SUBJECT: Acceptance of Public Improvements in South Pointe Subdivision
DATE: January 15, 2019
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Dubuque South Pointe, LLC, has recently completed in South Pointe
Subdivision. A maintenance guarantee covering said public improvements shall be
provided by the owners, Dubuque South Pointe, LLC, for a period of two years from the
date of acceptance by the City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in South Pointe Subdivision
INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
that the developers, Dubuque South Pointe, LLC, have recently completed in South
Pointe Subdivision.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 211-17, the
developer of South Pointe Subdivision was required to install certain public
improvements including street paving with curb, storm sewer and catch basins, storm
water detention facilities, sanitary sewer main, water main, fiber optic conduit, and street
lighting and to dedicate these improvements to the City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On October 22, 2018, the owners requested City's acceptance of the public
improvements in South Pointe Subdivision. Upon inspection by the City, it has been
determined that the public improvements required by Resolution 211-17 have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.

RESOLUTION NO. 30-19
ACCEPTING PUBLIC IMPROVEMENTS IN SOUTH POINTE SUBDIVISION IN THE
CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution 211-17, certain public improvements including
street paving with curb, storm sewer and catch basins, storm water detention facilities,
sanitary sewer main, water main, fiber optic conduit, and street lighting were installed by
the developer of South Pointe Subdivision in the City of Dubuque, Iowa; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that said
public improvements in South Pointe Subdivision be and the same is hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements shall be
provided by the owners, Dubuque South Pointe, LLC, for a period of two (2) years from
the date of this resolution.

Substantial Completion Inspection
Dear Mr. Kieffer:
Per our conversations over the past few days, Dubuque South Pointe, LLC is substantially completed with the
construction of the improvements at the above project. There are minor items being completed by the
contractors over the next few days. These include backfilling along sidewalks and curbs, cleaning detention
basins, installing permanent erosion control measures, and seeding.
Please begin the necessary inspections of the improvements to be dedicated to the public as soon as possible.
We are intending to request a reduction in the retainage to 25% of the construction costs shortly.
