ORDINANCE NO. 68-79
An Ordinance of the City of Dubuque,
Iowa, providing that the Code of Ordi-
nances, City of Dubuque, Iowa, be
amended by repealing Section 30-36
thereof and enacting a new Section 30-
36 in lieu thereof; by repealing Subsec-
tion (a) of Section 30-37 thereof and
enacting a new Subsection (a) of Sec-
tion 30-37 In Ileu thereof; by amending
Section 30-39, by enacting new Subsec-
tions (c), (d) and (e); and by enacting
a new Section 30-43.
NOW THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That ,the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing Section 30-36
thereof and enacting a new Section 30-
36 in lieu thereof as follows:
Section 30-36. Appointment; composi-
tion; qualifications.
The City Council shall appoint a
Plumbing board consisting of five (5),
members, one of whom shall hold a
license as a journeyman plumber, of
at least five (5) years' experience,
two master plumbers who have been
engaged in the plumbing business as
master plumbers for at least five (5)
years in the City, one person who
holds a bachelor of science degree in
the area of physical sciences, and a
fifth member who shall be a represen-
tative of the public.
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing Subsection (a) of
Section 30-37 thereof and enacting a
new Subsection (a) of Section 30-37 In
lieu thereof as follows:
Section 30-37. Terms; filling of
vacancies
(a), Members of the plumbing board
apppolnted after November 6, 1979
shall serve for a period of three (3)
years, or until their successors are
duly appointed.
Section 3. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting new Subsections
(c), (d) and (e) to Section 30-39 as fol-
lows:
(c) Members of the plumping board
shall attend at least two-thirds (2/3)
of all regularly scheduled meetings
within any twelve (12) month period.
If any member does not attend such
prescribed number of meetings, it
shall constitute grounds for the board
to recommend to the Dubuque City
Council that said member be
replaced. Attendance of all members
shall be entered on the minutes by the
clerk of the plumbing board.
(d) All meetings shall be held In con-
formance with the provisions of the
Iowa Open Meetings Law.
(e) The plumbing board shall file
with the Dubuque City Council a copy
of the minutes of each regular and
special meeting of the board within
ten (10) working days after each such
meeting.
Section 4. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting a new Section 30-
43 as follows:
Section 30-43. Procedures
All administrative, personnel,
accounting, budgetary and procure-
ment policies of the City shall govern
the plumbing board in all of its oper-
ation.

ing for the creation and fixing
responsibilities of a Public Works
Director.
NOW THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of the city of Dubuque, Iowa be
amended by repealing Subsection (b) of
Section 2-169 thereof and enacting a
new Subsection (b) of Section 2-169 in
lieu thereof as follows:
"Section 2-169. Created; Responsibi-
lities Generally.
(b) Said office shall be charged with
the responsibility for construction
and operation of public works, and
shall have the responsibility for
directing the activities of several
divisions comprised in The Public
Works Department, including water
system, engineering, street mainte-
nance, sanitary and storm sewerage,
wastewater treatment, refuse collec-
tion and disposition, maintenance
garage, and public docks."

terms of the members of the Board,
providing for meetings of the Board
and providing for the procedures to
govern the actions of the Board:
NOW THEREFORE BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of The city of Dubuque, Iowa be
amended by repealing Section 13-106
thereof and enacting a new Section 13-
106 in lieu thereof as follows:
"Section 13-106. Terms
(a) The term of each member of the
board created by This division shall be
four (4) years; provided, however, that
the original appointments to the board
shall be made as follows: two (2) mem-
bers for three (3) years; three (3) mem-
bers for four (4) years.
(b) Ali appointments made after
November 19, 1979 shall be for a period
of three (3) years or until a successor
is duly appointed."
Section 2. That the Code of Ordi-
nances of the city of Dubuque, Iowa be
amended by enacting a new Section 13-
111 thereof as follows:
"Section 13-111. Meetings.

cal examiners shall attend at least two
thirds (2/3) of all regularly scheduled

Attendance of all members shall be
entered on the minutes by the secretary
to the board.
(c) All meetings shall be held in con-
formance with the provisions of the
Iowa Open Meetings Law.
(d) The board of electrical examiners
shall file with the Dubuque City Coun-
cil copies of the minutes of each regu-
lar and special meeting of the
commission within ten (10) working
days after each such meeting.
Section 3. That the Code of Ordi-
nances of the city of Dubuque, Iowa be
amended by enacting a new Section 13-
112 thereof as follows:
Section 13-112. Procedures.
All administrative, personnel,
accounting, budgetary and procure-
ment policies of the city shall govern
the electrical board of examiners in
all of its operations."

