Van Milligen, City Manager SUBJECT: Calendar Year 2018 Urban Revitalization Applications DATE: May 29, 2019 On February 18, 2019, the City Council approved 14 residential properties in recognized Urban Revitalization Areas, and authorized transmittal to the City Assessor for final review and determination of the amount of property tax abatement. Upon further review it was determined that one of the properties (67 Main Street owned by Jeff Burds) is not in a designated Urban Revitalization Area. Housing and Community Development Director Alexis Steger recommends the City Council rescind the property tax abatement for 67 Main Street. It is for this reason, that we are requesting City Council rescind the approval of the urban revitalization application from Jeff Burds for the property located at 67 Main Street. ACTION I respecffully request City Council approve the attached resolution rescinding the property tax abatement for 67 Main Street based on the location of the property being ineligible for the abatement. Prepared by Alexis Steger, Housing & Community Devel., 350 W. 6th St., Suite 312, Telephone: 563-690-6072 Return to: Kevin Firnstahl, City Clerk Address: City Hall- 50 W. 13th St Telephone: (563) 589-4100 RESOLUTION NO. 202-19 RESOLUTION RESCINDING APPROVAL OF THE PROPERTY TAX ABATEMENT APPLICATION SUBMITTED BY JEFF BURDS FOR THE PROPERTY LOCATED AT 67 MAIN STREET AS NOT IN AN URBAN REVITALIZATION AREA AND AUTHORIZING THE TRANSMITTAL OF THE RECISION TO THE CITY ASSESSOR Whereas, Chapter 404 of the Code of Iowa, the Urban Revitalization Act, permits cities to abate property taxes for improvements made to properties in designated revitalization areas; and Whereas, the Urban Revitalization Act requires property owners to submit a written application for abatement by February 1 of the assessment yearforwhich the abatement is first claimed, and further requires the City Council to approve all applications that meet the requirements of the adopted Urban Revitalization Plan. Copies of the Urban Revitalization applications are forwarded to the City Assessor for review by March 1 of each year; and Whereas, pursuant to the requirements of said Urban Revitalization Act, an Urban Revitalization Area of the Old Main District was created; and Whereas, an application was submitted to and approved by the City Council in February 2019 for 67 Main Street as part of the Old Main Urban Revitalization Area, and Whereas, after further review it was determined the property is beyond the boundary of the OId Main Urban Revitalization Area; and Whereas, the City of Dubuque must rescind its acceptance and approval of the application for tax abatement for the property listed as it is not located within the aforementioned Old Main District Urban Revitalization Area: District Address Property Owner Type of Property Exemption Period OId Main 67 Main Street Jeff Burds Commercial 3 -year NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the above-described tax abatement application does not meet the requirements of the City of Dubuque's Urban Revitalization Plan as being located within an Urban Revitalization Area. Section 2.
