Maintenance of said improvements shall be provided by the owner, Derby Grange LLC, for a period of two years from the date of acceptance. Van Milligen, City Manager � FROM: Gus Psihoyos, City Engineer �� � ' DATE: November 7, 2018 SUBJECT: Acceptance of Subdivision Improvements in Rustic Point Subdivision INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements that the developers, Derby Grange LLC, have recently completed in Rustic Point Subdivision. BACKGROUND As a condition of subdivision plat approval through Resolution No. 266-17, the developer of Rustic Point Subdivision was required to install certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, street lighting, fiber optic conduit, and storm water detention facilities and to dedicate said improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On August 7, 2018, the owners requested City's acceptance of the improvements in Rustic Point Subdivision. Upon inspection by the City, it has been determined tr�at the public improvements required by Resolution 266-17, except for storm water detention facilities, have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would, therefore, recommend that the City Council accept the public improvements, except for storm water detention facilities, as described above. Maintenance guarantees for said public improvements shall be provided by the owners, Derby Grange LLC, for a period of two (2) years from the date of acceptance by City Council. Brant Schueller, Water Department Dean Mattoon, Engineering Assistant John Klosterman, Public Work Director RESOLUTION NO. 340-18 ACCEPTING PUBLIC IMPROVEMENTS IN RUSTIC POINT SUBDIVISION, IN THE CITY OF DUBUQUE, IOWA Whereas, pursuant to Resolution 266-17, certain public improvements including street paving with curb, sanitary sewer main, water main, storm sewers and catch basins, street lighting, fiber optic conduit, and storm water detention facilities were installed by the developer of Rustic Point Subdivision in the City of Dubuque, Iowa; and Whereas, the improvements, except for storm water detention facilities, have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in Rustic Point Subdivision, except for storm water detention facilities, be and the same is hereby accepted. Section 2.' That a maintenance guarantee covering said public improvements shall be provided: by the owners, Derby Grange LLC, for a period of two (2) years from the date of this resolution. Derby Grange LLC is also requesting acceptance of the public improvements by the City of Dubuque for its ownership and maintenance. We understand that warranty/maintenance securities must remain in place for a two-year period after City Council acceptance of the public improvements.
