2-5C-1: COMMISSION CREATED; COMPOSITION:
A. Creation: l"here is hereby created a community development advisory cornmission �
whose primary purpose shall be to provide for citizen participation in the
development and evaluation of the city of Dubuque's community development block �
grant (CDBG) program. �
�. Membership: The commission shall comprise nine (9) members; four (4) members
shall be residents of census tracts and block groups where at least fifty one percent
(51%) of the residents are low/moderate income persons as determined by the �'�
llnited States department of commerce, bureau of the census; four (4) members (
shall be residents of the community at large; and one member shall be that member
of the housing commission designated by fhe housing commission. (2007 Code

2-5C-2: TERM; FILLING OF VACANCIES; COnIIPENSATION: '�
��A. Term: The term of office for a commission member shall be three (3) years. ,�
B. Remova! Of IVlember. A commission member may be remnved at any time with or
�
without cause by a vote of two-thirds (2/3) of all members of the city council. '�
C. Filling Vacancies: A vacancy occurring on the commission caused by resignation or '
otherwise shall be filled by ap�ointment of the city council for the remair�der of the
unexpired term. ;,

D. Compensation: Members of the commission shall serve without compensation i
except for actual expenses, which shall be subject to approval by the cifi� �t�unciL
(2007 Code � 15-48}
2-5C-3: ORCANIZATION:
The commissinn shall choose annually, at its first regular meeting of the fiscal year, one
�
c�f its rr�embers to a�t as ch�irperson, and another of its members to act as vice �
�hairperson, to perform all of the duties of the chairperson during the chairperson's
�bsenc;e or disability. The c�mrr�ission shall adopt such rules and regulations governing �
its,c�rganization and procedures as it may be deem�d necessary, consistent vvith the �
following:
�
A. Meetings: The commis�ion shall meet as necessary to fulfill the purposes for whoch �
the commission �as created.
B. Att�ndance Of Memb�rs: Mernbers of the commission shall attend at least two-thirds
(z/3) of�II re�ularly scheduled meetings within any consecutive twelve (12) month
period. If any member fails to attend such pre��ribed number af ineetings, such
failure shall constitute grounds for the commission to recommend to the city council
that said member be replaced. Attendance of all members shall be entered in the
minutes.
C. Minutes Filed With Clerk: The commission shall file with #he city clerk a copy of the
minutes of each regular and special meeting of the commission within ten (10) ���
working days after such meeting. (2007 Code § 15-51)
2-5C-4: GENERAL DUTIES AND RESPONSIBILITIES: �

The commission shall have the following duties and responsibilities:
A. To conduct public hearings in accordance with the minimum standards established in �
the CDBG program's citizen participation plan to ensure meaningful citizen input in �
the planning, implementation and assessment of the city's CDBG program; `i
�
B. To provide for and encourage the participation of low and moderate income persons �
who reside in designated areas of slum and blight and residents of low and a
moderate income neighborhoods, as defined by the city council, in the planning, �
impler�entation and assessment of the CDBG program; �

C. To identify community development needs, particularly the needs of persons of low i
and moderate income; �

D. To serve in an advisory role upon the request of the city council in policy decision� �
regarding funding priorities and program development and implementation; �
,�E. To monitor and evaluate program activities to advise whether identified community

develapment objectives have been met; �

F. °To undertake public information efforts to educate the citizenry of the availability of �
CDBG funded programs and to provide for a greater understanding of the city's �
. community development efforts, �

G. To assist in the preparation of the statement of community development objectives
and projected us� of funds, amendments thereto and required reports including, but
not limited to, the annual grantee perFormance report (GPR) and the annual �
comprehensive housing assisfiance strategy (CHAS); �
H. To serve in an advisory role to the city manager in the review of complaints and
grievances received in accordance with the procedures established in section 2-5C-
5 of this article; and
I. To support, upon request, the efforts of the city council and other city
commissions in the assessment of the general development needs of the
community. (2007 Code § 15-49)
2-5C-5: C�RIEVANCE PI�OCEDURE; REVIEW STANDARDS; APPEAL PROCESS:

The grievance procedure for the community development block grant program shall be ;
as follows: �
�
A. Right To File: Any aggrieved person may file a grievance with the city manager.
�
�
B. Contents: Grievances shall contain a concise statement of the grievance and an �
explanation of the action desired. ,
C. Forwarding To Commission: The city mana er shall forward the rievance to the �

commission within seven (7) working days of its receipt. j
D. Setting Date For Hearing; Notice To Complainant: The commission shall, within �
fifteen (15) working days of the receipt of the grievance, set a time for a hearing. The �
complainant shall be notified in writing of the time.and place of the hearing. If a �i�
grievance is resolved prior to the date of the hearing, the aggrieved party shall ji
request in writing that the grievance be withdrawn. I�

E. Nearing Procedure: The commission shall conduct a hearing to review the grievance. ��i?
The grievant may appear in person, by agent, or by attorney. All persons wishing to '
appear before the commission shall have an opportunity to be heard regarding the ;��
grievanc�. Minutes shall be kept of the proceedings of the hearing. '�

