INTRODUCTION
The purpose of this memorandum is to seek acceptance of a Grants of Easement for
Grants of Easement for Sidewalk and Public Utilities, Public Electric Utilities, and Public
Utilities across properties along Kaufmann Avenue as part of the 22"d Street/Kaufmann
Avenue Storm Sewer Improvements Project (White Street to Kleine Street).
BACKGROUND
The 22nd Street/Kaufmann Avenue Storm Sewer Improvements Project (White Street to
Kleine Street) is one phase of the Bee Branch Watershed Flood Mitigation Project. The
project involves the replacement of the existing storm sewer with a large diameter storm
sewer and additional storm drains (intakes) along 22"d Street/Kaufmann Avenue from
White Street to Kleine Street. Improvements will continue up Kaufmann Avenue to
Kane Street in future phases. This work will require the relocation and reconstruction of
existing underground utilities to provide the necessary space for the larger storm sewer.
It will also requirP the completP removal and subsequent reconstr�.�ction of the stre�t.
The improvements will be constructed in multiple traffic control phases to accommodate
residents and businesses. Phase I involves the construction of improvements on 22�d
Street from White Street to Francis Street. Phase II improvements include construction
from Francis Street to North Main Street. Phase III improvements include construction
from North Main Street to west of Kleine Street. Improvements include the installation
of approximately 1200 linear feet of 10-foot by 6-foot concrete box culvert (either cast-in
place or precast) with cast in place connections on both the west and east ends of the
project. The project also includes local storm sewer and intakes, roadway
reconstruction with Hot Mix Asphalt (HMA) pavement, Portland Cement Concrete (PCC)
driveways, sidewalk, and curb ramp reconstruction, PCC retaining walls, railings, and
step construction, water main replacement, sanitary sewer replacement, temporary
stnrm water manager�r7ent, dewafierir�c�, mobifizaiiaii, elEctricai �or�duits, fiber vaults,
traffic signal replacement, miscellaneous restoration, erosion control, and traffic control.
DISCUSSION
As discussed above, this project includes the complete removal and subsequent
reconstruction of the street. The street and sidewalks are being widened to meet
current design standards. As such, several utilities need to be relocated behind the
pavement and sidewalks because the existing street right of way width will not
accommodate all of the relocations. As such, the City proposes to acquire permanent
Easements for Sidewalk and Public Utilities, Public Electric Utilities, and Public Utilities
for the purpose of constructing, operating and maintaining the relocated utilities across
the properties. The Grants of Easements and Plats to the City are shown on the
attached exhibits.
RECOMMENDATION
I recommend accepting the Grants of Easement for Sidewalk and Public Utilities, Public
Electric Utilities, and Public Utilities across the properties identified on the attached
resolution and as shown on the exhibits attached to the Grants of Easement.
ACTION TO BE TAKEN
I respectfully request acceptance of the Grants of Easement for Sidewalk and Public
Utilities, Public Electric Utilities, and Public Utilities from the property owners along
Kaufmann Avenue as part of the ZZnd Street/Kaufmann Avenue Storm Sewer
Improvements Project (White Street to Kleine Street), through the adoption of the
enclosed resolution.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grants of Easement for Sidewalk and Public Utilities, and
the Grants of Easement for Public Electric Utilities, and the Grants of Easement for
Public Utilities, across the properties as listed above, in the City of Dubuque, Iowa from
the property owners as listed above, copies of which are attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution with each said Grants of Easement for Sidewalk and
Public Utilities, Grants of Easement for Public Electric Utilities, and the Grants of
Easement for Public Utilities, in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

GRANT OF EASEMENT FOR SIDEWALK AND PUBLIC UTILITIES
For and in consideration of the sum of Ten and 00/100's ($10.00) and other good
and valuable consideration, AAA Car Care Center, INC., an Iowa Corporation,
("Grantor") does hereby grant to the City of Dubuque ("Grantee"), a municipal
corporation, its agents and contractors, from the date hereof, a right of way and
easement through, under and across the following described real estate situated
in Dubuque County, Iowa, to wit:
Part of I_=It 8A of L.H. Langworthy's Addition, in the City of
Dubuque, Iowa, as shown on Exhibit A attached hereto and by reference
made a part hereof.
Said easement shall be as shown on the attached Exhibit A for the purpose of
constructing a public sidewalk and constructing and maintaining public utilities
and other appurtenances, along with the right, privilege and authority to
construct, reconstruct, maintain, operate, repair, patrol and remove said
improvements. Said easement shall also include the right to cut, trim or remove
trees, bushes and roots as may be required incident to rights given herein.
It is understood and agreed that the Grantee herein shall restore the disturbed
area due to the construction, maintenance or repair of said public utilities and
other appurtenances.
Grantor shall not erect any structure over or within the easement area without
obtaining the prior written approval of the City Engineer. Grantor shall not
change the grade, elevation, and contour or perform any construction or
excavation that will diminish the lateral support or integrity of said improvements
without obtaining the prior written consent of the City Engineer.
To have and to hold unto the said City of Dubuque, Iowa, forever, and the
undersigned do hereby expressly covenant that they are the owners in fee of
said real estate and have good right to execute this agreement, and that the
Grantee, its agents or contractors, shall at all times have free access to and
egress from and over said real estate to maintain or repair said public utilities
thereon or therein.

