CITY OF DUBUQUE ZONING ADVISORY COMMISSION
REGULAR SESSION
6:00 p.m.
Tuesday, July 2, 2019
City Council Chamber, Historic Federal Building
Commissioners Present: Chairperson Tom Henschel; Commission Members Rich
Russell, Martha Christ, Laura Roussell, Steve Baumhover, and Michael Belmont; Staff
Members Travis Schrobilgen, John Maddock and Wally Wernimont.
Commissioners Excused: Pat Norton.
Commissioners Unexcused: None.
CALL TO ORDER: The meeting was called to order by Chairperson Henschel at 6:00 p.m.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the
meeting was being held in compliance with the lowa Open Meetings Law.
MINUTES: Motion by Roussell, seconded by Belmont, to approvethe minutesoftheJune
5, 2019Zoning AdvisoryCommission meeting assubmitted. Motion carried bythefollowing
vote: Aye— Baumhover, Belmont, Christ, Roussell, Russell, and Henschel; Nay— None.
PUBLIC HEARINGS
REZONING: Application of Thad Strub to rezone property from R-1 Single-Family
Residential zoning district to AG Agricultural zoning district.
Thad Strub, 2225 Southway, discussed the proposal to rezone. He noted the need to
change zoning in order to have a garden on the property. He also mentioned he would
be planting apple and pear trees as well as building a hoop house and potentially green
houses. He mentioned that he does not intend to have animals of any sort on his
property.
Nancy Heier, 4396 Peru Road, spoke in favor of the request but noted concerns with
livestock being present on the property in the future. She also had concerns about
what the applicanYs plan was to water the crops and whether it wnuld impact her well.
She did not think her property value would change since she is currently surrounded by
agricultural uses.

Staff Member Schrobilgen detailed the staff report noting the request, lot size,
surrounding zoning, and a lack of structures on the property. He also noted that city
water and sanitary sewer were in close proximity to the property. He pointed out that
animal feedlots and animal confinement operations are not permitted in the agricultural
zoning district.
Commissioner Belmont asked if a permit is required for a building. Staff Member
Schrobilgen noted that any structure over 200 sq. ft. requires a building permit. Staff
Member Wernimont noted that there are no size limitations or bulk standards for
structures and accessory structures in an AG district. He also noted City Agricultural
zoning is more restrictive than the County Agricultural zoning district.
Commissioner Baumhover asked the applicant if he would be ok with a condition of no
livestock at the property. The applicant was amenable to that condition. Staff Member
Wernimont clarified Commissioner Baumhover's request noting that a memorandum of
agreement would need to be written and signed by the applicant.
Commissioner Roussell expressed concern with the other agricultural districts in the
area that are without conditions and how that would affect the applicanYs property. Staff
Member Wernimont noted that to his knowledge, the surrounding properties do not
have livestock, but some may have fowl.
Commissioner Christ asked for clarification of the definition of livestock and whether
chickens would be included. Staff Member Wernimont stated that chickens are
considered livestock and would not be permitted if the condition were approved.
Motion by Baumhover, seconded by Russell, to approve the rezoning request with the
condition that livestock are not permitted. Motion carried by the following vote: Aye —
Baumhover, Belmont, Christ, Roussell, Russell, and Henschel; Nay — None.
PUD AMENDMENT: Application of John Gronen to amend the Historic Millwork District
Planned Unit Development to allow for the removal of the quonset hut located at 902
White Street and to install a surface parking lot at 902 & 990 White Street.
Chris Helle, Facilities Manager for Dupaco, represented the applicant and discussed
the proposal. He noted the quonset hut would be relocated and provided a conceptual
plan of the proposed parking area. He said the lot would be used by Dupaco with some
spaces being leased by residents of Linseed Lofts and businesses in the area.
Don Rusk, owner of Charlotte's Coffee House, 1104 White Street, spoke in support of
the proposal, noting that parking at the location would be very beneficial for the area.
Staff Member Wernimont presented the staff report. He said that the request is to
remove the quonset hut and Quick Lube building located at the site and that neither

was historically significant. He noted that the applicant would be required to submit a
site plan to meet all city rules and regulations. He also noted that the City Council
needs to review this project because it falls within the Historic Millwork District. In
conclusion, he noted that all property owners within the district and 200 feet around the
district were notified and there were no public comments submitted.
Chairperson Henchel asked if there were any issues with parking lot construction. Staff
Member Wernimont said the proposal is consistent with the Historic Millwork District
Plan and that it facilitates the infill and reuse of the district.
Motion by Norton, seconded by Baumhover, to approve the PUD Amendment request as
submitted. Motion carried by the following vote: Aye — Baumhover, Belmont, Norton,
Roussell, Russell, and Henschel; Nay — None.
