City Engineer Gus Psihoyos is recommending acceptance of the 2009 Intake
Reconstruction Project, as completed by Drew Cook & Sons Excavating Co., Inc., in the
final contract amount of $90,906.45, which is an 18% increase from the original contract
amount of $77,040.00. The cost increase was the result of adding the replacement of
two additional intakes to the project and replacing short segments of storm sewer in
conjunction with catch basin replacements on O'Neill Street and Sheridan Road.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
2009 Intake Reconstruction Project.

The 2009 Intake Reconstruction Project involved the replacement of 24 intakes and the
installation of 2 new intakes at various locations in the City. This project was done in
conjunction with the 2009 Public Works Asphalt Overlay Program.
The project was awarded based on a competitive quotation process for public
improvements in accordance with Iowa Code, Section 26.14.
DISCUSSION
The 2009 Intake Reconstruction Project was completed by Drew Cook & Sons
Excavating Co., Inc. of Dubuque, Iowa, in the final contract amount of $90,906.45,
which is an 18.0% increase from the original contract amount of $77,040.00. The cost
increase was a result of adding the replacement of two additional intakes to the project
and replacing short segments of storm sewer in conjunction with catch basin
replacements on O'Neil Street and Sheridan Road.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $90,906.45 to Drew Cook & Sons Excavating Co., Inc. for the
2009 Intake Reconstruction Project.

ACCEPTING THE 2009 INTAKE RECONSTRUCTION PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the 2009 Intake Reconstruction
Project (the Project) has been completed and the City Engineer has examined the work
and filed a certificate stating that the Project has been completed according to the terms
of the Public Improvement Contract and that the City Engineer recommends that the
Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Catch Basin Maintenance appropriation for the contract amount of $90,906.45 Tess
any retained percentage provided for therein as provided in Iowa Code chapter 573,
and to pay such retainage only in accordance with the provisions of Iowa Code chapter
573.
