The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Rick Ehrlich, the applicant, explained that he would like to place an apartment building
with 8 to 12 units on the lot at the southwest corner of W. 32"d Street and N. Grandview
Avenue. He is explained that the property is currently zoned R-1 Single-Family, and he
could place up to 9 smaller, single-family rental homes on the property. He explained
by placing an apartment building on the site that he could have approximately the same
number of units or more and have less stormwater run-off.
Linda & Ike La Soya, 808 Spires Drive, owners of an 8-plex located across N.
Grandview Avenue from the subject property, spoke in opposition to the request. They
both stated they have concerns with stormwater run-off.
Staff reviewed the staff report, noting the history of the property with respect to zoning
regulations, off-street parking requirements, characteristics of the site and flood plain
regulations. Staff noted that, if approved, a site plan will be required to be submitted
and would be reviewed by city departments (Planning, Building, Fire, Water,
Engineering, etc.) to ensure compliance with the Unified Development Code, Building
and Fire Codes and SUDAS (Statewide Urban Design and Specifications). In addition,
storm water controls will be reviewed in detail as part of the site plan if the subject
property is successfully rezoned.
The Zoning Advisory Commission discussed the request and found it appropriate.

Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request to rezone the subject property from R-1 Single-Family Residential
District to R-4 Multi-Family Residential District.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property was annexed into the city in 1936. The property
has been undeveloped and used primarily for agricultural purposes. The Bee Branch
Creek flows through the site. A portion of the property is located in the 100-year
floodplain. In 2006, the property was platted as part of the North Grandview Estates
Subdivision. The legal description of the property is Lot 37 North Grandview Estates
No.2.
Physical Characteristics: The subject property is an approximately 1.28-acre (55,757
sq. ft.) lot located on the southwest corner of the intersection of N. Grandview Avenue
and W. 32�d Streets. The Bee Branch Creek meanders through the property and
empties into a box culvert that extends under N. Grandview Avenue. Volunteer trees
line along both sides of the creek. A portion of the property has been designated as
part of the 100-year regulatory floodplain. Approximately 34,500 sq. ft. of the 55,757
sq. ft. lot is located outside of the floodplain.
Concurrence with Comprehensive Plan: The Comprehensive Plan encourages a
mix of housing affordable for all segments of Dubuque's population throughout the
community, including options for those who might be saving for their first home. The
plan also encourages new multi-family development in proximity to jobs to minimize
transportation costs and fosters the development of new and additional housing
products in suitable locations throughout the City. The City's Future Land Use Plan
identifies this area as residential.

Utilities: All City utilities are available to the property.
Traffic Patterns/Counts: The following charts shows the 2013 & 2017 lowa
Department of Transportation Annual Average Daily Vehicle Trips (ADT) along the
subject property. There has been a reduction of 970 AVT along W. 32"d Street and
an increase of 150 AVT along N. Grandview Avenue.

Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided the development adheres to Federal Emergency Management Agency
(FEMA) floodplain regulations.
Adjacent Properties: The adjacent property to the north consists of a graded, but
not fully improved, residential single-family subdivision. The property to the west
consists of flood plain and vacant land. The property to the north is W. 32"d Street
and a wooded hillside which is part of a farm. The property to the east consists of
N. Grandview Avenue and an 8-unit apartment building. The proposed rezoning
should have minimum impact on the neighborhood.
Staff Analysis: The applicant is requesting rezoning of a lot from R-1 Single-Family
Residential District to R-4 Multi-Family Residential District. The subject property is an
approximately 1 .28-acre lot located on the southwest corner of W.32�d Street and N.
Grandview Avenue. The property consists of floodplain and land that has been used for
agricultural purposes. Approximately 34,500 sq. ft. of the 57,757 sq. ft. lot is located
outside of the floodplain. The applicant has indicated he proposes to develop the
property into a 12-unit apartment building.

Included in this staff report is a chart of the 2013 & 2017 IDOT Annual Average Daily
Trips (ADT) for the subject area. Along the subject property, there has been a reduction
of 970 AVT along W. 32nd Street and an increase of 150 AVT along N. Grandview
Avenue. The Institute of Traffic Engineers Trip Generation Manual indicates that for
apartments, a trip generation of 6.47 vehicles trips per dwelling unit during the
weekday. This translates into approximately 78 ADT when the 12-unit apartment is
constructed.
The submitted application is for rezoning to R-4 Multi-Family Residential District to
accommodate the construction of a 12-unit apartment building. The applicant/developer
is required to submit a major site plan. The site plan will be reviewed by city
departments (Planning, Building, Fire, Water, Engineering, etc.) to ensure compliance
with the Unified Development Code, Building and Fire Codes and SUDAS (Statewide
Urban Design and Specifications). The parking requirement for apartments in an R-4
residential district is 1 .5 spaces per dwelling unit. The proposed 12-plex would
generate a demand of 18 paved off-street parking spaces. Water and sewer utilities are
available along both W. 32�d Street and N. Grandview Avenue. In addition, storm water
controls will be reviewed in detail as part of the site plan if the subject property is
successfully rezoned.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT SOUTHWEST CORNER OF
W. 32ND STREET AND NORTH GRANDVIEW AVENUE FROM R-1 SINGLE-FAMILY
RESIDENTIAL DISTRICT TO R-4 MULTI -FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter described
property from R-1 Single -Family Residential District to R-4 Multi -Family Residential
District, to wit:
Lot 37 North Grandview Estates No. 2, and to the centerline of the adjoining public
right-of-way, all in the city of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
by law.
