SUBJECT:Building Permit Moratorium - IA 32/Southwest Arterial Corridor
A request has been received from the Iowa Department of Transportation (IDOT) to
extend the moratorium in the IA 32/Southwest Artedal Corridor to prevent development
that might be incompatible with the future alignment of the roadway.
Building Services Manager Rich Russell recommends extension of the Building Permit
Moratorium until May 1, 2004.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Building Permit Moratorium--lA32-Southwest Arterial Corridor
INTRODUCTION: This memo transmits a request by the Iowa Department of
Transportation (IDOT) to extend the moratorium in the IA32-Southwest Arterial
Corridor. I have attached the written IDO T request and map for your information.
The City Council previously adopted Ordinances 101-00 and 20-02 to establish
and extend this moratorium.
DISCUSSION: Without a moratorium, development could occur in the Southwest
Arterial Corridor that might be incompatible with the future alignment of the
roadway. To avoid this situation, the IDOT has requested that the City of
Dubuque extend the previously established moratorium for another one-year
period. Adoption of the moratorium would allow the City to further explore
alternative routes and environmental impacts.
To extend the moratorium, the City Council must approve the attached ordinance
to amend Section 11-58.3 of the City Code.
RECOMMENDATION: I recommend that the City Council extend the moratorium
until May 1, 2004.

SUBJECT: U.S. 20 Capacity Study
Dear Mr. Russell:
I would like to request City Council approval to extend the present development moratorium in the
area of the proposed interchange at U.S. 20 and Seippel Road for another twelve month period
effective May I, 2003. The moratorium area also falls within the present Southwest Arterial project
study area. The project consultant has been asked to review and update as needed the diagram
showing the area to be covered by the moratorium based on interchange concept alternatives still
under consideration at this time. Upon receipt, the diagram will be provided to you.

ORDINANCE NO. 22-03
AN ORDINANCE AMENDING CHAPTER 11 (BUILDINGS AND BUILDING
REGULATIONS) OF THE CITY OF DUBUQUE CODE OF ORDINANCES
SECTION 11-58.3 ESTABLISHING A MORATORIUM ON THE ISSUANCE OF
PERMITS FOR WORK IN THE IA32-SOUTHWEST ARTERIAL CORRIDOR BY
EXTENDING SUCH MORATORIUM FOR TWELVE MONTHS,
Whereas, the Iowa Department of Transportation (IDOT) and the City of Dubuque
are conducting an IA32-Southwest Arterial Corridor Study, which will include the
determination of a preferred alignment; and
Whereas, Section 1 i-58.3 of the City of Dubuque Code of Ordinances establishing a
moratorium on the ~Ssuance of permits for work in the corridor; and
Whereas, the IDOT has requested that the City of Dubuque extend said moratorium an
additional twelve months to allow the City to further explore alternative routes and
environmental impacts; and
Whereas, the City of Dubuque desires to minimize potential development conflicts
during this study by extending the moratorium for the IA32-Southwest Arterial Corridor.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Chapter 11 (Buildings and Building Regulations) of the City of Dubuque
Code of Ordinances Section 11-58.3 is hereby amended as follows:
Section 11-58.3 Moratorium - for work in the IA32-Southwest Arterial Corridor. The
Building Official shall not issue any permit for any new construction or substantial
enlargement, alteration, repair or remodeling of any structure, building, or sign in the
IA32-Southwest Arterial Corridor but not to include demolition, as shown on the map
on file in the Office of the City Clerk, 50 West 13th Street, Dubuque, Iowa, during a
period from the date of publication of this ordinance to May 1,2004, except where a
vested right to the issuance of such permit accrued prior to November 20, 2000.
Sec{ion 2. This Ordinance shall take effect upon publication, as provided by law.
