Van Milligen, City Manager SUBJECT:Extension of Highway 20 Moratorium A request has been received from the Iowa Department of Transportation (IDOT) to extend the building permit moratorium on Highway 20, in connection with the U.S. Mississippi River Crossing Study. Building Services Manager Rich Russell recommends extension of the building permit moratorium for Highway 20, from Bluff Street east to the city limits, until May 1, 2004. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen, City Manager FROM: Rich Russell, Building Services Manager RE: Extension of Highway 20 Moratorium INTRODUCTION: This memo transmits a request from the Iowa Department of Transportation (IDOT) for the City to extend the building permit moratorium on Highway 20, in connection with the US. Mississippi River Crossing Study. An ordinance and map are attached. DISCUSSION: On May 4, 1998, the City Council established a six month moratorium for Highway 20 from Bluff Street to Cherokee Drive/Collins Street, for the completion of the Highway 20 Land Use Plan. On April 19, 1999, the City Council extended the moratorium to May 1, 2000, and expanded the area of the moratorium to include Highway 20 east from Bluff Street to the city limits. In early 2000, 2001 and 2002, the City Council extended this moratorium for one year periods ending May 1, 2001, 2002 and 2003 respectively. In the 2000 memo, the area of the moratorium was reduced in area from Collins Street east to Bluff Street east. At this time, the IDOT has requested another one-year extension for the moratorium. Please see the attached letter from the IDOT. On April 17, 2003, the IDOT held a public hearing on the determination of right-of-way needs. The attached map shows that area. RECOMMENDATION: I recommend that the City Council extend the building permit moratorium for Highway 20,from Bluff Street east to the city limits, as requested by the IDOT in connection with the U.S. Mississippi River Crossing Study. The project consultant has been asked to prepare a diagram showing the area to be covered by the moratorium based on right of way needs determined for this project. Upon receipt, the diagram will be provided to you. The dePartment is in the process of beginning to acquire right of way for this project. HIGHWAY 20 CORRIDOR. Whereas, the Iowa and Illinois Departments of Transportation has conducted a U.S 20 Mississippi River Crossing Study and determined the right-of-way needs for the project; and, Whereas, the ~ssuance of permits in the proposed right-of-way of U.S. 20 could impact the project negatively. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Chapter 11 (Buildings and Building regulations) of the City of Dubuque Code of Ordinances is hereby amended by amending Section 11-58.1 as follows: Section 11-58.1 Moratorium -for work in the U.S. 20 Corridor. The building official shall not issue any permit for any new construction or substantial enlargement, alteration, repair or remodeling of any structure, building, or sign in the U.S. 20 (Dodge Street), but not to include demolition, from the eastern corporate limits of the City of Dubuque westerly to the intersection of U.S. 20 (Dodge Street) with Bluff Street, as shown on the map on file in the Office of the City Clerk, 50 West 13th Street, Dubuque, Iowa, during a period from May 2, 2003 to May 1, 2004, except where a vested right to the issuance of such permit accrued prior to May 1, 2001 Section 2.