F. Recommendations Of Commission: The commi�sion shall forward its �
recammendation, in writing, to the city manager within ten (10) working days
following the hearing.
�
G. Action By City Manager: The city manager shall receive and review the i
recommendation of the commission and shall respond to the grievant within ten (10) 'r
working days of the receipt of the recommendation. The commission shall be i
advised of the action of the city manager. �
�
H. Compliance With Federal Regulations: The recommendations of the commission �
shall comply with the regulations established by the U.S. department of housing and �
urban development for the community development block grant program under title I
of the housing and community development act of 1974, as amended, and this code.
I. Appeal To Council By Grievant: If the grievant is unsatisfied with the response of the
city manager, an appeal may be made filed with the city clerk. The appeal shall be
forwarded by the city clerk to the city council. The city council may, at its discretion,
hold a hearing to consider the concerns of the grievant.
J. Council Action; Appeal To HUD: Upon review of the appeal, the city council shall: 1)
accept the response of the city manager; 2) modify the response of the city
manager; or 3) return the grievance to the city manager for further review. If the
outcome of such appeal is unsatisfactory, the complainant may file a written appeal
with the U.S. department of housing and urban development (HUD). (2007 Code
§ 15-50)
2-5C-6: PROCEDURES FOR OPCR�4TIONS:
The commission shall operate in accordance with the standards and procedures set
forth in the city's community development block grant (CDBG) program's citizen
participation plan. All administrative, personnel, accounting, budgetary and procurement
policies of the city shall govern the commission in all its operations. (2007 Code § 15-

There is hereby created the Long Range Planning Advisory Commission.

15-2-2: PURPOSE: '
The purpose of the commission is to foster the community planning process, develop
policies, goals, plans, and management tools based on a consensus of community values,
and help guide the community's future development, public policies, and decision-making. !;

15-2-3: INTERNAL ORGANIZATION AND RULES: ;ti
The commission may adopt rules and regulations to govern its organizational procedures as k
may be necessary and which are not in con�lict with this Code of Ordinances or the lowa II
Code. �
15-2-4: PROCEDURES FOR OPERATION: ih

at the city clerk's office any time prior to the first meeting of the commission.
15-2-7: TERMS:
The term of office for commissioners is thr�e (3) years or until such commissioner's
successor is appointed and qualified.
15-2-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
15-2-9: OFFICERS/ORGANIZATION: �,
The commissioners must choose annually a chairperson and vice-chairperson, each to se�-ve il
a term of one (1) year. The chairperson must appoint a secretary, who need not be a member �ij
of the commission. The commissioners must fill a vacancy among its officers for the ��
remainder of the officer's unexpired term. �

15-2-10: MEETINGS: i;
A. Meetings: Meetings may be called by the chairperson or at the written request of a �
majority of the commissioners. ,I

B. Open Meetings: All meetings must be called and held in conformance with the lowa j
open meetings law. 7
C. Attendance: �
1. In the event a commissioner has been absent for three (3) or more consecutive ;
meetings of the commission, without being excused by the chairperson, such absence !
will be grounds for the commission to recommend to the city council that the position �
be declared vacant and a replacement appointed. �

D. Minutes: A copy of the minutes of all regular and special meetings of the commission 'i,

E. Quorum: Four(4) commissioners constitute a quorum for the transaction of business. �I
The affirmative vote of a majority of the commissioners present and voting is necessary �j

15-2-11: COMPENSATION: �
Commissioners serve without compensation, provided that they may receive reimbursement i
for necessary travel and other expenses while on official commission business within the '
limits established in the city administrative policies budget.
15-2-12: REMOVAL:
Except as provided in 15-2-10(D)(1), the city council may remove any commissioner for good
cause.
15-2-13: POWERS:
The commission has the following powers, duties, and responsibilities:
A. To provide a leadership role in the planning, coordinating, and sponsoring of a periodic
community planning process;
B. To coordinate and supervise the preparation and maintenance of the comprehensive
plan;
C. To provide input to the city manager in the preparation of the city manager's
recommended multiyear capital improvement program;
D. To make comprehensive studies of the present condition and the future growth of the
city to provide input into the community planning process and to guide and accomplish a
coordinated, consistent, and harmonious development in accordance with the present
and future needs thereof to the end that the health, safety, morals, order, convenience, i
prosperity, and general welfare may be promoted; �
E. To make or cause to be made such surveys, studies, maps, plans, or charts of the City �
with due regard to its relation to neighboring territory as may be determined as necessary �
to carry out the purposes of the commission; j�
F. To recommend amendments to all or parts of the comprehensive plan in response to

the community planning process, upon its own initiative or upon recommendation ;,
presented by the Zoning Advisory Commission, but only after a public hearing; ��
G. To review proposed urban renewal plans and urban revitalization plans for �
consistency with the comprehensive plan; ;

H. To undertake public information efforts to enhance public understanding of the
community planning process generally and the comprehensive plan specifically; and i

