Buol and Members of the City Council DATE: November 13, 2018 RE: Tom Coyle Claim Denial Appeal This is an appeal by Tom Coyle to the City Council from the denial of his claim for damage to his automobile which resulted when loose asphalt on Roosevelt Street was kicked up by a passing vehicle which struck and damaged claimant's vehicle. The claim was referred to Public Entity Risk Services (PERS), the claims agency for the lowa Communities Assurance Pool. PERS investigated the claim and determined that the City was not at fault. Municipal Liabilitv for Damaqe Caused bv Street Defects Below is an lowa Supreme Court opinion on the subject of municipal liability for street defects. The law is well established: Pietz v. City of Oskaloosa, 250 lowa 374, 376-77, 92 N.W.2d 577, 579 (1958) "However, a city is not required to keep its streets in a condition of absolute safety. It is only required to use ordinary and reasonable care to that end. It does not insure the safety of travelers upon its streets, nor it is required to foresee and provide against every possible accident. It must have actual notice of the dangerous condition of the street, or the condition must have existed for a sufficient time to enable the city to discover and repair the same, in the exercise of reasonable and ordinary care and diligence.' See, also, Florey v. City of Burlington, 247 lowa 316, 73 N.W.2d 770, supra; Hall v. Town of Keota, 248 lowa 131, 79 N.W.2d 784." We are not aware of any lowa appellate court decision imposing on cities a duty to have a regular or continued inspection of street or a duty to inspect that which presents no visible signs of defects or danger. The City is limited to observing visible signs bf a problem, in which case the condition is investigated further. The City did not have actual notice of the defective condition of the street, nor is there any way to know whether the condition must have existed for a sufficient time to enable the City to discover and repair the condition, in the exercise of reasonable and ordinary care and diligence. In addition to the foregoing common law principles of a city's responsibility for a defective street, lowa Code Section 670.4(1) provides that a city is immune for liability for "(f) Any claims for damages caused by a municipality's failure to discover a latent defect in the course of an inspection." Y � Roosevelt street was in disrepair and many large pieces af asphalt w�re laying around the street due to asphalt breaking off along the edges af the str�et ' i submitted a claim to the City af Dubuque which was turned over to the lowa Communities Assurance Pool. After many weeks 1 called lawa Carr�munities Assurance Poal and was tofd my claim was being denied. The reason I was given for denial was that the city can not be held respc�nsible if they dic!not know that the street needed repair. I have no way of knc�wing if the City of l�ubuque krrew the street needed repair or nat, but I feel that their lack of knowledge of the street needing repair dcaes not remove them from liabiiity. I would argue that if a street light fell an � a car or a person in an intersection due to the maunting bracket needirrg repair the city wauld be liable regardless of F their knawledge of the streetlight needing repair or not. I see this road disrepair issue as no different. Damage occurred to my vehicle clue to the disrepair of the road,the disrepair c�f the road could alsa F�ave catase personal � injury#o pedestrians that coulcf be struck by these iarge pieces af asphalt. � Had the damage to my vehicle come fram a rock, c�r a stick or any ather foreign object that may have gotten in the road somehow, I would not be filing a claim, but this damage was caused by th�City af Qubuque`s raad itself creating a hazard to mc�torists and pedestrians,and I strongly fee[#he City of[�ubuque should be helcf liable for the damages.