attendance of members at meetings
and providing for the filing of
minutes of meetings with the City
Council; and by enacting a new Sub-
section (12) of Section 191/2-5 thereof,
providing for the establishment of
procedures governing the actions of
said Historic Preservation Commis-
sion.
NOW THEREFORE BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting new Subsections
(e) and (f) of Section 191/2-4 thereof as
follows:
(f) of Section 13-46 thereof, providing
for the meetings of said board; and
by enacting a new Section 13-47
thereof, providing for procedures to
govern the actions of said board.
NOW THEREFORE BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing Section 13-44
thereof and by enacting a new Section
13-44 in lieu thereof as follows:
"Sec. 13-44. Terms of Office.
(a) The term of each member shall be
four (4) years; providing, however,
that the original appointments to the
board shall be made as follows: Two
(2) members shall be appointed to
serve for a period of three (3) years;
three (3) members shall be appointed
to serve for a period of four (4)
years.
(b) All appointments made after
November 19, 1979 shall be for a
period of Three (3) years or until
their successors are duly ap-
pointed."
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting new Subsections
(d), (e) and (f) to Section 13-46 thereof
as follows:

(a) of Section 36-182 thereof and by
enacting a new Subsection (a) of Sec-
tion 36-182 in lieu thereof; by enact-
ing new Subsections (e), CO and (g)
of Section 36-183 thereof; and by
enacting a new Section 36-186
thereto; providing for terms of mem-
bership in the Dubuque Cable TV
Commission.
NOW THEREFORE BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing Subsection (a) of
Section 36-182 thereof and by enacting a
new Subsection (a) of Section 36-182 in
lieu thereof as follows:
"Sec. 36-182.
(a) The commission shall have a
membership of nine (9) persons
appointed by the City Council for two
(2) year terms. Five (5) of the initial
appointments shall be for one (1) year
terms and the balance shall be for two
(2) year terms. Members of the
Dubuque Cable TV Commission
appointed after November 19, 1979
shall serve for a period of three (3)
years. Upon completion of their term
of office, members shall continue to
serve in their full capacity until a
successor has been duly appointed."
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting new Subsections
(e), (f) and (g) to Section 36-183 thereof
as follows:
"Sec. 36-183.

