Van Milligen, City Manager SUBJECT: Restricted Parking During Central Market and Other Farmers' Markets DATE: May 1 , 2019 City Code Section 4-4-4 details parking restrictions during the dates, times and months that the Central Market occurs. Assistant City Attorney Maureen Quann recommends City Council approval of an amendment to City Code Section 4-4-4. In March 2019, City staff worked with local groups to create a process through which other farmers' markets following state and local rules for farmers' markets could be permitted and exist legally throughout the City. In recognition of that application, process and permitted status, this proposed amendment seeks to clarify parking restrictions and limitations during those permitted farmers' markets as well. Currently City Code Section 4-4-4 details parking restrictions during the dates, times, and months that the Central Market occurs. The newly proposed amendment explains parking restrictions during dates, times, and months that other permitted farmers' markets occur as well. Discussion City Code Section 4-4-4 currently states: When stalls in the Central Market and other farmers' markets have been established by the city manager and signs are erected giving notice thereof, no person shall park a vehicle in such stall between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) noon on Saturdays in the months of May through October unless the vehicle has on display a permit as described in this chapter. Consequently, the new proposed amendment states: A. When stalls in the Central Market have been established by the city manager and signs are erected giving notice thereof, no person shall park a vehicle in such stall between the hours of six o'clock (6:00) A.M. and twelve o'clock (12:00) noon on Saturdays in the months of May through October unless the vehicle has on display a permit as described in this chapter. B. When stalls in other designated, permitted farmers' markets have been established by the city manager and signs are erected giving notice thereof, no person shall park a vehicle in such stall between the hours designated on the signs on the days in the months of the year designated on the signs unless the vehicle has on display a permit described in this chapter. With the City's recognition of other farmers' markets in addition to the long-standing Central Market, clarifying these parking restrictions will treat all permitted farmers' markets equally and consistently and help citizens navigate the changes in parking during such market times. The proposed amendment is attached for your review. Recommendation I recommend that the proposed amendment to City Code Section 4-4-4 is forwarded to the City Council for review, consideration, and approval.
