The purpose of this memorandum is to request no action currently be taken on the
adoption of the Amended and Restated Urban Renewal Plan for the Peru Road Urban
Renewal Area following the December 3, 2018 public hearing.
The proposed new Subarea B of the Plan includes property that had previously been
included in the Swiss Valley Urban Renewal Area. Counsel had advised that the Swiss
Valley Urban Renewal Plan be terminated before placing that same property in the Peru
Road Urban Renewal Plan.
I recommend that following the public hearing, no action be immediately taken on the
resolution adopting the Amended and Restated Urban Renewal Plan for the Peru Road
Urban Renewal Area.

INTRODUCTION
The purpose of this memorandum is to forward for City Council review and approval the
Amended and Restated Urban Renewal Plan (Plan) for the Peru Road Urban Renewal
Area (District).
The proposed Amended and Restated Urban Renewal Plan, Version 2018.1, ("Urban
Renewal Plan") for the District would add property to the District to create Subarea B
and authorize the undertaking of an additional urban renewal project in the District with
Prairie Farms Dairy, Inc. consisting of expanding its operations facility.
BAC KG RO U N D
On November 5, 2018, the City Council approved a Resolution of Necessity finding that
the proposed urban renewal area meets the definition of a blighted and an economic
development area under state law, and is appropriate for urban renewal activities to
remediate and stop the spread of the blighted conditions in the District. Further, the
District will be designated as a mixed area for the remediation of blight and promotion of
economic development (commercial and industrial). Staff has prepared an amended
urban renewal plan for the District per the directive of the City Council.
DISCUSSION
In compliance with lowa Code Chapter 403, project details have been included to reflect
current planned work, including the estimated costs of projects under the Plan as well
as estimated project completion timelines.
A consultation process was conducted with the affected taxing entities as required by
Chapter 403.5 of the lowa Code. Prior to the meeting, the taxing entities were mailed
copies of the Urban Renewal Plan and the Notice of Public Hearing. The required
consultation to discuss, question, or object to the findings in these documents was held
on November 15, 2018. There were no representatives from the taxing entities in
attendance.
The notice of public hearing was published on November 23, 2018 in accordance with
publication requirements.
RECOMMENDATION/ ACTION STEP
I recommend that following the public hearing, the attached resolution adopting the
Amended and Restated Urban Renewal Plan for the Peru Road Urban Renewal Area
be approved to support reinvestment efforts in the District.

A. INTRODUCTION
This Amended and Restated Peru Road Urban Renewal Plan ("Plan" or "Urban Renewal
Plan") for the Peru Road Urban Renewal Area ("Area" or "Urban Renewal Area") has
been developed to help local officials promote economic development and remediate
blight in the City of Dubuque (the "City"). The primary goal of the Plan is to stimulate,
through public involvement and commitment, private investment in new commercial and
industrial development and blight remediation.
In order to achieve this objective, the City intends to undertake urban renewal activities
pursuant to the powers granted to it under Chapter 403 and Chapter 15A of the Code of
lowa, as amended.
B. DESCRIPTION OF THE URBAN RENEWAL AREA
The Urban Renewal Area is located entirely within the corporate limits of the City of
Dubuque, lowa. The Urban Renewal Area is illustrated in Attachment A and described in
Attachment D. The City reserves the right to modify the boundaries of the Urban Renewal
Area at some future date. The property originally included in the Area by the original
urban renewal plan is referred to as Subarea A.
This Plan adds property to the Area to be referred to as Subarea B. Subarea A and
Subarea B make up the whole of the Urban Renewal Area.
C. AREA DESIGNATION
With the adoption of this Plan, the City continues to designate this Urban Renewal Area
as a mixed area for the remediation of blight and promotion of economic development
(commercial and industrial). The City Council has determined that a need exists for
redevelopment of the Urban Renewal Area in order to eliminate blight and enhance
economic development activities.
By Resolution No. 330-18 adopted November 5, 2018, the City Council declared that
these factors have impaired the sound growth of the Urban Renewal Area.
D. BASE VALUE
If Subarea B is legally established, a Tax Increment Financing ("TIF") ordinance is
adopted including Subarea B, and debt is certified for the Urban Renewal Area prior to
December 1 , 2019, the taxable valuation within the portion of Subarea B included in the
TIF Ordinance as of January 1 , 2018 will be considered the frozen "base valuation" for
that portion of Subarea B. If debt is not certified in the Urban Renewal Area until a later
date or if a TIF ordinance is not adopted until later, the "base value" will be the assessed
value of the taxable property within the TIF ordinance area as of January 1 of the calendar
year preceding the calendar year in which the City first certifies the amount of any debt
on the Urban Renewal Area.

