The final contract amount for the project was $37,308.07. City Engineer Gus Psihoyos recommends that the award and acceptance of the Alley — Harlan Street and Euclid Street Sanitary Sewer Reconstruction Project be officially recorded in the minutes of the City Council. BACKGROUND The City of Dubuque, lowa is under a Consent Decree according to Case 2:11-cv-01001-EJM, United States of America and the State of lowa v. the City of Dubuque, IA (N.D. lowa), Civil Action Number 2008V00041, DOJ Case Number 90-5-1-1-09339 effective June 27, 2011. The City is required to submit Corrective Action plans for each of the Sanitary Sewersheds identified in the Consent Decree. The FY2019 budget appropriated funds for sanitary sewer improvements in the alley between Harland and Euclid in Sewer Shed 10 per the Consent Decree Corrective Action Plan. DISCUSSION The existing sanitary sewer in the alley between Harlan Street and Euclid Streets was a 6" clay line with protruding laterals. The sub-standard line was replaced with an 8" PVC pipe and all laterals were re-connected to the main. This project also included one brick manhole replacement. BID RESULTS On March 21, 2019, informal bids for the Alley— Harlan Street and Euclid Street Sanitary Sewer Reconstruction Project were received in the amounts of: Contractor Name Bid Amount Temperley Excavating, Inc. $ 48,900.00 Drew Cook & Sons Excavating Company, Inc. $ 49,616.00 MDE, LLC DBA McDermott Excavating $ 59,132.50 Mainline Excavating Company, Inc. $63,180.50 Midwest Concrete, Inc. $65,798.75 Tschiggfrie Excavating Co. $66,650.00 Based on lowa Code § 384.103 and § 364.12(3)(c), and lowa Code, Section 26.14, through the informal bid process for public improvements, the low bid was received on March 21, 2019 by Temperley Excavating, Inc. of East Dubuque, IL in the amount of $48,900.00. The final contract amount for the project was $37,308.07. Gus Psihoyos, City �ngineer Filed ir� thP offic� nf th�; City Clerk an th� 25'��'_ d�y c�f June 2019. �__ evin Firnsfi�hl, MC, Cifiy Cl�rk RESOLUTION NO. -19 ACCEPTING THE ALLEY — HARLAN STREET AND EUCLID STREET SANITARY SEWER RECONSTRUCTION PROJECT AND AUTHORIZING THE FINAL PAYMENT TO THE CONTRACTOR WHEREAS, the public improvement contract for the Alley — Harlan Street and Euclid Street Sanitary Sewer Reconstruction Project (the Project) has been completed by the Contractor, Temperley Excavating, Inc. of East Dubuque, IL (Contractor), and the City Engineer has examined the work and signed a certificate stating that the Project has been completed according to the terms of the Public Improvement Contract and that the City Engineer recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $37,308.07; WHEREAS, the Contractor has previously been paid $35,442.67, leaving a balance of$1 ,865.40; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1 . The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Harlan Euclid Sanitary CIP appropriations for the contract amount of $37,308.07 less any retained percentage provided for therein as provided in lowa Code. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of$1 ,865.40 as provided in lowa Code chapter 573, and to pay such retainage in accordance with the provisions of lowa Code chapter 573 or lowa Code chapter 26.13.
