The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed lot split.
Staff reviewed the existing lot size and configuration, and noted that the submitted plat
allows for sale of the dwelling units as townhomes. Staff recommended approval
subject to waiving lot area requirements for Lots 1 and 2.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objections.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the minimum lot area requirements for Lots 1
and 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Wedig Place subdivides an existing legally non-
conforming parcel of land into two parcels to facilitate conversion of an existing duplex
to a townhouse. The property is located at 418 Emmett Street one block west of the
Emmett Street/Bluff Street intersection.
DISCUSSION
The submitted Plat of Survey of Wedig Place facilitates the conversion of an existing
duplex into a two -unit townhome. The two lots created will be substandard in terms of
lot area. The subject property is zoned OR Office Residential and is located within the
Cathedral Historic District.
The OR District requires lots to have 1, 200 square feet of lot area. The submitted Plat
of Survey provides 1,047 square feet of lot area for Lot 1, and 1,051 square feet of lot
area for Lot 2. Attached to this memo is an aerial photo highlighting the subject
property. As the Zoning Advisory Commission can see, the existing structure occupies
a large percentage of the existing parcel.
RECOMMENDATION
Planning staff recommends the submitted Plat of Survey of Wedig Place be approved
subject to waiving the lot area requirements for Lots 1 and 2 as shown on the submitted
Plat of Survey.

RESOLUTION NO. 49-10
RESOLUTION APPROVING A PLAT OF SURVEY WEDIG PLACE IN THE CITY OF
DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Wedig Place in the
City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides square feet and 1,051 square feet of lot
area for Lot 1 and Lots 2 respectively, where 1,200 square feet of lot area is required by Section
5 -7.7 of Title 16 of the City or Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, Said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it. '
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 5 -7.7 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 1,047 square feet and 1,051 square feet of lot
area for Lot 1 and Lots 2 respectively where 1,200 square feet of lot area is required.
Section 2. That the Plat of Survey of Wedig Place is hereby approved and the Mayor
and City Clerk are hereby authorized and directed to enclose the approval of the City of
Dubuque, Iowa upon said final plat.
