Maintenance guarantees for said public improvements shall be provided by the owner, Timber Ridge Estates LLC, for a period of two years from the date of acceptance by City Council. DATE: November 21, 2018 SUBJECT: Acceptance of Subdivision Water Main and Fiber Optics Improvements in Timber Ridge Estates Subdivision, Dubuque County, lowa INTRODUCTION The enclosed material provides for City Council acceptance of the public water main and fiber optics conduit improvements that the developers, Timber Ridge Estates LLC, have recently completed in Timber Ridge Estates Subdivision in Dubuque County. BACKGROUND As a condition of an Agreement between the City and Timber Ridge Estates LLC dated August 21, 2107 and Resolution No. 308-17, the developer of Timber Ridge Estates Subdivision was required to install public improvements including water main and fiber optic conduit and appurtenances and to dedicate said improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On September 27, 2018, the owners requested City's acceptance of the water main and fiber optic conduit improvements in Timber Ridge Estates Subdivision. Upon inspection by the City, it has been determined that the public improvements required by Resolution 308-17, have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION i would, therefore, recommend that the City Council accept the public water main and fiber optic conduit improvements as described above. Maintenance guarantees for said public improvements shall be provided by the owners, Timber Ridge Estates LLC, for a period of two (2) years from the date of acceptance by City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public water main and fiber optic conduit improvements in Timber Ridge Estates Subdivision. It has come to our attention that the city would like a formal letter from us dedicating the water main and fiber conduit utilities to the City of Dubuque for ownership and maintenance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public water main and fiber optic conduit improvements in Timber Ridge Estates Subdivision, be and the same are hereby accepted. Section 2. That a maintenance guarantee covering said public improvements shall be provided by the owners, Timber Ridge Estates LLC, for a period of two (2) years from the date of this resolution.
