Supporting documents are enclosed. DISCUSSION During the City and County Officials meeting held on October 17, 2018 in Peosta, lowa, City staff questioned FEMA officials and lowa Department of Natural Resources (IDNR) staff about City and IDNR recommended changes that were not approved by FEMA. The preliminary FIRM reflects the City and IDNR recommendation to include the drainage improvements to the North Fork of Catfish Creek, which were documented in a Letter of Map Revision (LOMR). The preliminary FIRM will remove 49 structures from Special Flood Hazard Areas, mostly in the North Fork of Catfish Creek. Previously, the City of Dubuque and IDNR recommended to FEMA two map changes based on the Bee Branch Watershed improvements that are not incorporated on the preliminary FIRM: 1. Removal of the floodplain along Kaufmann Avenue and the streets around Comiskey Park. 2. Extension of the floodwall/levee system protection for the North End/Comiskey Park area. It was suggested to City staff, but never definitively confirmed, that FEMA did not approve these two changes because they are within one or more of the five map panels with an effective date of August 19, 2013 that include the City's floodwall/levee system. It was further suggested to City staff, but never definitively confirmed, that including changes on one or more of these five map panels would negate the 2011 certification of the City's floodwall/levee system. Enclosed are maps that illustrate the location of these areas recommended for change and the five FIRM panels that include the City's floodwall/levee system. RECOMMENDATION The City of Dubuque submitted the above comments via the enclosed letter from Mayor Buol to FEMA Region VI I dated October 30, 2018 for which we have no record of a response or further direction from FEMA. The City needs a definitive answer from FEMA as to whether making the recommended � changes to one of these five FIRM panels would negate the 2011 certification of the floodwall/levee system. Therefore, we recommend that the City of Dubuque re-submit these comments again as part of the appeal process described in the May 1, 2019 correspondence from FEMA. The 90-day appeal process will end approximately August 31, 2019. The enclosed letter from Mayor Buol to FEMA Region VII dated June 4, 2019 would be submitted upon City Council approval at the June 3, 2019 meeting. REQUESTED ACTION City staff recommends that the City Council authorize the Mayor to submit the enclosed letter as part of the flood mapping appeal process, respectfully requesting that FEMA provide a definitive answer as to whether making these recommended changes on one or more of the five FIRM panels that include the floodwall/levee system will negatively impact the 2011 certification. The preliminary FIRM for the City of Dubuque reflects the City and IDNR recommendation to include the drainage improvements to the North Fork of Catfish Creek, which were documented in a Letter of Map Revision (LOMR). The preliminary FIRM for the City of Dubuque reflects the City and IDNR recommendation to include the drainage improvements to the North Fork of CatFish Creek,which were documented in a Letter of Map Revision (LOMR). The City appreciates FEMA's approval of this update. The preliminary FIRM will remove 49 structures from Special Flood Hazard Areas, mostly in the North Fork of Catfish Creek. Overall, the City of Dubuque is supportive of the collaborative floodplain mapping process involving both FEMA and IDNR which has resulted in a revised preliminary FIRM that better reflects conditions in our community. We look forward to our continued consultation and partnership during the refinement of the new Flood Insurance Rate Map for our community. The City of Dubuque has a comment that was not answered completely at the City and County Officials meeting on October 17, 2018. Previously, the City of Dubuque and IDNR recommended to FEMA two map changes based on the Bee Branch Watershed improvements that are not incorporated on the preliminary FIRM: 1. Removal of the floodplain along Kaufmann Avenue and the streets around Comiskey Park. 2. Extension of the floodwall/levee system protection for the North End/Comiskey Park area. It was suggested to City staff, but never definitively confirmed,that FEMA did not approve these Service �� People�� Integ�ity � � Respo�sibility � Linovihon�� � MTeamwock������� two changes because they are within one or more