City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Thomas Place Retaining Wall Repair Project, as completed by Drew Cook &
Sons Excavating, Co, Inc., in the final contract amount of$81 ,014.17, which is a 54°k
increase from the original contract in the amount of$52,420.00. The increase in
construction costs was due to additional rock removal, additional grading, additional
HMA pavement, added HMA curb and gutter, added seeding and topsoil and added
limestone for the wall repair not included in the original scope of work.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Thomas Place Retaining Wall Repair Project
INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Thomas Place Retaining Wall Repair Project.
BACKGROUND
The Thomas Place Retaining Wall Repair Project provided for the repair of 12 feet of
existing limestone retaining wall & replacement of 92 feet of existing retaining wall with a
reinforced concrete wall. The project also included 26 LF of steel W-Beam guardrail with
wood posts, a 92 feet of chain link fence and 198 SF of 5" HMA pavement for the street
repair.
DISCUSSION
The Thomas Place Retaining Wall Repair Project was completed by Drew Cook & Sons
Excavating, Inc. of Dubuque, lowa, in the final contract amount of $81,014.17, which is a
54% increase from the original contract in the amount of$52,420.00.
The increase in construction costs were due to additional rock removal, additional
grading, additional HMA pavement, added HMA curb and gutter, added seeding and
topsoil and added limestone for the wall repair not included in the original scope of work.
The project was designed and estimated by WHKS.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment of
the contract amount of $81,014.17 to Drew Cook & Sons Excavating, Co., Inc. for the
Thomas Place Retaining Wall Repair Project.

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution to accept the
improvements and to authorize the payment of the contract amount of $81,014.17 to
Drew Cook & Sons Excavating, Co., Inc. for the Thomas Place Retaining Wall Repair
Project.

RESOLUTION NO. 301-18
ACCEPTING THE THOMAS PLACE RETAINING WALL REPAIR PROJECT AND
AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Thomas Place Retaining
Wall Repair Project (the Project) has been completed by the Contractor, Drew Cook &
Sons Excavating, Co., Inc. (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $81,014.17;
WHEREAS, the Contractor has previously been paid $76,963.46, leaving a
balance of $4,050.71; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $4,050.71 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