MECHANICAL AND PLUMBING CODE BOARD Pi

. A. Board Created:
In order to hear and decide appeals of orders, decisions, or determinations made by the �
code official relative to the application and interpretation of this code, there shall be and
is hereby created a Mechanical and Plumbing Code Board. The Mechanical and
Plumbing Code Board shall be appointed by the City Council and shall hold office at its ,
pleasure. I
B. Membership: �
The Mechanical and Plumbing Code Board shall consist of seven (7) residents of the ;
city, appointed by the City Council for a term of three (3) years or until such member's
successor is appointed and qualified. Vacancies must be filled in the same manner as �
original appointments. � j
1. Special Qualifications.
a. Two (2) at-large members; � � ��
b. Five (5) members who possess a minimum of one of the following ii
requirements: minimum of five (5) years working experience in the plumbing ��
or mechanical trade, hold a state certification as a mechanical or plumbing i�
contractor, licensed mechanical or hydraulic engineer, or any combination '
thereof. i
c. Members must be eighteen (18) years of age or older �f

C. Oath: �
Each person, upon appointment or reappointment to the board, must execute an oath of �
office at the first meeting of the board following appointment or reappointment or at the
city clerk's office any time prior to the first meeting of the board following the '
appointment or reappointment.
�
D. Officers/Organization: �
The board must choose annually a chairperson and vice- chairperson, each to serve a p
term of one (1) year. The code official is the secretary of the board. The board must fill a
vacancy among its officers for the remainder of the officer's unexpired term.
E. Compensation:
Members serve without compensation, provided that they may receive reimbursement
for necessary travel and other expenses while on official board business within the limits
established in the city administrative policies and budget.
F. Disqualification of Member:
A member shall not hear an appeal in which that member has a personal, professional,
or financial interest.
G. Application for Appeal:
1. Any person affected by a decision of the code official or a notice or order issued
under this code shall have the right to appeal to the Mechanical and Plumbing
Code Board, provided a written application for appeal is filed within twenty (20)
days after the day the decision, notice, or order was served.
2. An application for appeal shall be based on a claim that the true intent of this I�
code or the rules legally adopted thereunder have been incorrectly interpreted, �
the provisions of this code do not fully apply, or an equally good or better form
of construction is proposed.
H. Limitations on Authority (Board Powers): !
1. The board has the following powers, duties, and responsibilities:
i
a. To advise the city council on all mechanical and plumbing code regulations �
and procedures. ;
b. To serve as an appeai body for the decisions of the code official or the code j
official's designee. ��
c. To provide for reasonable interpretations of the mechanical and plumbing I;�
code. �i

The Mechanical and Plumbing Code Board does not have the authority to waive the :�
requirements of this code ;';
�
I. Notice of Meeting:
The board shall meet upon notice from the chairman, within not less than thirty (30)
days and not more than ninety (90) days of the filing of an appeal, at stated periodic i
meetings, or at the written request of a majority of the members. i
�
�
J. Open Hearing:
1. Hearings before the board shall be open to the public and in compliance with
the provisions of the lowa open meetings law. ��
2. The appellant, the appellant's representative, the code official, and an erson �
Yp
whose interests are affected shall be given an opportunity to be heard.
K. Hearing Procedure:
1. Procedures: The board shall adopt and make available to the public through the
secretary procedures under which a hearing will be conducted. The procedures
shall not require compliance with strict rules of evidence, but shall mandate that
only relevant information be received.
2. Quorum: four(4) members constitute a quorum for the transaction of business.
The affirmative vote of a majority of the members present and voting is
necessary for the adoption of any motion or resolution.
�
3. Members of the board shall attend at least two-thirds (2/3) of all regularly �
scheduled and held meetings within a twelve (12) month period. If any member �
does not attend such prescribed number of ineetings, it shall constitute grounds �
for the board to recommend to the city council that the member be replaced. N
The attendance of all members shall be entered upon the minutes of all
meetings. �

4. The code official shall file with the city council a copy of the minutes of each
meeting of the board within ten (10) working days after each such meeting, or
by the next regularly scheduled city council meeting, whichever is later.

5. All administrative, personnel, accounting, budgetary, and procurement policies '�

of the city shall govern the board in its operations. '
�

6. Removal: ;
The city council may remove any member for cause upon written charges and �
after a public hearing. �
L. Postponed Hearing: ;i
Either the city or the appellant may request a postponement of a hearing subject to the �
approval of the code official. In no event may a postponement exceed ninety (90) days �
beyond the date of the appeal.
�
M. Board Decision on Appeals: �
The board may, by majority vote, affirm, modify, or reverse the decision of the code �
official. �p
G
N. Resolution:
The decision of the board shall be by resolution. A written copy shall be furnished to the
appellant and placed in the board's records.
O. Administration:
The code official shall take immediate action in accordance with the decision af the
board.
P. Court Review: �
Any person, whether or not a previous party to the appeal, shall have the right to apply
to the appropriate court for a writ af certiorari to correct errors of law. Application for
review shall be made in the manner and time required by law following the filing of the
decision in the office of the code official chief administrative officer.
Q. Stays of Enforcement:
Appeals of notice and orders (other than Imminent Danger notices) shall stay the
enforcement of the notice and order until the appeal is heard by the appeals board.
