INTRODUCTION
This memorandum transmits a proposed resolution authorizing the Notice of Intent to Request
Release of Funds for the Lead-Based Paint Hazard Control Grant # IALHB0667-18.
BACKGROUND
The City Council must request release of the funds for the Lead-Based Paint Hazard Control Grant
from the U.S. Department of Housing and Urban Development, Office of Lead Hazard Control and
Healthy Homes. The City of Dubuque has received a $3,580,968.00 Lead-Based Paint Hazard
Control Grant for: 1) inspection, identification, and reduction of lead-based paint hazards in 120 units;
2) training of low/mod individuals and contractors for lead certification; and 3) citizen outreach and
education on home health and safety. This amount includes $581,000 Healthy Homes supplement
funds to identify and remediate housing-related health and safety hazards in 120 units.
The City of Dubuque published a Notice of Intent to request Release of Funds (NOI/RROF) on May 8,
2019. This required notice allows 7 days for citizen and public agency comments on the
environmental assessment of these programs. Public comment was accepted until May 15, 2019 and
considered before proceeding with the request for release of funds. The City must then file a
Request for Release of Lead-Based Paint Hazard Control Grant funds and Certification with the U.S.
Department of Housing and Urban Development (HUD). The City Council must authorize the Mayor
to execute a Request for Release of Funds and Certification after May 18, 2019, ten (10) days after
publication of the NOI/RROF for the Release of Lead-Based Paint Hazard Control Grant funds and
submit to the U.S. Department of Housing and Urban Development (HUD).
REQUESTED ACTION
I respectfully request that the Authorizing Official, Honorable Mayor Roy Buol, sign the resolution and
Request for Release of Funds and Certification HUD-7015.15 to process through the U.S.
Department of Housing and Urban Development.

A RESOLUTION AUTHORIZATION REQUEST FOR RELEASE OF FUNDS AND
CERTIFICATION FOR LEAD BASED PAINT HAZARD CONTROL AND HEALTHY HOMES
PRODUCTION GRANT PROGRAM.
Whereas, the City of Dubuque has been awarded Lead Based Paint Hazard Control Grant
funds from the U.S. Department of Housing arid Urban Development, and
Whereas, pursuant to the rules and regulations as promulgated by the U.S. Department of
Housing and Urban Development, an environmental review has been processed for the Lead
Based Paint Hazard Control Grant; and
Whereas, a Notice of Intent to Request Release of Funds for said grants has been published
on May 8, 2019, to commence the required seven (7) days comment period; and
Whereas, any and all comments received as a result of such notice will be duly considered
before proceeding with a Request for Release of Funds and Certification; and
Whereas, a Request for Release of Funds and Certification must be sent to the U.S.
Department of Housing and Urban Development at the conclusion of the comment period.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Mayor of the City of Dubuque is hereby authorized and directed to execute
a Request for the Release of Funds and Certification on or after May 18, 2019 and submit to the
U.S. Department of Housing and Urban Development.
Section 2. That the Mayor of the City of Dubuque is hereby authorized to consent to assume
the status of a responsible federal official under the National Environmental Protection Act,
insofar as the provisions of the said Act apply to the U.S. Department of Housing and Urban
Development responsibilities for review, decision-making, and action assumed and carried out
by the City of Dubuque as to environmental issues.
Section 3. That the Mayor of the City of Dubuque is hereby authorized to consent personally,
in his official capacity and on behalf of the City of Dubuque, to accept the jurisdiction of the federal
courts if an action is brought to enforce responsibilities in relation to environmental review
process, decision-making and action.

11. Program Activity/Project Description
The City of Dubuque will utilize the Lead -Based Paint Hazard Control and Healthy Homes Supplemental funding for
administration and production costs for the performance period of April 1, 2019 - September 30, 2022. Activities will include
staff salaries and fringes, marketing and recruitment, supplies, equipment, testing, mitigation/remediation of hazards, and
clearances associated with lead hazard control work and healthy homes interventions. A total of 120 existing owner -occupied
and/or rental units housing low -moderate income individuals and families will receive assistance in making their built
environments safer and healthier. Eligibility for rental units is based on the tenant. All projects covered under this
Environmental Review will be completed on single-family homes or buildings containing one to four units constructed prior to
1978. The area of eligibility for participation in this project is the entire city of Dubuque. Preference will be given to homes
housing a child under the age of six, a pregnant woman, or having a child under the age of 6 who visits at least 10% of the
time.
Other outputs will include: 190 applicants enrolled; 170 Lead Inspection/Risk Assessments (LIRA's) and Healthy Homes
Assessments completed.; 120 units completed and cleared of lead-based paint hazards and other housing related health and
safety hazard interventions as a result of HHRS findings. In addition, low/mod residents, other contractors, City staff, and other
partners will be trained and certified as Lead Safe Renovators, Abatement Contractors and Workers, Lead Inspector/Risk
Assessor, and Healthy Homes Specialists.
The Program will also provide educational outreach and conduct events throughout the City of Dubuque to educate citizens on
the dangers of lead-based paint and other environmental health hazards. Partners of this Program include: Visiting Nurses
Association, Operation: New View Action Agency, Community Foundation of Greater Dubuque, Crescent Community Health
Center, Police & Fire Departments, Alliant Energy, Black Hills Energy, the City of Dubuque Public School District, etc.

Part 2. Environmental Certification (to be completed by responsible entity)
With reference to the above Program Activity(ies)/Project(s), I, the undersigned officer of the responsible entity, certify that:
1. The responsible entity has fully carried out its responsibilities for environmental review, decision-making and action pertaining
to the project(s) named above.
2. The responsible entity has assumed responsibility for and complied with and will continue to comply with, the National
Environmental Policy Act of 1969, as amended, and the environmental procedures, permit requirements and statutory obligations
of the laws cited in 24 CFR 58.5; and also agrees to comply with the authorities in 24 CFR 58.6 and applicable State and local
laws.
3. The responsible entity has assumed responsibility for and complied with and will continue to comply with Section 106 of the National
Historic Preservation Act, and its implementing regulations 36 CFR 800, including consultation with the State Historic Preservation
Officer, Indian tribes and Native Hawaiian organizations, and the public.
4. After considering the type and degree of environmental effects identified by the environmental review completed for the proposed
project described in Part 1 of this request, I have found that the proposal did 1 1 did not ✓ require the preparation and
dissemination of an environmental impact statement.
5. The responsible entity has disseminated and/or published in the manner prescribed by 24 CFR 58.43 and 58.55 a notice to the public
in accordance with 24 CFR 58.70 and as evidenced by the attached copy (copies) or evidence of posting and mailing procedure.
6. The dates for all statutory and regulatory time periods for review, comment or other action are in compliance with procedures and
requirements of 24 CFR Part 58.
7. In accordance with 24 CFR 58.71(b), the responsible entity will advise the recipient (if different from the responsible entity) of
any special environmental conditions that must be adhered to in carrying out the project.
As the duly designated certifying official of the responsible entity, I also certify that:

and each provision of law designated in the 24 CFR 58.5 list of NEPA-related authorities insofar as the provisions of these laws
