City Engineer Gus Psihoyos recommends City Council approval of a resolution
authorizing emergency stream bank repairs to a segment of the South Fork of the
Catfish Creek which is close in proximity to the existing South Fork of the Catfish Creek
sanitary interceptor sewer. Initial projections are that repair costs would be
approximately $100,000 and staff has identified a potential $100,000 saving from the
Southwest Arterial — US20 interchange sanitary sewer relocation project.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Stream Bank Emergency Repair Project

INTRODUCTION
This memo requests the City Council to approve the attached resolution authorizing
emergency stream bank repairs to a segment of the South Fork of the Catfish Creek
which is close in proximity to the existing South Fork of the Catfish Creek sanitary
interceptor sewer.
BACKGROUND
The City is currently working on a project to repair and stabilize a segment of the
stream bank along the South Fork, located just upstream of the North Cascade
bridge crossing. The segment of stream bank is approximately 300 feet in length and
has experienced significant erosion and stream embankment loss over the past
several years. The City has an existing 18-inch sanitary interceptor sewer that runs
along the South Fork of the Catfish Creek. Stream bank erosion has gradually been
encroaching towards the alignment of the sanitary interceptor sewer.
DISCUSSION
The City recently took drone aerial photos of the stream bank erosion location to
assist with the development of repair and stabilization plans. In reviewing the aerial
photos, the erosion and stream embankment loss has increased and is now
extremely close to the existing sanitary interceptor sewer.
Due to this observed stream bank encroachment on the existing South Fork of the
Catfish Creek near the City's sanitary interceptor sewer, emergency repairs are
required to repair and stabilize a segment of the stream bank to prevent impacts to
the sanitary interceptor sewer.
RECOMMENDATION
City staff recommends that an emergency repair project be initiated so that the
necessary stream bank repair and stabilization can be made to protect the existing
sanitary interceptor sewer.
Due to the emergency repair recommendation, the City may proceed with an
emergency repair project under the following State of lowa Code:
384.103 Emergency Repairs
2. a. When emergency repair of a public improvement is necessary and the delay
of advertising and a public letting might cause serious loss or injury to the city,
the chief officer or official of the governing body of the city or the governing
body shall make a finding of the necessity to institute emergency proceedings
under this section, and shall procure a certificate from a competent licensed
professional engineer or registered architect, certifying that emergency
repairs are necessary.
b. In that event the chief officer or official of the governing body or the governing
body may accept, enter into, and make payment under a contract for
emergency repairs without holding a public hearing and advertising for bids,
and the provisions of chapter 26 do not apply.
CERTIFICATE OF CITY ENGINEER
As required per State of lowa Code, attached is a Certificate from the City Engineer
stating that an emergency repair declaration is both appropriate and necessary.
BUDGETIMPACT
As of this time a detailed cost estimate has not been developed for the stream bank
repair and stabilization. Initial projections are that repair costs would be
approximately $100,000. Staff has identified a potential $100,000 saving from the
Southwest Arterial - US20 interchange sanitary sewer relocation project.
ACTION TO BE TAKEN
The City Engineer requests approval of the attached resolution by the City Council in
the interest of public safety and welfare so that emergency repairs can be made to a
segment of stream bank along the South Fork of the Catfish Creek to protect and
prevent impacts to the nearby sanitary interceptor sewer.

RESOLUTION AUTHORIZING EMERGENCY REPAIRS TO SEGMENT OF STREAM
BANK ALONG THE SOUTH FORK OF THE CATFISH CREEK TO PROTECT AND
PREVENT IMPACTS TO THE NEARBY SANITARY INTERCEPTOR SEWER
Whereas, emergency repairs are required to repair and stabilize a segment of the
stream bank along the South Fork of the Catfish Creek to prevent impacts to the sanitary
interceptor sewer; and
Whereas, Iowa Code § 384.103 provides that when emergency repair of a public
improvement is necessary and the delay of advertising and a public letting might cause
serious Toss or injury to the city, the governing body shall, by resolution, make a finding
of the necessity to institute emergency proceedings and shall procure a certificate from a
competent registered professional engineer or architect, certifying that emergency repairs
are necessary, and that in that event the governing body may contract for emergency
repairs without holding a public hearing and advertising for bids; and
Whereas, the City Engineer has certified that an emergency repair declaration is both
appropriate and necessary to complete stream bank repairs and stabilization to protect
the existing South Fork of the Catfish Creek sanitary interceptor sewer; and
Whereas, the City Council finds that the erosion and stream embankment Toss has
progressed and is now close in proximity to the existing South Fork of the Catfish Creek
sanitary interceptor sewer, and constitutes an emergency and that an emergency repair
is in the best interest of public welfare and safety and the delay of advertising and a public
letting might cause serious Toss or injury to the City.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council finds that it is necessary to institute emergency
proceedings to repair and stabilize a segment of the stream bank along the South Fork
of the Catfish Creek to prevent impacts to the sanitary interceptor sewer.
Section 2. The City Manager is hereby authorized to proceed with instituting such
emergency repairs as provided by law.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has observed the site condition and feel that in the interest of public safety and
protecting critical public infrastructure, that an emergency repair declaration is both
appropriate and necessary to complete stream bank repairs and stabilization to protect
the existing South Fork of the Catfish Creek sanitary interceptor sewer.
