The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating that the OC District allows
residential dwellings on the first floor, but the existing C-4 District does not. Mr.
Damaso stated he has difficult in keeping the commercial spaces on the first floor
occupied with commercial tenants.
Staff reviewed the staff report, noting surrounding zoning and land use. Staff reviewed
that the existing C-4 District allows a wide range of uses and the requirement that the
first floor be used for commercial is designed to maintain the continuity of commercial
storefronts. The introduction of first floor residential can be negatively impacted by
typical commercial activity of traffic, noise and lighting.
There were no public comments.
The Zoning Advisory Commission discussed the request, and discussed recent
community efforts to address the Central Avenue corridor and felt the rezoning request
was premature.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
deny the request.

A simple majority vote is needed for the City Council to concur with the Commission's
recommendation to deny the request. A super majority vote is needed for the City

Property History: The property was subdivided circa 1890 as part of the original City
Lot subdivision. A three-story commercial structure with upper story residential use was
built on the lot in 1883. The building has continued to be used as a mixed-use structure
until the present.
Physical Characteristics: The subject property is a 10,000 square foot lot with 50 feet
of frontage along Central Avenue. The property is 200 feet deep with a relatively level
front half and a steep rear yard that rises approximately 50 feet in elevation to a platted
but unimproved City alley behind the residences on Shelby Street. The three-story brick
structure spans the entire width of the property frontage prohibiting exterior access to
the back yard from Central Avenue. As a result, there is no off-street parking on the
subject lot.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
infill and mixed-use commercial and residential development. The goals also
recommend buffering non-compatible uses from each other. The City's 2030 Future
Land Use Plan identifies this area as commercial.
Impact of Request on:
Utilities: The property is currently adequately being served by City water and
sanitary sewer. There is a fire hydrant across Central Avenue approximately 80
feet from the subject building.

Traffic Patterns/Counts: The lowa Department of Transportation daily average
traffic counts indicate more than 13,000 vehicle trips per day traveling south along
Central Avenue adjacent to the subject property. The City and IDOT have plans to
reroute Highway 52 and allow two-way traffic along Central Avenue. This should
reduce the amount of traffic along Central Avenue.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment as
there will be no change to the site, only the building interior.
Adjacent Properties: Converting the ground floor level of the building from
commercial use to residential use should have little impact on the adjacent
properties. However, permanent residents may compete for limited on-street
parking and conversion of a retail space may reduce the number and variety of
street-level businesses necessary to maintain a critical mass of retail activity.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting to rezone the subject property from C-4
Downtown Commercial district to OC Office Commercial district enabling him to convert
the ground floor of the subject building to residential use. The subject property is a
10,000 square foot lot with 50 feet of frontage along Central Avenue. The property is
200 feet deep with a relatively level front half and a steep rear yard that rises
approximately 50 feet in elevation to a platted but unimproved City alley behind the
residences on Shelby Street.
The building is a typical turn-of-the century three-story structure with a commercial store
front at the street level and residential use above. There is approximately 2,500 square
feet of floor area per story. Because the structure is built from side property line to side
property line, access to the back yard and the ability to provide off-street parking is not
possible. Although an additional residential unit should create little additional traffic or
demand on parking, residents, compared to shoppers, tend to consume available on
street parking more long-term.
The C-4 district prohibits residential use on the first floor. Converting the ground floor
level of the building from commercial use to residential use should have little impact on
the adjacent properties. However, conversion of the retail space may reduce the
number and variety of street-level businesses necessary to maintain a critical mass of
retail activity in the neighborhood
Staff recommends the Commission review the criteria established in Chapter 9 of the
Unified Development Code regarding granting a rezoning.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 1961 CENTRAL AVENUE FROM C-4
DOWNTOWN COMMERCIAL DISTRICT TO OC OFFICE COMMERCIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter—described property
from C-4 Downtown Commercial District to OC Office Commercial District, to wit:
Parcel ID# 1024252007, and to the centerline of the adjoining public right-of-way, all
in the City of Dubuque, lowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, lowa.
Section 3. This Ordinance shall take effect immediately upon publication as
provided by law.
