The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, noting he would like to plant a large garden and orchard and install a hoop house on the property. He said in the future, greenhouses may be installed. He said he does not intend to have any animals on the property. Staff reviewed the staff report, noting the lot size, surrounding zoning and lack of structures on the property. Staff noted that animal feed lots and animal confinement operations are not permitted in the agricultural district. There was one public comment with concerns of keeping of livestock on the property and potential impact to a private well. The Zoning Advisory Commission discussed the request, and considered placing a condition that would not allow livestock on the property. The Commission discussed the condition with the applicant. The applicant was amenable to the condition. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request with the condition that no livestock be allowed on the property. A simple majority vote is needed for the City Council to approve the request. Additionally, imagery from 1994 through 2016 shows open space or less intense crop cultivation occupying the space. Physical Characteristics: The property is approximately 3 acres in size and is primarily lightly wooded open space with a garden in the western half of the property. The property slopes approximately 6% or 26 feet from the front property line (along Peru Road) to the rear property line. No structures are present on the property. Concurrence with Comprehensive Plan: The Imagine Dubuque 2037 Comprehensive Plan goals encourages mixed-use development and infill development. Impact of Request on: Utilities: Existing utilities are in close proximity to the site. Sanitary sewer and water terminate just north of the Tanzanite Drive/Peru Road intersection approximately 120' from the subject property. Traffic Patterns/Counts: 2017 lowa Department of Transportation shows an Average Daily Traffic count of 2,030 along Peru Road. Few additional trips are expected to be generated by redevelopment of this property for agricultural purposes. i Rezoning Staff Report Page 2 Public Services: Existing public services are adequate to serve the property. Environment: Staff does not anticipate any adverse impact to the environment provided common erosion control techniques are used. Adjacent Properties: The adjacent residential property to the south is owned by the applicant and is buffered by vegetation. The other adjacent residential properties are across the Peru Road right of way about 90 feet away. Another residential property is across the lane to the north and is currently surrounded by agricultural zoning. The other adjacent properties to the east are zoned and used for agricultural. Therefore, the potential impacts from the proposed agricultural use should be mitigated by topography, distance, and similar present agricultural land use. CIP Investments: None proposed. Staff Analysis: The applicant is requesting to rezone the subject property from R-1 Single-Family Residential to AG Agricultural zoning district. The applicant proposes to plant an orchard and gardens. The property is approximately 3 acres in size and is primarily lightly wooded open space with a garden in the western half of the property. The property slopes approximately 6% or 26 feet from the front property line (along Peru Road) to the rear property line. No structures are present on the property. The adjacent residential property to the south is owned by the applicant and is buffered by vegetation. The other adjacent residential properties are across the Peru Road right-of-way approximately 90 feet away. Another residential property is across the lane to the north and is currently adjacent to agricultural zoning to the north, east, and south. The adjacent property to the east is zoned and used for agricultural purposes. Therefore, the potential impacts from the proposed agricultural use should be mitigated by topography, vegetation, distance, and similar adjacent agricultural land use. The noise, traffic, and activity generated by the proposed orchard and gardens should not be excessive. However, the AG zoning district allows a broad spectrum of agricultural use, some of which could have significant impacts on the surrounding residences. Additionally, animal confinement and feed lots are prohibited in an AG district. Also, retail use, other than that accessory to the principal use, is not permitted in the AG district. Staff recommends the Commission review the criteria established in section 6-1.1 of the Zoning Ordinance regarding granting a rezoning. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, is hereby amended by reclassifying the hereinafter—described property from R-1 Single -Family Residential District to AG Agricultural District, to wit: Lot 1 Youtzy Sub. Plat 2, and to the centerline of the adjoining public right-of- way, all in the City of Dubuque, Iowa. Section 2. That the foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. Buol, Mayor MEMORANDUM OF AGREEMENT Pursuant to the Iowa Code Section 414.5 (2017), and as an express condition of rezoning of the property located at 4304 Peru Road and legally described as: Lot 1 Youtzy Sub Plat 2, and to the center line of the adjoining public right-of-way, all in the City of Dubuque, Iowa. which is the subject of Ordinance No. 31-19, a copy of which is attached hereto and incorporated herein by reference, the undersigned property owner(s) agree(s) to the following conditions, all of which the property owner(s) further agree(s) are reasonable and are imposed to satisfy public needs which are caused directly by the rezoning: A) Conditions: 1) Livestock is not allowed. B) Reclassification of the Subject Property. The City of Dubuque, Iowa may initiate zoning reclassification proceedings to the R-1 Single -Family Residential District (which rezoning will include the removal of the performance standards in Section A above) if the property owner fails to complete any of the conditions or provisions of this Agreement. Modifications. Any modifications of this Agreement shall be considered a zoning reclassification and --shall-be -subject to the provisions of the Title 16, Unified Development Code, governing zoning reclassifications. All such modifications must be approved by the City Council of Dubuque, Iowa: Recording. A copy of this Agreement shall be recorded at the property owner's expense with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this rezoning approval within ten (10) days of the adoption of Ordinance No. 31-19.