PUBLIC ELECTRIC UTILITIES ASSOCIATED WITH THE 22ND STREET/KAUFMANN
AVENUE STORM SEWER IMPROVEMENTS PROJECT, WHITE STREET TO
KLEINE STREET, IN THE CITY OF DUBUQUE, IOWA
Whereas, AAA Car Care Center, INC, has executed a Grant of Easement for
Sidewalk and Public Utilities across Part of Lot 8A of L.H. Langworthy's Addition, in the
City of Dubuque, Iowa; and
Whereas, the Revocable Living Trust of Nick A. Helgerson and Sondra J. Helgerson,
has executed a Grant of Easement for Public Electric Utilities across Part of Lot 1-21 of
Tivoli's Addition, in the City of Dubuque, Iowa; and
Whereas, Jeremy R. Valentine, has executed a Grant of Easement for Public Utilities
across Part of Lot 3 of Weland's Subdivision, in the City of Dubuque, Iowa; and
Whereas, JRK Properties, LLC, has executed a Grant of Easement for Public Utilities

Whereas, Stephanie R. Walker and Darrell Walker Jr., have executed a Grant of

in the City of Dubuque, Iowa; and
Whereas, Julie A. Stierman and Eric B. Stierman, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Lot 1 of Lot 1 of Lot 1 of Lot 1
of Lot 147, and the West half of Lot 1 of Lot 1 of Lot 2 of Lot 147, in L.H. Langworthy's
Addition, in the City of Dubuque, Iowa; and
Whereas, Vance F. Koehler and Lindsay Koehler-Plath, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Cornelia Place, in the City of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grants of Easement for Sidewalk and Public Utilities, and
the Grants of Easement for Public Electric Utilities, and the Grants of Easement for
Public Utilities, across the properties as listed above, in the City of Dubuque, Iowa from
the property owners as listed above, copies of which are attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution with each said Grants of Easement for Sidewalk and
Public Utilities, Grants of Easement for Public Electric Utilities, and the Grants of
Easement for Public Utilities, in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

GRANT OF EASEMENT FOR PUBLIC ELECTRIC UTILITIES
For and in consideration of the sum of Ten and 00/100's ($10.00) and other good
and valuable consideration, REVOCABLE LIVING TRUST OF NICK A.
HELGERSON AND SONDRA J. HELGERSON ("Grantor") does hereby grant to
the Public and the City of Dubuque ("Grantee"), a municipal corporation, its
agents and contractors, from the date hereof, a right of way and easement
through, under and across the following described real estate situated in
Dubuque County, Iowa, to wit:
Part of Lot 1-21 of Tivoli's Addition, in the City of Dubuque, Iowa, as
shown on Exhibit A attached hereto and by reference made a part hereof.
Said easement shall be as shown on the attached Exhibit A for the purpose of
constructing and maintaining public electric utilities and other appurtenances,
along with the right, privilege and authority to construct, reconstruct, maintain,
operate, repair, patrol and remove said improvements. Said easement shall also
include the right to cut, trim or remove trees, bushes and roots as may be
required incident to rights given herein.
It is understood and agreed that the Grantee herein shall restore the disturbed
area due to the construction, maintenance or repair of said public utilities and
other appurtenances.
Grantor shall not erect any structure over or within the easement area without
obtaining the prior written approval of the City Engineer. Grantor shall not
change the grade, elevation, and contour or perform any construction or
excavation that will diminish the lateral support or integrity of said improvements
without obtaining the prior written consent of the City Engineer.
To have and to hold unto the said City of Dubuque, Iowa, forever, and the
undersigned do hereby expressly covenant that they are the owners in fee of
said real estate and have good right to execute this agreement, and that the
Grantee, its agents or contractors, shall at all times have free access to and
egress from and over said real estate to maintain or repair said public electric
utilities thereon or therein.
This easement shall terminate if and when the proposed electric utility pole and
appurtenances installed on the easement area is removed or relocated in the
future.

