I Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report, and related materials are attached for your review. Discussion Mike Weber, representing Royal Oaks Development Corporation, spoke in favor of the request. He described the proposal, noting the rezoning and annexation process and that public sewer and water were adjacent to the property. He noted that Silver Oaks Drive would remain a private street under the control of the homeowners' association until such a time as it is dedicated to the city. Additionally, he discussed density and reducing the proposal from fourplexes down to two-family townhomes. Attorney Ted Huinker, 890 Main Street — Suite 200, spoke on behalf of the applicant. He discussed a pre-annexation agreement from 2014. He also mentioned that they initially requested the property to be rezoned to allow fourplexes. He said they have revised the zoning request to allow no more than two-unit town homes. Staff reviewed the staff report, noting the layout, size, location, easements, and access to the area to be rezoned. Staff discussed the applicant is requesting rezoning in conjunction with annexation. Staff also noted the difference between County R-2 and City R-2 zoning districts. Staff also noted covenants with homeowner associations are private contracts that have no bearing on City rules and regulations. Additionally, Staff described the process for dedication of private streets to the city. Staff noted that a pre- annexation agreement does exist. Seroice Pcople Integrity Responeibffity Lmovatlon Teaznwock The Honorable Mayor and City Council Members Page 2 There were four public comments citing concerns with winter road maintenance of Silver Oaks Drive, increased density of the neighborhood, and allowing more time for negotiations between the property owner and the homeowner's association. The Zoning Advisory Commission discussed the request, and received clarification from staff on covenants, notification requirements of the rezoning, current permitted development and the private road dedication process. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The property was platted in March 2017 as part of a residential county subdivision. Physical Characteristics: The subject property is located at the intersection of Elmwood Drive and Silver Oaks Drive. The property consists of 13 platted lots with frontage along Silver Oaks Drive (private road) and two platted lots with frontage along Elmwood Drive (county right-of-way). Silver Oaks Drive has a 66-foot-wide platted right-of-way and approximately 26 feet of pavement with no curb, gutter, shoulders or sidewalks. Elmwood Drive has 72-foot-wide platted right-of-way and approximately 20 feet of pavement with no curb, gutter, shoulders or sidewalks. There are 12 platted lots that range in size from 1 acre to 2 acres and one lot that is 87 acres in size. Royal Oaks Development Corporation is in the process of applying to rezone the property to R-2 Two-Family Residential concurrently with annexation. Imagine Dubuque Comprehensive Plan Recommendations: Multi-Family - Encourage a mix of housing affordable for all segments of Dubuque's populations throughout the community, including options for those who might be saving for their first home. Rezoning Staff Report — Silver Oaks Estates, Phase II Page 2 Impact of Request on: Utilities: City water is available to the site along the Elmwood Drive frontage and there is a hydrant at the intersection of Elmwood Drive and Silver Oaks Drive. The water main is adequate to serve the proposed development. City sanitary sewer service is also available along the Elmwood Drive frontage. The sewer main is adequate to serve the proposed development. Traffic Patterns/Counts: There are no traffic counts available for Silver Oaks Drive or Elmwood Drive which provide access to the development. The property was already developed as a residential subdivision in the county. The change from a county subdivision to a city subdivision should add very little traffic to Elmwood Drive and Silver Oaks Drive. Elmwood Drive was the former US Highway 61 and carried a large volume of traffic. A new frontage road is under construction as part of the Southwest Arterial project. Elmwood Drive's current at grade access to Highway 151/61 will be closed once the Southwest Arterial and iYs interchange with Highway 151/61 is completed. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided that any future development of the property is in compliance with established City standards for storm water management and erosion control. Adjacent Properties: The proposed rezoning of the subject parcel to R-2 Two- Family allows single-family homes and duplexes. The adjacent properties to the north and east are part of a single-family residential subdivisions and the properties to the south are agricultural land and a single-family residential subdivision. The property to the west is the Elmwood Drive and US Highway 61/151 right-of-way. The proposed rezoning should have very little impact on the adjacent uses. CIP Investments: None proposed. Staff Analysis: The applicanYs request is to rezone the subject property from County R-2 Residential to City of Dubuque R-2 Two-Family Residential in conjunction with annexation of the property to the city of Dubuque. County R-2 zoning only allows single-family homes with reduced setbacks when compared to County R-1 zoning. City R-2 Two-Family Residential zoning allows both single and two-unit residential dwellings. The subject property is located at the intersection of Elmwood Drive and Silver Oaks Drive. Within the past two years, the City of Dubuque has installed water and sewer service to the airport. These public utilities run along Elmwood Drive and can adequately service the site.