of the five map panels with an effective date of August 19, 2013 that include the City's floodwall/levee system. It was further suggested to City staff, but never definitively confirmed, that including these changes on the preliminary FIRM would negate the 2011 certification of the City's floodwall/levee system. Enclosed are maps that illustrate the location of these areas recommended for change and the five FIRM panels that include the City's floodwall/levee system. The City of Dubuque respectfully requests that FEMA provide a definitive answer as to whether or not making changes within one or more of the five map panels with an effective date of August 19, 2013 that include the City's floodwall/levee system will negatively impact the 2011 certification of that system. The criteria for data submit[aYs are outIined in Title 44, Chapter fl, Code of l�ederal Regulations, Section 67.6(b) and in this docume�8. The statutory 90-day appeal period cannoY be extended. FEMA may provide an add'ational 30 days for a communiey after the 90-day appeal period has ended to submit supporting and clarifying data for an appeaI received during the appeal period. No appeafls will be accepYed afrer the 90-day appeal period. Challenges that do raoY relate ca new or modified BFEs, base flood depths, SFfif� boundazies, SFHA zone designations, or floodways aze not considered appeals. Challenges received by FEMA during the appeal period that do not address these items will be considered comments. Comments include, but a�re not li�ited to the following: • The impac�s of changes that have occurred in the floodp]ain that should have previously been sub�itted to &�M.4,in accordance with 44 Code of Federal Regulations, Section 65.3; • Corporate li�it revesions; � Aoad name errars and revisions; � Requests that changes effected by a L,OMA,LOMR-F, or LONfR be incorporated; o Base map errors; and • Other gossibfle omissi�ns or potential improvements to the mapping. Any signifacant problems 3dentified by community officials or residents (at forcnal ecneetings or otherwise) will b�addffessed appropriately. 3. Supporteng Data and Documentation Required for Appeals The BFEs and base flood depUas presented in Flood Insurance Study (FdS)repor[s and shown on F�TR10�Is are typically the eesult of coastal, hydrologic and hydraulic engineering rne4hodologies. Floodway conffiguratnons, generally developed as part of the hydraulic analyses, are adopted by communifies as a r�gtala4ory tool for floodplain management and are delineated on d�IIBI�s along with SFHAs. Because�eumerous methodologies have been developed for es[unating flood discharges and flood eflevations/depths, and oiher flood hazazd information under a variety of conditioe�s, FEMA contractars, mapping par6ners, and others whose data and documentation�'E�t.�appro�es and uses, �uch a,s c�s�ununaties, reglonal entities and State agencies participating in tite Cooper�ting Technical Farkners (C'H'P) �so�am, n�se their professional judgment in selecting anethodologies that are appropriate fo8 Yhe cond'aCions along a particulaz segment of a paeticulaa' flooding source. 5 For FEMA contracted flood studies and PIMRs the approach to be used will usually tze discussed with community offecials at the begznning of the flood study or PMR mappbng pro�ess. Because the methodologies are [he result of attempts to reduce complex physical proc�sses to mathematical enodels, the methodologies include simplifying assumptions. IJsually, Che methodologies are aased wiYh data developed specifically for the flood s[udy, PIV�t, oa L,Ol�✓EYt. Therefore, the results of[he methodologies are affected by the amount of data collecked and the precision of any measurements made. Because of the judgments and assumptions that must be made and the lianits imposed by cos[ considerations, the correctness of[he BFEs,base flood depths and other flood hazau�d information is often a matter of degree,rather than absoIuee. For that reason, agpellants who contend that the��s, b�se flood depths, or other flood hazard information is incorrect hecause better methodologies could have been used, better assumptions could have been made, or beetea data could have been used, must provide alternative analyses that incorporate saach methodologies, assumpcioas, or data and that quantify their effect on 4he�F'�s, base flood depths or other flood hazard iaafora�tion. 1�R�IA will review the alternatiae analyses and de8exnaiue whether they are super3or to t9aose used for the flood study, PMR, or LOPd� and �whether changes [o ehe FIS repoet arnd/oa FIIZiVi, or LGMR are warranted as a result. Unless appeals aze based on indispaatable mathematical or measurement ereors or the �ffects of natural physical changes thae have occurred in the floodplain, they must 1oe accora�ranied V�y all data[hat FEM.