The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting the rezoning will facilitate the
opening of a new restaurant in the building.
Staff reviewed the staff report, reviewing surrounding zoning and land use, allowed uses
in the C-4 Downtown Commercial District, and parking availability.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request. i

Property History: The subject property is half of an 1888 Queen Anne/Second Empire
Double House. The property is part of the original town plat and is located in the
Cathedral Historic Preservation District.
Physical Characteristics: The subject property is an approximately 2,142 square foot lot
located midblock along Bluff Street between 6�h and 7th Streets in a mixed-use area.
The property accommodates half of an 1888 Queen Anne/Second Empire Double
House. The footprint of the subject building is approximately 1,310 sq. ft and shares a
common lot line with the other half of the duplex to the north. The property is bordered
by the other half of the double house being used as a duplex to the north, Bluff Street
and Washington Park to the east, a nine-space parking lot to the south and a bluff to
the west. There are metered parking spaces located on both side of Bluff Street at this
location.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
infill and mixed-use residential and commercial development and recommends
buffering non-compatible uses from each other. The City's 2030 Future Land Use Plan
identifies this area as commercial/residential.
Impact of Request on:
Utilities: All City utilities are available to the property.

Traffic Patterns/Counts: IDOT 2013 Traffic maps indicate 4,000 average daily trips '
south bound along Bluff Street just north of the subject property. �
Public Services: Existing public services are adequate to serve the site.

Environment: Staff does not anticipate any adverse impact to the environment as i
the site is fully developed.

Adjacent Properties: The property is bordered by the other half of the double house �
being used as a 3-plex to the north, Bluff Street and Washington Park to the east, !
a parking lot to the south and a bluff to the west. The other surrounding property
consists of the Carnegie-Stout Public Library, a parking lot, and the back side of
commercial buildings with upper story residential development that face Main �
Street. The applicant owns the parking lot on the adjacent property. The
proposed rezoning should have little additional impact on the neighborhood.
Staff Analysis: The applicant is requesting to rezone the subject property from OR
Office Residential to C-4 Downtown Commercial district. The property is a 2,142 square

The applicanYs request represents an expansion of the C-4 district that located across
Bluff Street. The C-4 district permits additional commercial uses that are not permitted
in the OR district. Several of the uses listed in the C-4 district would not likely locate on
the subject property due to site constraints such as limited access, parking and
building/lot area. In addition, some of the more intense vehicle related uses in the C-4
district such as drive-through restaurants and vehicle repair require that the Zoning
Board of Adjustment review and approve a Conditional Use Permit at a public hearing.
Staff recommends the Commission review the criteria established in Section 6-1.1 of
the Zoning Ordinance regarding granting a rezoning.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 701 BLUFF STREET FROM
OR OFFICE RESIDENTIAL DISTRICT TO C-4 DOWNTOWN COMMERCIAL
DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter described
property from OR Office Residential District to C-4 Downtown Commercial District, to
wit:
Lot 1 of 2 of 2 City Lot 653 and Lot 1 of 3 City Lot 653A, and to the centerline of
the adjoining public right-of-way, all in the city of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
