Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager `-�� SUBJECT: Set for Public Hearing -Voluntary Annexation Request Concurrent with Rezoning DATE: February 8, 2019 INTRODUCTION This memorandum transmits a 100% voluntary annexation request for City Council to set for public hearing. The request is being filed by Michael Portzen, SWAD, LLC. for approximately 28.48 acres of property, concurrent with rezoning. The property owner is Carolyn S. Haupert Trust. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory consists of a 28.48 parcel of land that is located south of the Southwest Arterial, west of English Mill Road and north of English Ridge Subdivision. The property is presently used for agricultural purposes. Michael Porzen, SWAD, LLC. is also in the process of applying to rezone the property to C-3 General Commercial. The Zoning Advisory Commission is scheduled to hold a public hearing on the rezoning on March 6, 2019. By lowa Code, the annexation will be approved upon acknowledgement by the Secretary of State that the legal description, map and resolution have been received. RECOMMENDATION Staff recommends the City Council approve the resolution to set the public hearing on the voluntary annexation request for March 18, 2019. This date will provide adequate time to complete the notifications, certified mailings, and newspaper publication required by lowa Code as well as the rezoning public hearing before the Zoning Advisory Commission.