E. DEVELOPMENT PLAN/ZONING
The City has a general plan for the physical development of the City as a whole outlined
in the 2017 City of Dubuque Comprehensive Plan that was adopted by the City Council
on September 18, 2017. The goals and objectives of this Plan, including the urban
renewal projects, are in conformity with the City's Comprehensive Plan. In addition to the
City's Comprehensive Plan, the planning criteria to be used to guide the physical
development of the Urban Renewal Area are those standards and guidelines contained
within the City of Dubuque's Unified Development Code and other applicable local, state
and federal codes and ordinances.
Land use maps (Attachments B-1 and B-2) identify the existing and proposed land uses
with the Urban Renewal Area. This Plan does not in any way replace or modify the City's
current land use planning or zoning regulation process.
The need for improved traffic, public transportation, public utilities, recreational and
community facilities, or other public improvements within the Urban Renewal Area is set
forth in this Plan, as amended. As the Urban Renewal Area develops, the need for public
infrastructure extensions and upgrades will be evaluated and planned for by the City.
F. PLAN OBJECTIVES
Renewal activities are designed to provide opportunities, incentives, and sites to promote
new and existing economic development (commercial and industrial) and to promote
blight remediation. More specific objectives for the development, redevelopment and
rehabilitation within the Urban Renewal Area are as follows:
1 . To achieve a diversified, well-balanced economy providing a desirable
standard of living, creating job opportunities, and strengthening the tax base.
2. To plan for and provide sufficient land for commercial and industrial
development in a mannerthat is efficient from the standpoint of providing municipal
seroices.
3. To provide for the installation of public works and facilities including, but not
limited to, water, sanitary sewer and other public improvements, which contribute
to the revitalization of the area and to the sound development of the entire City.
4. To eliminate blighting influences and promote revitalization.
5. To encourage commercial and industrial growth and expansion through
governmental policies which make it economically feasible to do business.
6. To provide a more marketable and attractive investment climate through the
use of various federal, state and local incentives.

7. To stimulate, through public action and commitment, private investment in
new and existing commercial and/or industrial development.
8. To improve the conditions and opportunities for economic development
(commercial and industrial) and blight remediation.
9. To help develop a sound economic base that will serve as the foundation
for future growth and development.
10. To enhance the community by fostering an entrepreneurial climate,
diversifying the local economy, encouraging opportunities for new businesses, and
supporting retention of existing businesses.
11 . To provide for the matching share for a variety of local, state and federal
grants and loans.
12. The deconstruction/demolition of a century old manufacturing facility in the
Urban Renewal Area.
G. TYPES OF RENEWAL ACTIVITIES
To meet the objectives of this Plan and to encourage orderly development of the Urban
Renewal Area, the City intends to utilize the powers conferred under Chapter 403 and
Chapter 15A, Code of lowa. General development activities in the Urban Renewal Area
may include:
1 . To undertake and carry out urban renewal projects through the execution
of contracts and other instruments.
2. To arrange for or cause to be provided the construction or repair of public
infrastructure including but not limited to streets, curb and gutter, street lighting,
water, sanitary sewer, public utilities or other facilities in connection with urban
renewal projects.
3. To finance programs that will directly benefit blight remediation.
4. To make loans, forgivable loans, grants, tax rebate payments or other types
of economic development grants or incentives to private persons, local
development organizations, or businesses for economic development purposes on
such terms as may be determined by the City Council.
5. To borrow money and to provide security therefor.
6. To acquire or dispose of property. The City does not intend to acquire any
property with the Urban Renewal Area. However, the City reserves the right to