ORDAINED BY THE CITY COUNCIL

Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting a new Chapter
111/2 thereof establishing a Community
Development Commission to provide
as follows:
"CHAPTER 111/2
COMMUNITY DEVELOPMENT
COMMISSION
ARTICLE I. STATEMENT OF
INTENT
Sec. 111/2-1. General.
The City Council of the City of
Dubuque wishes to assure that a fair
cross section of the residents of the
City of Dubuque fully participate in
the continuous process of budgeting,
developing, monitoring and evaluat-
ing the community development
block grant program.
ARTICLE II. COMMUNITY
DEVELOPMENT COMMISSION
Sec. 111/2-2. Created.
There is hereby created a Community
Development Commission to have
such powers and responsibilities to
the extent of authority granted by the
City Council of the City of Dubuque.
Sec. 11Vz-3. Purpose and Charge.
(a) The Community Development
Commission is charged with the
development of the community devel-
opment program based on identifi-
able community development needs
and objectives through the involve-
ment of residents likely To be effected
by community development and hous-
ing activities, the private sector, and
local government for submission to
the City Council for their considera-
tion.
(b) The neighborhood organization
in the community development orga-
nizational structure is the basic
grassroots structure for analyzing
problems, recommending objectives
and suggesting program strategy. The
community development commission
will rely heavily on the neighborhood
organization input when developing
and evaluating the total community
development program.
Section 111/2-4. Membership.
(a) The community development
commission shall have a member-
ship of nine (9) persons as described
hereinafter who shall be appointed by
the City Council of the city of
Dubuque for a period of three (3)
years. Three (3) of the initial
appointments shall be for a one (1)
year term, three (3) of such appoint-
ments shall be for a term of two (2)
years, and the balance of such
appointments shall be for a term of
three (3) years. The two (2) members
representing the housing commis-
sion and the rehabilitation commis-
sion shall be nominated for
appointment to the community devel-
opment commission by Their respec-
tive commissions, and they shall
serve as members of the community
development commission for terms
coinciding with the terms set forth
by their respective commissions.
Upon completion of their term of
office, members shall continue to
serve in their full capacity until a
successor has been duly appointed.
The City Council shall solicit recom-
mendations from representative
organizations, agencies and the pub-
lic before making such appoint-
ments.
(b) Membership of the community
development commission shall be
limited to residents of the city of
Dubuque.
(c) A vacancy caused by resignation
or other reasons on the community
development commission shall be
filled by the City Council of the city
of Dubuque within thirty (30) days
for the unexpired term of the office.
(d) Members of the community devel-
opment commission shall attend at
least seventy five (75) percent of all
regularly scheduled and held meet-
ings within any twelve (12) month
period. If any member does not attend
such prescribed number of meetings,
it shall constitute grounds after hear-
ing by the community development
commission for the community
development commission to recom-
mend to the City Council that said
member be replaced. Attendance of
all members shall be entered on the
minutes.
(e) No member of the community
development commission may be an
employee of the city.
(f) No more than one representative
from the same board or commission
of the city of Dubuque may be a mem-
ber of the community development
commission at any one time.
(g) All members of the community
development commission shall serve
without compensation except for
reimbursement of authorized out of
town travel expenses incurred in the
discharge of their duties.
(h) The membership of the Commu-
nity Development Commission shall
at all times include the following rep-
resentation:
1. Four (4) representatives from
target areas, but not more than one
(1) from any organized area.
2. Three (3) at large members.
3. One (1) Housing Commission
member.
4. One (1) Rehabilitation Commis-
sion member.
5. At least two (2) members listed
above from low and moderate
(b) The director of the Department
of Community Development shall
have general supervision of the
administration and affairs of the
Community Development Commis-
sion, subject to the direction of the
commission. The department shall
maintain the records of the commis-
sion and shall be charged with the
overall management, administration
and operation of all community
development programs.
(c) The Community Development
Commission acknowledges that sole
responsibility and authority to make
final determinations for the carrying
out of any community development
activity or program rests with the
Dubuque City Council, and the City
Council does not require the concur-
rence of any person or group of per-
sons to make such a determination.
Sec. 111/2.6. Procedure.
All administrative, personnel,
accounting, budgetary and procure-
ment policies of the City shall govern
the Community Development Com-
mission in all of its operations."
Section 2. That Resolution No. 280-75,
Resolution No. 77-76 and Resolution
351-76 and Resolution No. 411-78 be and
the same are hereby repealed and of no
further force or effect.

Section 11'/2-3. Organization.
(a) Community development com-
mission may adopt rules, bylaws and
regulations governing its organiza-
tional procedures as may be deemed
necessary and which are not in con-
flict with this document or any other
resolutions and ordinances of the city
of Dubuque.
(b) All programs, projects and ser-
vices to be formed by members of the
community development commis-
sion, either singularly or as a com-
mission, must conform to the
policies of the city of Dubuque and to
applicable local, state and federal
laws, rules and regulations.
(c) Nothing in this organizational
structure prohibits or prevents any
person, or group of persons, to for-
mally or informally petition the
Dubuque Clty Council or the city
administration regarding the com-
munity development program.
Section 111/2.4. Meetings.
(a) The community development
commission shall hold an organiza-
tional meeting on a date selected by
the mayor of the city of Dubuque and
a reorganizatlonal meeting annually
thereafter.
(b) The Secretary of the community
development commission shall file
with the Clty Council, rehabilitation
commission and housing commis-
sion a copy of the minutes of each
regular and special meeting of the
commission within ten (1) working
days offer each such meeting.
(c) All meetings shall be held in con-
formance with the provisions of the
Iowa Open Meetings Law.
Sec. 111/2-5. -5. Staff.
(a) The community development spe-
cialist for the Clty of Dubuque shall
act as secretary of the regular and
special meetings of the Community
Development Commission and shall
record all votes, keep a record of all
proceedings of the commission and
perform such other duties incident to
the office of secretary.

