COUNCIL ACTION

INTRODUCTION
This memorandum provides a contract with the Dubuque County Health Department for
services related to the H1N1 pandemic.
BACKGROUND
The Iowa Department of Public Health has provided local Boards of Health with Federal
Phase I, Phase II and Phase III H1N1 supplemental funding. The Iowa Department of
Public Health requires subcontracts to community -based agencies and health care
providers who have assisted in the H1N1 pandemic response. This subcontract
primarily pertains to communication and education related to H1N1 pandemic response
by the City of Dubuque Health Services Department. Money spent for radio and print
advertising will be claimed separately.
DISCUSSION
Monies will be claimed with the Dubuque County Health Department similarly to the
Core Preparedness funds which are processed monthly. The Health Services
Department assisted with local vaccine distribution, vaccination and community
education. Health care provider communication and education was coordinated and
provided regularly. Radio commercials and print ads were developed and distributed,
along with ten media releases.
RECOMMENDATION
Approve the attached contract with the Dubuque County Health Department for public
health emergency preparedness and response, H1N1 pandemic response.

The subcontractor agrees to perform the work and to provide the services described in the special conditions
for the consideration. stated herein. The duties, rights and obligations of the parties to this contract shall be
governed by the contract documents, which include the special conditions, general conditions.
The Subcontractor has reviewed and agrees to the Iowa Department of Pubic Health General Conditions
effective February 1, 2007 as posted on the Iowa Department of Public Health Website under Grants, Bids
and Proposals: www.idph.state.ia.us. The subcontractor specifies no changes have been made to the Special
Conditions or General Conditions.

Article I — Identification of Parties:
This contract is entered into by and between the Dubuque County Health Department
(hereinafter referred to as the Contractor) and the Subcontractor, as identified on the contract
face page.
Article II — Designation of Authorized County Official:
Paul A. Buss, Jr., PhD, Administrator, Dubuque County Health Department, is Authorized for
this contract. Any changes in the terms, conditions, or amounts specified in this contract must be
approved by the Authorized Official. Negotiations concerning this contract should be referred to
Paul A. Buss, Jr., PhD; 563.557.7396.
Article III — Designation of Subcontractor, Project Director and Key Personnel:
1. The Subcontractor, as listed on the contract face page, is responsible for financial and
administrative matters of this contract.
2. The Subcontractor has designated the project director listed on the contract face page the
authority to manage the contract, to assure compliance with all conditions, and to
negotiate matters concerning this project. The project director will receive key
communications from the Contractor and will be responsible for keeping the
Subcontractor and all authorized agencies informed.
Article IV — Statement of Contract Purpose:
Communication and Education related to H1N1 Pandemic Response
1. Personnel time to create, coordinate, and conduct training in the Dubuque County
community relating to H1N1 pandemic prevention and response.
2. Personnel time to attend pandemic planning meetings in the community and within the
subcontractor's facility.
3. Printed materials relating to influenza prevention and response.
Vaccine
1. Personnel time to conduct HINI Influenza A mass vaccination clinics in which no
additional billing for the administration of vaccine has taken place. Those vaccinated
must fall into at least one of the priority populations as identified in the Iowa Department
of Public Health's HIN1 Provider Agreement with the Visiting Nurse Association,
Dubuque, IA.
2. Dubuque County will pay Subcontractor $1 for each vaccination IRIS data entry. Proper
paperwork must be submitted to the County Health Department showing how many IRIS
data entries were entered.
3. Personnel time to deliver H1N1 Influenza A vaccine to outlying clinics in the VNA
system.
4. Supplies such as masks and gloves needed to conduct H1N1 Influenza A mass
vaccination clinics.
5. Refrigeration needed to appropriately store H1N1 Influenza A vaccine.

Article V — Reports:
The Subcontractor shall prepare invoices for items /personnel time noted in Article IV and
submit to the Dubuque County Health Department. Payments are based on availability of
funds.
This subcontract is in the amount of $15,000.00.
Any single item with a cost that exceeds $5,000 must be submitted to the Contractor for
approval. The Contractor will in turn request approval from the Iowa Department of Public
Health.
Supporting information such as personnel records shall be provided to Contractor for audit
when requested.
Final invoice shall be received by August 10, 2010.

Article IX— Additional Conditions
Indemnification — Subcontractor agrees to defend, indemnify, and hold Department and
Contractor, and their officers and employees from and against any and all claims of any kind
arising out of or related to Subcontractor's negligence in the performance of the Work and
Services pursuant to this Subcontract.
Insurance — Subcontractor shall at its expense maintain insurance or self-insure with the same
coverage which Contractor is required to maintain under Par. 13 of the General Conditions.