acquire, by negotiation or eminent domain, property rights required for the
construction or reconstruction of streets and public utilities, or any other public
facility or improvement.
7. To provide for the construction of specific site improvements such as
grading and site preparation activities, access roads and parking, fencing, utility
connections, and related activities.
8. To acquire property through a variety of ineans (purchase, lease, option,
etc.) and to hold, clear, or prepare the property for redevelopment.
9. To undertake the demolition and clearance of existing development.
10. To make or have made surveys and plans necessary for the implementation
of this Plan or specific urban renewal projects.
11 . To use any or all other powers granted by the Urban Renewal Act to
remediate blight, develop and provide for improved economic conditions for the
City.
Nothing herein shall be construed as a limitation on the power of the City to exercise any
lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter
427B, or any other provision of the Code of lowa in furtherance of the objectives of this
Plan.
H. ELIGIBLE URBAN RENEWAL PROJECT(S)
Although certain project activities may occur over a period of years, the eligible urban
renewal projects under this Plan include:

2. Tax Rebate or other Development Aqreements
a. Development Agreements: The City expects to consider requests for
Development Agreements for projects that are consistent with this Plan, in
the City's sole discretion. Such Development Agreements are unknown at
this time, but based on past history, and dependent on development
opportunities and climate, the City expects to consider a broad range of
incentives as authorized by this Plan, including but not limited to land, loans,
grants, tax rebates, infrastructure assistance and other incentives. The
costs of such Development Agreements will not exceed $3,500,000.
b. Development Agreement with Prairie Farms: The City anticipates entering
into a development agreement with Prairie Farms for the development of a
property in the Urban Renewal Area. Pursuant to the agreement, Prairie
Farms would expand its current production facility and would agree to hire
an additional ten (10) employees at the property. The City expects to
support the project by providing semi-annual grants, pursuant to the
detailed terms of the development agreement, which are not to exceed
$420,000.

costs to support urban renewal projects and planning.

4. Costs related to the planning and administration of this Plan consistent with the

J. URBAN RENEWAL FINANCING
The City intends to utilize various financing tools such as those described below to
successfully undertake the proposed urban renewal actions. The City has the statutory
authority to use a variety of tools to finance physical improvements within the Urban
Renewal Area. These include:
1 . Tax Increment Financing
Under Section 403.19 of the lowa Code, urban renewal areas may utilize the tax
increment financing mechanism to finance the costs of public improvements or economic
development incentives associated with redevelopment projects. Upon creation of a tax
increment district within the Urban Renewal Area, by ordinance, the assessment base is
frozen and the amount of tax revenue available from taxes paid on the difference between
the frozen base and the increased value, if any, is segregated into a separate fund for the
use by the City to pay costs of the eligible urban renewal projects. The increased taxes
generated by any new development, above the base value, are distributed to the taxing
entities, if not requested by the City.

2. General Obligation Bonds
Under Division III of Chapter 384 and Chapter 403 of the lowa Code, the City has the
authority to issue and sell general obligation bonds for specified essential and general
corporate purposes, including the acquisition and construction of certain public
improvements within the Urban Renewal Area or incentives for development consistent
with this Plan. Such bonds are payable from the levy of unlimited ad valorem taxes on all
the taxable property within the City. It may be the City will elect to abate some or all of the
debt service on these bonds with incremental taxes from this Urban Renewal Area.
The City may also determine to use tax increment financing to provide incentives such as
cash grants, loans, tax rebates or other incentives to developers in connection with urban
renewal projects for commercial or industrial development, blight remediation,
redevelopment, or other urban renewal projects. In addition, the City may determine to
issue general obligation bonds, tax increment revenue bonds or such other obligations,
or loan agreements for the purpose of making loans or grants of public funds to private
businesses located in the Urban Renewal Area. Alternatively, the City may determine to
use available funds for making such loans or grants for urban renewal projects. In any
event, the City may determine to use tax increment financing to reimburse the City for
any obligations or advances.
Nothing herein shall be construed as a limitation on the power of the City to exercise any
lawful power granted to the City under Chapter 15, Chapter 15A, Chapter 403, Chapter
427B, or any other provision of the Code of lowa in furtherance of the objectives of this
Plan.
K. PROPERTY ACQUISITION/DISPOSITION
If property acquisition/disposition by the City becomes necessary to accomplish the
objectives of this Plan, such acquisition/disposition will be carried out, without limitation,
in accordance with the Code of lowa.
L. RELOCATION
The City does not expect there to be any relocation required as part of the eligible urban
renewal projects; however, if any relocation is necessary, the City will follow all applicable
relocation requirements.
M. STATE AND LOCAL REQUIREMENTS
All provisions necessary to conform to state and local laws will be complied with by the
City and developers in implementing this Plan and its supporting documents.
N. URBAN RENEWAL PLAN AMENDMENTS