Whereas, AAA Car Care Center, INC, has executed a Grant of Easement for
Sidewalk and Public Utilities across Part of Lot 8A of L.H. Langworthy's Addition, in the
City of Dubuque, Iowa; and
Whereas, the Revocable Living Trust of Nick A. Helgerson and Sondra J. Helgerson,
has executed a Grant of Easement for Public Electric Utilities across Part of Lot 1-21 of
Tivoli's Addition, in the City of Dubuque, Iowa; and
Whereas, Jeremy R. Valentine, has executed a Grant of Easement for Public Utilities
across Part of Lot 3 of Weland's Subdivision, in the City of Dubuque, Iowa; and
Whereas, JRK Properties, LLC, has executed a Grant of Easement for Public Utilities
across Part of Lot 4 of Weland's Subdivision, in the City of Dubuque, Iowa; and
Whereas, Melissa A. Stock, has executed a Grant of Easement for Public Utilities
across Part of Lot 12, and the West 7 %2 feet of Lot 11, in Cushing's Addition, in the City
of Dubuque, Iowa; and
Whereas, GRTD Investments, LLC, has executed a Grant of Easement for Public
Utilities across Part of Lot 2 of Lot 1, Lot 2 of Lot 2, and Lot 14, of Cushing's Addition, in
the City of Dubuque, Iowa; and
Whereas, Dale P. Kleinschrodt and Karen A. Kleinschrodt, have executed a Grant of
Easement for Public Utilities across Part of the West Half of Lot 3-143 of L.H.
Langworthy's Addition, in the City of Dubuque, Iowa; and
Whereas, Stephanie R. Walker and Darrell Walker Jr., have executed a Grant of
Easement for Public Utilities across Part of Lot 1-2-2-147 of L.H. Langworthy's Addition,
in the City of Dubuque, Iowa; and
Whereas, Julie A. Stierman and Eric B. Stierman, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Lot 1 of Lot 1 of Lot 1 of Lot 1
of Lot 147, and the West half of Lot 1 of Lot 1 of Lot 2 of Lot 147, in L.H. Langworthy's
Addition, in the City of Dubuque, Iowa; and
Whereas, Vance F. Koehler and Lindsay Koehler-Plath, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Cornelia Place, in the City of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grants of Easement for Sidewalk and Public Utilities, and
the Grants of Easement for Public Electric Utilities, and the Grants of Easement for
Public Utilities, across the properties as listed above, in the City of Dubuque, Iowa from
the property owners as listed above, copies of which are attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution with each said Grants of Easement for Sidewalk and
Public Utilities, Grants of Easement for Public Electric Utilities, and the Grants of
Easement for Public Utilities, in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

GRANT OF EASEMENT FOR PUBLIC UTILITIES
For and in consideration of the sum of Ten and 00/100's ($10.00) and other good
and valuable consideration, Dale P. Kleinschrodt and Karen A. Kleinschrodt
("Grantor") does hereby grant to the Public and the City of Dubuque ("Grantee"),
a municipal corporation, its agents and contractors, from the date hereof, a right
of way and easement through, under and across the following described real
estate situated in Dubuque County, Iowa, to wit:
Part of the West Half of Lot 3-143 of L.H. Langworthy's Addition, in the
City of Dubuque, Iowa, as shown on Exhibit A attached hereto and by
reference made a part hereof.
Said easement shall be as shown on the attached Exhibit A for the purpose of
constructing and maintaining public utilities and other appurtenances, along with
the right, privilege and authority to construct, reconstruct, maintain, operate,
repair, patrol and remove said improvements. Said easement shall also include
the right to cut, trim or remove trees, bushes and roots as may be required
incident to rights given herein.
It is understood and agreed that the Grantee herein shall restore the disturbed
area due to the construction, maintenance or repair of said public utilities and
other appurtenances.
Grantor shall not erect any structure over or within the easement area without
obtaining the prior written approval of the City Engineer. Grantor shall not
change the grade, elevation, and contour or perform any construction or
excavation that will diminish the lateral support or integrity of said improvements
without obtaining the prior written consent of the City Engineer.
To have and to hold unto the said City of Dubuque, Iowa, forever, and the
undersigned do hereby expressly covenant that they are the owners in fee of
said real estate and have good right to execute this agreement, and that the

Grantee, its agents or contractors, shall at all times have free access to and
egress from and over said real estate to maintain or repair said public utilities
thereon or therein.

