Van Milligen, City Manager SUBJECT:New Map for Southwest Artedal Development Moratorium The Iowa Department of Transportation has submitted a revised map for the Southwest Arterial Development Moratorium. Planning Services Manager Laura Carstens is recommending adoption of the moratorium for this revised area. Corporation Counsel Barry Lindahl concurs with this approach. I concur with the recommendation and respectfully request Mayor and City Council approval. Michael C. Van Milligen MCVM/jh Attachment cc: Barry Lindahl, Corporation Counsel Cindy Steinhauser, Assistant City Manager Laura Carstens, Planning Services Manager MEMORANDUM April 17, 2003 TO: Michael Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager SUBJECT: New Map for Southwest Arterial Development Moratorium At their April 21st meeting, the City Council will hold a public hearing on the joint request of the City staff and IDOT to extend the Southwest Arterial development moratorium for the U.S. 20 study area. The moratorium extension involves text amendments of the Zoning Ordinance and the Subdivision Ordinance. The Zoning Advisory Commission held a public hearing on the moratorium and recommended its extension. The map provided to the Zoning Advisory Commission and the affected property owners for this hearing was included in the City Council's packets. Today, the IDOT consultant for the Southwest Arterial and U.S. 20 projects provided the attached map. This new map reduces the limits from the original area. This original area has been changed for the Menard's property. IDOT coordinated with Menard's and purchased the ROW required for the future highway improvements before their new store was built. This property has been removed from the moratorium area. The limits also have been reduced from the previous map to more accurately reflect the area needed for the access roads west of the proposed interchange. The changes include removal of the Neztrop, LLC property from the development moratorium area, and a reduction in the moratorium area for the Landfill property. Corporation Counsel Barry Lindahl has determined that the City Council can adopt the moratorium extension with the revised map as the exhibit because it is a reduction in area. (If it had been an expansion, this would not have been possible.) The requested action is for the City Council to use the attached map in their consideration of the extension of the Southwest Arterial development moratorium for the U.S. 20 study area.