This Plan may be amended from time to time for a variety of reasons, including but not
limited to, change in the area, to add or change land use controls and regulations, to
modify goals or types of renewal activities, to add or change urban renewal projects, or
to amend property acquisition and disposition provisions. The City Council may amend
this Plan in accordance with applicable state law.
O. EFFECTIVE PERIOD
This Plan will become effective upon its adoption by the City Council and will remain in
effect as a Plan until it is repealed by the City Council. There is no statutory limitation on
the collection oftax increment in this Urban Renewal Area because it is a mixed economic
development and blight area. At all times, the use of tax increment financing revenues
(including the amount of loans, advances, indebtedness or bonds which qualify for
payment from the division of revenue provided in Section 403.19 of the Code of lowa) by
the City for activities carried out under the Urban Renewal Area shall be limited as
deemed appropriate by the City Council and consistent with all applicable provisions of
law. The division of revenues shall continue on the Urban Renewal Area, forthe maximum
period allowed by law.
P. SEVERABILITY CLAUSE
If any part of the Plan is determined to be invalid or unconstitutional, such invalidity or
unconstitutionality shall not affect the validity of the previously adopted Plan as a whole,
or any part of the Plan not determined to be invalid or unconstitutional.

APPROVING THE AMENDED AND RESTATED URBAN RENEWAL PLAN FOR THE
PERU ROAD URBAN RENEWAL AREA
Whereas, by Resolution 330-18 on November 5, 2018 the City Council ofthe City of
Dubuque, lowa authorized the preparation of an Amended and Restated Urban Renewal
Plan (the "Plan") for the Peru Road Urban Renewal Area (the "Area"); and
Whereas, the proposed Plan for the Area has been prepared and placed on file
for public inspection in the City Clerk's Office; and
Whereas, the City Council of the City of Dubuque has determined that the creation
of the Area will stimulate, through public involvement and commitment, blight mitigation
and private investment in redevelopment activity; and
Whereas, a consultation process has been undertaken with affected taxing
entities in accordance with Chapter 403 of the Code of lowa with no written objections
or recommended changes to the Plan received; and
Whereas, the City Council, in accordance with Chapter 403 of the Code of lowa,
has held a public hearing on the proposed Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1 . That the Amended and Restated Urban Renewal Plan for the Peru
Road Urban Renewal Area, on file in the City Clerk's Office and made reference to
herein, is hereby approved; that a feasible method exists for the location of any families
who will be displaced from the Area into decent, safe and sanitary dwelling
accommodations within their means and without undue hardship to such families; and
that the Plan conforms to the general plan of the City as a whole. The City does not
currently anticipate the acquisition of any real property in connection with the land and
projects included in the Plan.
Section 2. That the Peru Road Urban Renewal Area is a mixed area for the
remediation of blight and promotion of economic development (commercial and industrial)
within the meaning of lowa Code Chapter 403; that such area is eligible for designation as
an urban renewal area and otherwise meets all requisites underthe provisions of Chapter
403 of the Code of lowa; and that the rehabilitation, conservation, redevelopment,
development, or a combination thereof, of such area is necessary in the interest of the
public health, safety or welfare of the residents of this City.
Section 3. That, notwithstanding any prior resolution, ordinance, plan,
amendment or any other document, the Plan shall be in full force and effect from the
date of this Resolution until the Council amends or repeals the Plan.
Section 4. That the City Clerk of the City of Dubuque, lowa is hereby authorized
and directed to file a certified copy of this Resolution in the office of the Dubuque
County Auditor.
