Van Milligen, City Manager MEMORANDUM April 1, 2003 SUBJECT: Usage Policies for Amphitheater, River's Edge Plaza and Riverwalk City staff has been working to develop a policy for use of the Alliant Energy Amphitheater, the Pavilion at the American Trust River's Edge Plaza and the Mississippi Riverwalk. The process has included obtaining input from the America's River project partners. Assistant City Manager Cindy Steinhauser is recommending adoption of the following policies: The Ailiant Energy Amphitheater Hours General public use is available 24 hours per day. Special event usage is as follows: 7:00 a.m. to 10:00 p.m. Sunday through Thursday 7:00 a.m. to 2:00 a.m. Friday, Saturday and holidays. Rental Fee $200 per day. Reservations will be taken by the Leisure Services Department and are available for public or private special events. Alcoholic beverages Beer, Wine and Liquor are prohibited except for special events. Glass containers are not allowed. Pets Pets are not allowed. The Pavilion at the American Trust River's Edge Plaza Hours General public use is available 24 hours per day. Prohibited events Same as above As noted in the above usage policies, alcohol would be allowed on the Mississippi Riverwalk and at the River's Edge Plaza for public special events only. Public events shall be defined as events where the general public is invited and are sponsored by a not-for-profit organization. Due to construction, it is also recommended that the Alliant Energy Amphitheater not be available for use until 2004. Discussion City staff has been working to develop a list of criteda for public use of the Alliant Energy Amphitheater, the Pavilion at the American Trust River's Edge Plaza and the Mississippi Riverwalk. As noted in the above usage policies, alcohol would be allowed on the Mississippi Riverwalk and at the Rivers Edge Plaza for public special events only. Public events shall be defined as events where the general public is invited and are sponsored by a not-for-profit organization. These usage policies will be provided to applicants at the time of a reservation request and will be enforced by the Leisure Services Department and Operations and Maintenance Department. Aisc attached is a copy of a proposed ordinance prepared by Gil Spence and Barry Lindahl. Upon adoption, the ordinance will allow enforcement by the City of Dubuque. It is also the recommendation of staff that usage of the Alliant Energy Amphitheater not be available until 2004 due to the construction that will be occurring at the Port of Dubuque. Throughout most of 2003, Bell Street and Fifth Street will be under construction, as will the Grand River Center and adjacent parking lots. In addition, construction at the Brewery could also occur throughout 2003. The construction will significantly limit access to the Amphitheater and create difficulty for anyone who may want to host a special event at the Amphitheater. Action The requested action is for City Council to adopt the proposed ordinance and usage policies for the Alliant Energy Amphitheater, the Pavilion at the American Trust River's Edge Plaza and the Mississippi Riverwalk. Intoxicating Beverages: (a) The consumption or use of "alcoholic liquors" or "wine" as defined by chapter 123 of the Code of Iowa or any type of wine product is prohibited in any public park or park and recreation facility including park roadways and parking lots. This paragraph shall not apply, however, to the consumption or use of alcoholic liquors or wine in Four Mounds Park at an event sponsored or expressly approved by the Four Mounds Foundation, or at public events sponsored by non-prof~ organizations held at the American Trust River's Edge Plaza or the Mississippi Riverwalk and for which a special events permit has been issued, or at an event at the Alliant Energy Amphitheater for which a special events permit has been issued. Section 2. Section 10. The City of Dubuque Code of Ordinances is amended by adding thereto the following new section: Sec. 34-136. Mississippi Riverwalk.' The following described parcel of real estate is and shall be used for public park purposes and shall be continued to be known, celled and named as "Mississippi Riverwalk" and placed under the jurisdiction of the Park and Recreation Advisory Commission: The walkway on the floodwall between The American Trust River's Edge Plaza and the Alliant Energy Amphitheater. Section 1t. The City of Dubuque Code of Ordinances is amended by adding thereto the following new section: Sec. 34-137. Alliant Energy Amphitheater: The following described parcel of real estate is and shall be used for public park purposes and shall be continued to be known, called and named as "Alliant Energy Amphitheater" and placed under the jurisdiction of the Park and Recreation Advisory Commission: The area of the Port of Dubuque west of the Mississippi Riverwalk, south of the railroad tracks east of Bell Street, and adjacent to the former Dubuque Star Brewery. Section 12. The City of Dubuque Code of Ordinances is amended by adding thereto the following new section: Sec. 34-138. Ice Harbor Park: The following described parcel of real estate is and shall be used for public park purposes and shall be continued to be known, called and named as "Ice Harbor Park" and placed under the jurisdiction of the Park and Recreation Advisory Commission: The area of the Port of Dubuque between the Portside Building and the National Mississippi River Museum and Aquarium.
