The request is being filed by Royal Oaks Development Corporation for approximately 106.96 acres of property, concurrent with rezoning. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory is located at the intersection of Elmwood Drive and Silver Oaks Drive. The property consists of 13 platted lots with frontage along Silver Oaks Drive (private road) and two platted lots with frontage along Elmwood Drive (county right-of- way). On April 3, 2019, the Zoning Advisory Commission approved the request of Royal Oaks Development Corporation to rezone the property to R-2 Two-Family Residential in conjunction with annexation. The 106.96-acre annexation territory includes an additional 0.99 acres of County right- of-way (Elmwood Drive), in accordance with lowa Code. By lowa Code, the annexation will be approved upon acknowledgement by the Secretary of Sta;e that the legal description, map and resolution have been received. RECOMMENDATION Staff recommends the City Council approve the voluntary annexation request at the June 3, 2019 public hearing. Property History: The subject property has been utilized for agricultural production. The property was platted in March 2017 as part of a residential county subdivision. Physical Characteristics: The subject property is located at the intersection of Elmwood Drive and Silver Oaks Drive. The property consists of 13 platted lots with frontage along Silver Oaks Drive (private road) and two platted lots with frontage along Elmwood Drive (county right-of-way). Silver Oaks Drive has a 66-foot-wide platted right-of-way and approximately 26 feet of pavement with no curb, gutter, shoulders or sidewalks. Elmwood Drive has 72-foot-wide platted right-of-way and approximately 20 feet of pavement with no curb, gutter, shoulders or sidewalks. There are 12 platted lots range in size from 1 acre to 2 acres and one lot that is 87 acres in size. Royal Oaks Development Corporation is in the process of applying to rezone the property to R-3 Moderate Density Multi-Family Residential concurrently with annexation. Future Land Use Map — Single-Family Residential. Impact of Request on: Utilities: City water is available to the site along the Elmwood Drive frontage and there is a hydrant at the intersection of Elmwood Drive and Silver Oaks Drive. The water main is adequate to serve the proposed development. City sanitary sewer service is also available along the Elmwood Drive frontage. The sewer main is adequate to serve the proposed development. Traffic Patterns/Counts: There are no traffic counts available for Silver Oaks Drive or Elmwood Drive which provide access to the development. The property was already developed as a residential subdivision in the county. The change from a county subdivision to a city subdivision should add very little traffic to Elmwood Drive and Silver Oaks Drive. Elmwood Drive was the former US Highway 61 and carried a large volume of traffic. A new frontage road is under construction as part of the Southwest Arterial project. Elmwood Drive's current at grade access to US Highway 151/61 will be closed once the Southwest Arterial and iYs interchange with US Highway 151/61 are completed. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided that any future development of the property is in compliance with established City standards for storm water management and erosion control. Adjacent Properties: The proposed rezoning of the subject parcel to R-2 Two- Family allows single-family and two-family housing units. The adjacent properties to the north and east are part of a single-family residential subdivision and the properties to the south are agricultural land and a single-family residential subdivision. The property to the west is the Elmwood Drive and US Highway 61/151 right-of-way. The proposed rezoning should have very little impact on the adjacent uses. CIP Investments: None proposed. Staff Analysis: The City received a written application from Royal Oaks Development Corporation for voluntary annexation of approximately 106.96 acres of property. The annexation territory is located at the intersection of Elmwood Drive and Silver Oaks Drive. The application, a resolution and other supporting documents are attached. Within the past two years, the City of Dubuque has installed water and sewer service to the airport. These public utilities run along Elmwood Drive and can adequately service the site. A new frontage road (Elmwood Drive) is being constructed as part of the Southwest Arterial project and will provide access to Silver Oaks Subdivision as well as the other adjacent county subdivisions. Elmwood Drive's current at grade access to US Highway 151/61 will be closed once the Southwest Arterial and iYs interchange with US Highway 151/61 are completed. The applicant has requested rezoning the subject property from County R-2 Residential to City of Dubuque R-2 Two-Family Residential in conjunction with annexation to the city of Dubuque. The rezoning was approved by the City's Zoning Advisory Commission on April 3, 2019. The subject property is part of Area D of the Annexation Analysis. This study provides a cost/benefit analysis of 23 potential growth areas around the city of Dubuque. This annexation is consistent with the Imagine Dubuque Comprehensive Plan. The City of Dubuque has the capacity to provide substantial municipal services to the annexation territory. By lowa Code, annexation will be considered complete upon acknowledgement by the Secretary of State that the legal description, map and resolution have been received.
