CITY OF DUBUQUE ZONING BOARD OF ADJUSTMENT
REGULAR SESSION
5:00 p.m.
Thursday, August 23, 2018
City Council Chamber, Historic Federal Building
Board Members Present: Chairperson Jonathan McCoy, Board Members Keith
Ahlvin, Bethany Golombeski, Jeff Cremer, and Joyce Pope; Staff Members Wally
Wernimont and Travis Schrobilgen.
Board Members Excused: None.
Board Members Unexcused: None.
CALL TO ORDER: The meeting was called to order by Chairperson McCoy at 5:00 p.m.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the
meeting was being held in compliance with the lowa Open Meetings Law.
MINUTES: Motion by McCoy, seconded by Pope, to approve the minutes of the July 26,
2018 Zoning Board of Adjustment meeting as submitted. Motion carried by the following
vote: Aye — Cremer, Ahlvin, and Golombeski; Nay — None; Abstain — Pope and McCoy
DOCKET: 30-18/Special Exception (Tabled): Application of Tony Steffen, 1745 Key
Way Drive, to store a vehicle in the side yard 2' from south side property line, where 6'
minimum required, in an R-1 Single-Family Residential zoning district.
Tony Steffen, of 1745 Key Way Drive, discussed the proposal noting it has been stored
in that location for about 10 years. He also pointed out that it is primarily seasonal
storage and that he will expand the concrete pad to comply with City code.
Staff member Wally Wernimont detailed the staff report noting this docket was tabled
from the previous month. He noted that a letter of support was received, and new
photos were provided by the applicant which show current conditions.
Board members discussed the proposal noting existing shrubbery masks the boat from
the side.
Motion by McCoy, seconded by Ahlvin, to approve the Special Exception with the
condition to limit storage from April 15t to October 315t. Motion carried by the following
vote: Aye —Ahlvin, Cremer, Golombeski, and McCoy; Nay — Pope, citing Criteria A.

DOCKET: 31-18/Special Exception (Tabled): Application of David Saeugling, 2545
Chaney Road, to store a vehicle 0' from the front property line, where 20' minimum is
required, in an R-1 Single-Family Residential zoning district.
David Saeugling, of 2545 Chaney Road, discussed the proposal. He noted it has been
stored in that location since 1995.
Staff inember Wally Wernimont detailed the staff report noting this docket was tabled
from the previous month. He noted a neighbor was present at the last meeting and that
she had concerns the boat may obstruct delivery trucks to the adjacent property.
However, after she received the details of the request she had no objections to the
proposal. Mr. Wernimont noted that the topography and access to the rear yard creates
the need for a special exception.
Board members discussed the proposal. There was discussion of storing different
vehicles of various profiles, which may create a hazard in the future.
Staff inember Wernimont addressed that discussion by stating there are no concerns
with low profile vehicles and that the biggest concern with different vehicles would be
whether or not said vehicle would be in the visibility triangle.
Motion by McCoy, seconded by Cremer, to approve the Special Exception with the
condition to limit storage from April 1 st to October 31 st. Motion carried by the following
vote: Aye — Ahlvin, Cremer, Golombeski, and McCoy; Nay — Pope, citing Criteria A.
DOCKET: 33-18/Special Exception: Application of Christopher Biedermann, 222/224
S. Grandview Avenue, to construct a detached garage 0' from the common side
property line, where 6' minimum is required, in an R-1 Single-Family Residential zoning
district.
Jeff Hiat, 2080 Southpark Ct., represented the applicant. He discussed the proposal
noting the garage is located behind the primary dwelling and that this proposal would
add to off-street parking for the property.
Staff inember Wernimont detailed the staff report. He noted the unique situation
involving a duplex with a 0' lot line which would bisect the garage. He noted there is
common access to the garage and he recommended to the applicant that they should
provide a maintenance and access agreement.
The Board Members discussed the proposal questioning whether stormwater would be
addressed through the building process.
Staff inember Wernimont noted the staff report and explained the proposed footprint of
the building does not exceed the 40°kmaximum lot area requirement.

Motion by Pope, seconded by McCoy, to approve the Special Exception as submitted.
Motion carried by the following vote: Aye — Ahlvin, Cremer, Golombeski, Pope and
McCoy; Nay — None.

special exceptions, noting each case is individual and should be treated that way.
