The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the location of the property, what
a mobile batch plant is, and the benefits of the mobile plant versus a permanent
installation. The applicant reviewed the surrounding land use, access to the site, and
dust control measures that will be used. The applicant reviewed that he held a
neighborhood meeting, but only one person attended. The applicant reviewed the
power plant slides with the Commission.
Staff reviewed the staff report, noting the history of zoning on the property, that the
property was annexed to the City in 2003, and is currently served with City water, but
has no access to sanitary sewer. Staff reviewed the surrounding zoning and land use,
and the allowed uses in the MHI District.
There were no public comments.
The Zoning Advisory Commission discussed the request, and based on surrounding
zoning and land use both in the City and County, found the requested rezoning to be
appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.

The owner of C&C Freight called on 5/13/19 and he was concerned about dust. I informed him our plant had a dust
collection system and the parking lot would be paved. He said that "he or his attorney would attend the meeting", but
neither showed last night. I would like to note that his parking lot is graveled and not paved and he is upwind from us. I
am not complaining,just pointing that out.
I had a sign-up sheet and the only neighbor to show up was Steve Rodham on behalf of Addoco. He had no objections,
and inquired about our plans with our current property since it is next door to him.
I have attached the letter and map I mailed out to this email. No letters were returned to us as undeliverable. We ditl
send as regular mail and not certified mail.

Dear Neighbor(s),
As you may well be aware, BARD Materials has a ready-mix plant located at 12688 Industrial Ct that we
use intermittently. BARD Acquired this plant and location around twenty years ago from the previous
owner.
Due to the construction of the Southwest Arterial BARD has been using this plant more frequently over
the last two seasons. With this workload and the aging of the current plant BARD is looking to purchase
a parcel of property on Seippel Court. This property is undeveloped, and because of that it still has the
agricultural zoning instead of the commercial/industrial zoning of the developed properties around it.
To operate a ready-mix plant in Dubuque City Limits we will need to get zoning for Modified Industrial.
BARD is on the agenda for the June 5`h zoning meeting, and adjoining neighbors within 200 feet of the
parcel on Seippel Court will be notified by the city. I am sending this letter to all our neighbors within
800 feet.
I have attached an Aerial photo that shows the current location and the proposed new location. As
shown on the photo the new location is less than 800 feet southeast of the current location.This new
location will have less impact on several of our neighbors since most of our future traffic will go south on
Seippel Road to the new Southwest Arterial or Highway 20.
The proposed new location will still be operated as an intermittent ready-mix plant. There will be a new
plant on the site and it will have to meet all the conditions set forth by the city, county, state, and
federal regulations.
I would also like to invite you to an informative meeting on May 23, 2019 at our Key West plant located
at 2400 Hwy 52 South, Dubuque, IA 52003. The meeting will Start at 6:30 P.M. with a short
introduction, zoning presentation and a tour of the ready-mix plant. i
We want to be very open with all our neighbors. We want to answer any questions you may have about I
our new plant I would urge you to come to our meeting on the 23`d. I

Why Modified Industrial?
• BARD could put a portable plant on the current location without
any further zoning, but as stated before the traffic patterns are
tight.
• The proposed future location is in the city limits and they require
Modified Heavy Industrial (MHI).
• Dubuque also requires MHI for Parking structures, Lumber Yards, �
Manufacturing, Vehicle Body Shops etc....
• MHI is not the same as Heavy Industrial which is for salvage yards,
oil/fuel storage, landfills etc....

Property History: The property was vacant or under agricultural production until its
annexation in 2003. Subsequently the property has been rezoned to CS Commercial
Service and Wholesale district, subdivided and rough-graded and remains vacant. In
July 2017, the parcel was rezoned to AG Agricultural.
Physical Characteristics: The subject property is an approximately six-acre parcel with
approximately 70 feet of frontage along Seippel Court at the northeast corner of the
property. The subject property drops from the high point at the Seippel Court access to
its low point along the property's southern border directly adjacent to the Brehm farm.
Concurrence with Comprehensive Plan: The City's 2030 Future Land Use Plan
identifies this area as commercial.
Impact of Request on:
Utilities: City water is available to the site currently. The water main is adequate to
serve the proposed development. City sanitary sewer service is not available to
this site or the adjacent commercial service and residential development to the
north and east.
Traffic Patterns/Counts: Based on 2013 IDOT counts, 3,410 average daily trips
occur along Old Highway Road west of its intersection with Seippel Road, and
2,600 vehicle trips occur along Seippel Road just south of the intersection with
Seippel Court. There were no vehicle counts available from the IDOT for 2017.

Public Services: Existing public services, except sanitary sewer, are adequate to
serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water management is practiced as
part of any development project.
Adjacent Properties: The proposed change from the current AG Agricultural district
to MHI Modified Heavy Industrial district should have limited impact on adjacent
properties. The abutting county property to the south is a mix of pasture and
contour cultivated farm land and the abutting lot to the east is a detention area that
accommodates runoff from the Seippel Court properties. The nearest residence is
approximately 375 feet north of the subject lot and is buffered from potential
industrial activity by vegetative screening and an intervening mini- storage facility.
The surrounding area is a mixture of agricultural, residential, commercial and
industrial land uses.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting to rezone the subject property from AG
Agricultural District to MHI Modified Heavy Industrial district. The parcel is
approximately six acres in size and is accessed from the western terminus of Seippel
Court. The property has approximately 72 feet of frontage along the cul-de-sac.
Seippel Court is approximately 660 feet long and adjoins Seippel Road, which is built to
collector street standards. Seippel Road has direct access to Old Highway Road and
eventually to U.S. Highway 20. The property slopes from its high point at the northeast
corner, falling gradually to the south toward the Brehm Farm.
The subject property was annexed in 2003 and, at that time, was rezoned from County
M-1 with conditions to CS Commercial Service and Wholesale district. The property
directly adjacent to the west of the subject property was rezoned from LI Light Industrial
to HI(c) Heavy Industrial with conditions. The subject lot shares approximately 370 feet
of adjacency with the newly rezoned Heavy Industrial property and 291 feet of
adjacency with existing LI property. The adjacent LI property must remain open space
if the Hlc property is developed as a salvage yard.

The MHI district has 51 permitted use. The AG district has a limited number of uses that �
include the raising of field crops and livestock, horticulture, aquaculture and non-
commercial greenhouses.

Staff recommends the Commission review the criteria established in Section 6-1 .1 of
the Zoning Ordinance regarding granting a rezoning.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY FROM AG AGRICULTURAL DISTRICT TO

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter described
property from AG Agricultural District to MHI Modified Heavy Industrial District, to wit:
Lot 9 Seippel Road Commercial Park, and to the centerline of the adjoining
public right-of-way, all in the city of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
by law.
