City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the 2017 Windsor Avenue Sanitary Sewer Manhole Project, as
completed by Drew Cook & Sons Excavating, in the final contract amount of
$18,390.38, which is a 0.6°k decrease from the original contract amount of$18,500.00.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the 2017 Windsor Avenue Sanitary Sewer Manhole Project.
BACKGROUND
The City of Dubuque, lowa is under a Consent Decree according to Case
2:11-cv-01001-EJM, United States of America and the State of lowa v. the City of
Dubuque, IA (N.D. lowa), Civil Action Number 2008V00041, DOJ Case Number
90-5-1-1-09339 effective June 27, 2011. The City is required to submit Corrective Action
plans for each of the Sanitary Sewersheds identified in the Consent Decree. The
FY2017 budget appropriated funds for sanitary sewer manhole improvements in the
Consent Decree Correction Action Plan.
DISCUSSION
The 2017 Windsor Avenue Sanitary Sewer Manhole Project was completed by Drew
Cook & Sons Excavating of Dubuque, lowa, in the final contract amount of $18,390.38
which is a 0.6% decrease from the original contract amount of $18,500.00. The project
included the removal of two (2) manholes and replacement with 8" connecting pipe and
the replacement of two (2.) manholes in Sewershed 10.

RESOLUTION NO. 31-19
ACCEPTING THE 2017 WINDSOR AVENUE SANITARY SEWER MANHOLE
PROJECT
WHEREAS, the public improvement contract for the 2017 Windsor Avenue Sanitary
Sewer Manhole Project, (the Project) has been completed by the Contractor, Drew
Cook & Sons Excavating (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $18,390.38; and
WHEREAS, the Contractor has previously been paid $17,470.86, leaving a balance
of $919.52; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $919.52 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