GRANT OF EASEMENT FOR SIDEWALK AND PUBLIC UTILITIES
For and in consideration of the sum of Ten and 00/100's ($10.00) and other good
and valuable consideration, JULIE A. STIERMAN AND ERIC B. STIERMAN,
("Grantor") does hereby grant to the City of Dubuque ("Grantee"), a municipal
corporation, its agents and contractors, for the benefit of the City of Dubuque and
all other public utilities, from the date hereof, a right of way and easement
through, under and across the following described real estate situated in
Dubuque County, Iowa, to wit:
Part of Lot 1 of Lot 1 of Lot 1 of Lot 1 of Lot 147, and the West half of Lot 1
of Lot 1 of Lot 2 of Lot 147, in L.H. Langworthy's Addition, in the City of
Dubuque, Iowa, as shown on Exhibit A attached hereto and by reference
made a part hereof.
Said easement shall be as shown on the attached Exhibit A for the purpose of
constructing a public sidewalk and constructing and maintaining public utilities
and other appurtenances, along with the right, privilege and authority to
construct, reconstruct, maintain, operate, repair, patrol and remove said
improvements. Said easement shall also include the right to cut, trim or remove
trees, bushes and roots as may be required incident to rights given herein.
It is understood and agreed that the Grantee herein shall restore the disturbed
area due to the construction, maintenance or repair of said public utilities and
other appurtenances.
Grantor shall not erect any structure over or within the easement area without
obtaining the prior written approval of the City Engineer. Grantor shall not
change the grade, elevation, and contour or perform any construction or
excavation that will diminish the lateral support or integrity of said improvements
without obtaining the prior written consent of the City Engineer.

To have and to hold unto the said City of Dubuque, Iowa, forever, and the
undersigned do hereby expressly covenant that they are the owners in fee of
said real estate and have good right to execute this agreement, and that the

thereon or therein.

Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grants of Easement for Sidewalk and Public Utilities, and
the Grants of Easement for Public Electric Utilities, and the Grants of Easement for
Public Utilities, across the properties as listed above, in the City of Dubuque, Iowa from
the property owners as listed above, copies of which are attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution with each said Grants of Easement for Sidewalk and
Public Utilities, Grants of Easement for Public Electric Utilities, and the Grants of

RESOLUTION NO. 205-19
ACCEPTING GRANTS OF EASEMENT FOR SIDEWALK, PUBLIC UTILITIES, AND
PUBLIC ELECTRIC UTILITIES ASSOCIATED WITH THE 22ND STREET/KAUFMANN
AVENUE STORM SEWER IMPROVEMENTS PROJECT, WHITE STREET TO
KLEINE STREET, IN THE CITY OF DUBUQUE, IOWA
Whereas, AAA Car Care Center, INC, has executed a Grant of Easement for
Sidewalk and Public Utilities across Part of Lot 8A of L.H. Langworthy's Addition, in the
City of Dubuque, Iowa; and
Whereas, the Revocable Living Trust of Nick A. Helgerson and Sondra J. Helgerson,
has executed a Grant of Easement for Public Electric Utilities across Part of Lot 1-21 of
Tivoli's Addition, in the City of Dubuque, Iowa; and
Whereas, Jeremy R. Valentine, has executed a Grant of Easement for Public Utilities
across Part of Lot 3 of Weland's Subdivision, in the City of Dubuque, Iowa; and
Whereas, JRK Properties, LLC, has executed a Grant of Easement for Public Utilities
across Part of Lot 4 of Weland's Subdivision, in the City of Dubuque, Iowa; and
Whereas, Melissa A. Stock, has executed a Grant of Easement for Public Utilities
across Part of Lot 12, and the West 7 IA feet of Lot 11, in Cushing's Addition, in the City
of Dubuque, Iowa; and
Whereas, GRTD Investments, LLC, has executed a Grant of Easement for Public
Utilities across Part of Lot 2 of Lot 1, Lot 2 of Lot 2, and Lot 14, of Cushing's Addition, in
the City of Dubuque, Iowa; and
Whereas, Dale P. Kleinschrodt and Karen A. Kleinschrodt, have executed a Grant of
Easement for Public Utilities across Part of the West Half of Lot 3-143 of L.H.
Langworthy's Addition, in the City of Dubuque, Iowa; and
Whereas, Stephanie R. Walker and Darrell Walker Jr., have executed a Grant of
Easement for Public Utilities across Part of Lot 1-2-2-147 of L.H. Langworthy's Addition,
in the City of Dubuque, Iowa; and
Whereas, Julie A. Stierman and Eric B. Stierman, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Lot 1 of Lot 1 of Lot 1 of Lot 1
of Lot 147, and the West half of Lot 1 of Lot 1 of Lot 2 of Lot 147, in L.H. Langworthy's
Addition, in the City of Dubuque, Iowa; and
Whereas, Vance F. Koehler and Lindsay Koehler-Plath, have executed a Grant of
Easement for Sidewalk and Public Utilities across Part of Cornelia Place, in the City of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grants of Easement for Sidewalk and Public Utilities, and
the Grants of Easement for Public Electric Utilities, and the Grants of Easement for
Public Utilities, across the properties as listed above, in the City of Dubuque, Iowa from
the property owners as listed above, copies of which are attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. That the City Clerk be and is hereby authorized and directed to record a
certified copy of this resolution with each said Grants of Easement for Sidewalk and
Public Utilities, Grants of Easement for Public Electric Utilities, and the Grants of
Easement for Public Utilities, in the offices of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.
