaddedby theimprovementswhichshallbe usedtocomputetheexemptionshallnotexceed$20,000andthegrantingof theexemptionshallnotresultin theactualvalueof thequalifiedrealestatebeingreducedbelowtheactualvalueon whichthehomesteadcreditiscomputedunderSection425.1of theCodeof Iowa.2. Allqualifiedrealestateassessedascommercialproperty,consistingof threeormoreseparatelivingquarterswithat least75 percentof thespaceusedforresidentialpurposes,is eligibleto receivea 100percentexemptionfromtaxationon theactualvalueaddedby theimprovements.Theexemptionis fora periodof tenyears.APPLICATIONANDREVIEWPROCEDURE1. Thepropertyownermustapplyforan exemptionby February1stof theassessmentyearforwhichtheexemptionis firstclaimed,butnotlaterthantheyearinwhichal~theimprovementsarefirstassessedfortaxation.2. Theapplicationmustcontain,at a minimum,thefollowing:(a) Thenatureof theimprovements.(b) Thecostof theimprovements.(c) Theactualor estimateddateofcompletion.(d) Thetenantslivingon thepropertyas of October6, 1980.(ThedateofCouncilresolutioncitingtheneedforestablishmentof theJacksonParkRevitalizationArea.)(e) Theexemptionoption .to be applied.11 3. Thepropertyownerhastheoptionof submittinga proposalforanimprovementprojectto theCitypriorto submittinsa formalapplication.If theproposedprojectis inconformancewiththerevitalizationplan,theCityCouncilshall,by resolution,givepreliminaryapprovalof theproject.Suchpreliminaryapprovalshallnotentitletheownertoexemptionuntiltheimprovementshavebeencompletedandfoundto bequalifiedrealestate.If theproposalis rejected,theownermaysubmitan amendedproposalfortheCityto approveor reject.4. TheCityreviewsallapplicationsto determinewhethera proposedprojectconformsto therevitalizationplan,is withinthedesignatedarea,andif theimprovementsweremadeduringtheappropriatetimeperiod.Ifaproposedprojectmeetsallthreecriteria,theCityshallfon~ardtheapplicationto theassessorby March1st,witha statementas towhichexemptionapplies.Applicationsforexemptionsforsucceedingyearsonapprovedprojectsshallnotbe required.5. Thelocalassessorshallrevieweachfirst-yearapplicationbymakingaphysicalreviewof theproperty,to determineif theimprovementsmadeincreasedtheactualvalueof thequalifiedrealestateby at leastfifteenpercent,or at leasttenpercentin thecaseof realpropertyassessedas residentialproperty.Iftheassessordeterminesthattheactualvalueof thatrealestatehasincreasedby at,leasttherequisitepercent,theassessorshallcertifythepropertyvaluation,determinedpursuantto thetaxexemptionschedule,to theCountyAuditorat thetimeof transmittingtheassessmentrolls. Theassessorshallnotifytheapplicantof thedetermination,andtheassessor'sdecisionmaybe12IIIIIIIIII.1III-I appea~edto thelocalboardof reviewat thetimespecifiedinSection441.37of theIowaCode. Thepropertyownermayalsorefileanapplicationin a subsequentyearafteradditionalimprovementshavebeenmade.6. Afterthetaxexemptionisgranted,theassessorshallcontinueto grantthetaxexemption,withperiodicphysicalreviewby theassessor,forthetenyeartimeperiodspecifiedin thetaxexemptionschedule.RelocationProvisionsA qualifiedtenantmayapplyto theCityforrelocationcompensationif hebecomesdisplaceddueto theactionof a propertyownerattemptingto qualifyfortheurbanrevitalizationtaxexemption.Uponverificationof suchanapplication,theCityshallrequirethepersonscausingthequalifiedtenantto be displacedto payallactualrelocationexpensesandonemonth'srentasasconditionsforreceivinga taxexemption.TIMEFRAMEThedesignationof theJacksonParkNeighborhoodas an UrbanRevitalizationAreawillremainin effectuntilit isdeterminedthattherevitalizationgoalsof theneighborhoodhavebeenattained.A threeto fiveyeartimeframeis anticipatedfortheJacksonParkrevitalizationdesignation.Uponrepealof theordinanceestablishingtherevitalizationarea,allexistingexemptionswouldcontinueuntiltheirpreviouslyestablishedexpirationdate.13 2.
