INTRODUCTION
This memorandum requests city council approval to establish a mapped jurisdictional
boundary for the U.S. Highway 151 lowa Department of Transportation (IDOT) Right of
Way on Schmitt Island adjacent to the location of the Chaplain Schmitt Veteran's
Memorial.
BACKGROUND
U.S. Highway 151 is a limited access highway that generally runs north to south through
Dubuque heading toward Wisconsin. When this limited access highway was constructed
through the downtown area of Dubuque in the late 1980's and early 1990's, it was mostly
constructed on City of Dubuque owned property or right of way. Right of way is defined
as the land on which highways are built. When a right of way limit is established, it must
be sufficient enough to allow the construction and maintenance of the highway. When
the right of way or jurisdictional boundary was established at the time the highway was
opened to traffic, the boundary was only shown as a line on a construction drawing and
was never detailed to meet any established surveying standard.
DISCUSSION
As part of the Chaplain Schmitt Veteran's Memorial Project, Engineering and Leisure
Services Department staff and members of the consultant design team collaborated with
IDOT to determine if the project would require an IDOT Right-of-Way Permit. As part of
that collaboration, IDOT determined that a recorded map of the jurisdictional boundary
would need to be created before they could provide final direction on whether the project
required a right of way permit or not. The boundary on the attached map is what was
mutually agreed to between IDOT and city staff. The mapped boundary is very similar to
what had been the assumed jurisdictional boundary since the time of the highway opened
to traffic in the early 1990's.

RECOMMENDATION
It is recommended that the City Council authorize the City Clerk to record the attached
IDOT Exhibit Map "A" 1 of 1 at the Dubuque County Recorder's Office in order to formally
establish the jurisdictional boundary for U.S. Highway 151 adjacent to the Chaplain
Schmitt Veteran's Memorial.
BUDGETIMPACT
There will only be a nominal fee for recording the exhibit map which will recharged to the
Chaplain Schmitt Veteran's Memorial Project.
ACTION TO BE TAKEN
I respectfully recommend that the City Council authorize the City Clerk to record the
attached IDOT Exhibit Map "A" 1 of 1 at the Dubuque County Recorder's Office in
accordance with the attached resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Iowa Department of Transportation Map dated March 18, 2019
prepared by WHKS Engineers, relative to the real estate hereinabove described be and
the same is hereby approved, and the Mayor and City Clerk be and they are hereby
authorized and directed to approve said map for and on behalf of the City of Dubuque,
Iowa.

and certified copy of this resolution in the Office of the Recorder in and for Dubuque
