Van Milligen, City Manager SUBJECT: Southwest Arterial Project Black Hills Energy Pipeline Utility Relocation Reimbursement Agreement Quit Claim Deed Transfer of Easements DATE: November 28, 2018 By previous action, the City Council approved a Utility Relocation Reimbursement Agreement (Relocation Agreement) with Black Hills Energy for the relocation of a high- pressure natural gas main impacted by the Southwest Arterial Project near English Mill Road. Black Hills Energy owns and operates the impacted natural gas pipeline located on its own private easement through and upon property acquired by the City for the project. As part of the Relocation Agreement, the City purchased replacement permanent easements on private property for Black Hills Energy. The transfer of the permanent utility easements by the City to Black Hills Energy will be by Quit Claim Deed. Assistant City Engineer Bob Schiesl recommends City Council approval of the transfer of easements by Quit Claim Deed to Black Hills Energy Corporation. BACKGROUND By previous action, the City Council approved a Utility Relocation Reimbursement Agreement (Relocation Agreement) with BHEfor the relocation of a high-pressure natural gas main impacted by the Southwest Arterial Project near English Mill Road. BHE owns and operates the impacted 8" and 16" high-pressure natural gas pipeline located on its own private easement through and upon property acquired by the City for the Project as shown in the Quit Claim Deed. As part of the Relocation Agreement, the City purchased replacement permanent easements on private property for BHE to operate, access, repair and maintain its pipeline utility. The transfer of the permanent utility easements by the City to BHE will be by Quit Claim Deed. In return, BHE has agreed to relinquish all rights granted to BHE for those portions of the existing pipeline easements to be vacated after relocation and to subordinate certain specified rights of its easements within the land acquired by the City for future highway right-of-way. The existing and relocated pipeline is shown on the attached aerial exhibit. RECOMMENDATION I recommend that the City Council dispose of the easements by Quit Claim Deed to Black Hills Energy Corporation. ACTION TO BE TAKEN The City Council is requested to approve the disposal of the easements by Quit Claim Deed to Black Hills Energy Corporation by adoption of the enclosed resolution.