�needs to revise the prelaminary version of the FIS report and�I�R�7s. �'herefore, appellants should be paepared to perform coastal, hydrologic and hydraulic analyse�, to plot new and/or revised F1ood�eofiles, and to delineate revised SFI-Itl zone and reguYatory floodway boundaries as necessau-y. An appeal must be based on data tbat show the new or modified BFEs, base flood depths, SFHA boundazies, SFFd.A zone designations, or floodways to be scientifically or technically incorrect. Appea! Period Proceclures Appeals and comments must be resolved by follawing the procedures below: • Acknowledgement by FEI�A of fhe receipt of an appeal in writing, ensuring that acknowiedged appeals iYaclude AL.L of the criteria discussed above. � Acknowledge 4he receaqr2 of commenes. At a muumum FEMA must notify the community in writing ghat iF did noc receive any appeals. This can be done by sep�ate correspondence or by¢he anclaasaora of language in the Leteer of Final Determinatiort (LFD). 11 • FEMA or the mapping par[ner will eva,luate any scientific or technical data submitt�d for compliance with enisting mapping statues, regulations, ar Guidelines and Standards. • F'EMA or the mapping par[ner will request any additional scientific or technical data required to properly review the appeal or comment. � FEMA or the mapping partner wii�make a recommendation to FEMA on the resolu[ion of the appeal or comment. • FEMA or the mapping partner will prepare a draft appeal resolution letter (if all the criteria for an appeal are met). . All correspondence must be prepared and issued on k7EI�I�eadqezarters or FEMA Itegionalletterhead. � FEMA provides a comment perio�of 30 days following the date the appeal or comment resolution letter is issued. Any comccaents received during the 30 day comment period must be addressed and resolved befo�e proceeding witb the LFD, Extensions to this 30 day period can only be granted v✓ith F'E11R,�Headquarters approval. 5. General Technicat Guedarrce Detailed guidance on the supporting documentation that must be submitted in support of an appeal can be found in Appeals, FPevisions, ar�d f►rrtendments to National Flood Insurance Program Maps A Guide for Community Officials. Unless appeals aze based on the use of alternative models or methodologies, the hydrologic and hydraulic analyses that appellants subiriit must be performed with the models used for the tlood study, PMIt, or LOMR. Generally, wh�n appellants are required to submit hydrologic or hydraulic ac�alyses, those analyses must be pexformed for the same recurrence interval floods as those performed for the flood study, I'Iv&Y3, or A,O�d. The vertical datum used in any data submitted must match the datum used in the prelimznary FIS report and FIRM. Furcher, SFHA bou�daries are to be shovvn on a topogapluc map (preferably, in digital form) whose scale and contour interval aze sufficient to provide reasonable accuracy. All analyses and data submitted by appellants, incfluciing those that show mathematica] or measurement enors must be certified by a PSegisiered Frofessional Engineer or Licensed Land Surveyor, as appropriate. 6. Scientific Resolution Pane� (�EiP) FEMA's Scient�c Resolution Panel(SIB�) process reinforces FEMA's commitment to work w+ith communities to ensure the flood hazar@ data depicted on FIRMs is built collaboratively using the best science available. When changes to the FIIFIvIs are met wiYh conflicting [echnicai and scientific data, an independent third party review of the information may be needed to ensure the FII�IvIs ue updated cosecely. The SRP serves as fhe independent third party. To be eligible for an SI2P, an appeal must include supporting flnforma¢ian or data to substantiate that the BFEs, base flood depths, SFHA boundaries, SF�A zone desigmations, or floodways proposed by FEMA aze scientifically or technically incosrect..4n SA�eequest is an option only afrer FEMA and a floeal community have been engageci in�coIlaborative�onsultation process for at least 60 days without a mutually-acceptable resoiutaoa�of an appeal. 13