Section 2. That the Code of Ordi-

Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by. repealing Section 26-131
thereof and enacting a new Section 26-
131 In lieu thereof as follows:
"Section 26-131. Created.
There is hereby created a division of
the City to be known as the Division
of Public Docks."
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing Subsection (a) of
Section 26-132 thereof and enacting a
new Subsection (a) of Section 26-132 In
lieu thereof as follows:
"Section 26-132. Dock Board.
(a) Composition. The Division of
Public Docks shall be administered
by the Dock Board consisting of three
(3) members to be known as Commis-
sioners of Public Docks."
Section 3. That the Code of Ordi-
nances of the City of Dubuque, be
amended by repealing Paragraph (8) of
Subsection (h) of Section 2 6-1 32
thereof.
Section 4. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting a new Section 26-
133 thereto as follows:
"Section 26-133. Office of Dock Man-
ager.
The office of Dock Manager is hereby
created who shall be appointed by and
serve at the pleasure of the City Man-
ager. The Dock Board shall serve as a
personnel advisory committee to the
City Manager in the selection of such
a manager."
Section 5. That the Code of Ordi-
nances of the city of Dubuque, Iowa be
amended by enacting a new Section 26-
134 Thereto as follows.
"Section 26-134. Meetings.
(a) Members of the Dock Board shall
attend at least two thirds (2/3) of all
regularly scheduled meetings within
any twelve (12) month period. If any
member does not attend such pre-
scribed number of meetings, it shall
constitute grounds for the board to
recommend to the Dubuque City
Sec. 20-180. General.
The City of Dubuque hereby elects to
have its powers as defined in Chapter
403A of the 1979 Code of Iowa exercised
by the City Council of the City of
Dubuque.
Sec. 20-181. Created.
There is hereby created a Housing
Commission to have such powers and
responsibilities to the extent of the
authority granted by the City Council of
the City of Dubuque.
Sec. 20 -182. -Purpose.
(a) The Housing Commission shall
undertake and carry out studies and
analyses of the housing needs and the
meeting of such needs, and to make the
results of such studies and analyses
available to the public, as well as to
recommend proposed projects in the
area of low and moderate housing for
the citizens of the City of Dubuque.
(b) Any proposed low rent housing
project shall be sublect to specific
approval by the City Council and any
proiect requiring a referendum as pro-
vided in Chapter 403A of the 1979 Code
of Iowa shall be submitted to the voters
of the City of Dubuque in accordance
with such chapter.
Sec. 20-183. Membership
(a) The Housing Commission shall
be comprised of a membership of seven
(7) persons who shall be appointed by
the Dubuque City Council for terms of
two (2) years. Two (2) of the initial
appointments shall be for terms of one
(1) year. Three (3) of the initial
appointments shall be for a term of two
(2) years.
(b) All appointments offer November
19, 1979 shall be for a period of three (3)
years or until their successors are duly
appointed.
(c) A vacancy caused by death, res-
ignation or otherwise on the commis-
sion shall be promptly filled by the
Dubuque City Council for the unexpired
term of office.
Sec. 20-184. Meetings.
(a) The Housing Commission shall
hold at least one (1) official meeting
per month.
(b) Members of the commission shall
attend at least two-thirds (2/3) of all
regularly scheduled and held meetings
within any twelve (12) month period.
If any member does not attend such a
prescribed number of meetings, it shall
constitute grounds for the commission
to recommend to the Dubuque City
Council that said member be replaced.
The attendance of all members shall be
entered upon the minutes of all meet-
ings.
(c) All meetings shall be held in con-
formance with the provisions of the
Iowa Open Meetings Law.
(d) The Housing Commission shall
file with the Dubuque City Council a
copy of the minutes of each regular and
special meeting of the commission
within ten (10) working days after each
such meeting.
Sec. 20-175. Compensation.
All members of the commission shall
serve without compensation except for
reimbursement of necessary expenses.
Sec. 20-186. Internal Organization.
The commission may adopt rules and
regulations to govern its organiza-
tional procedures as they may deem
necessary and which are not In conflict
with this document or other resolutions
and/or decisions of the City.
Sec. 20-187. Supervisor.
The supervisor of the housing pro-
gram shall be appointed by and serve at
the pleasure of the City Manager. The
Housing Commission shall serve as a
personnel advisory committee to the
City Manager in the selection of such o
supervisor.
Sec. 20-188. Procedures.
All administrative personnel,
accounting, budgetary and procurement
policies of the City shall govern the
commission in all of its operations."
Section 2. That Resolution No. 244-70,
Resolution No. 36-71 and Resolution
No. 13-76 be and the same are hereby
repealed and of no further force and
effect.

(a) There shall be elected, as herein-
after provided, three (3) Park Com-
missioners who shall constituteand
be known as the Park Board of the
City of Dubuque, Iowa, who shall
have the jurisdiction, powers, duties
as set forth in Section 27-34 hereof.
(b) One (1) of such Commissioners
shall be elected at each regular bian-
nual municipal election in the City
and the term of office of such com-
missioner shall be six (6) years.
(c) Each Commissioner shall be paid
an annual salary of 51,000.00.
(d) Each commissioner shall give
bond in the sum of 51,000.00, and the
cost of said bond shall be paid out of
the appropriate city account.
(e) Within ten (10) days after the
election of any commissioner, the
newly elected commissioner shall
qualify by taking the oath of office
and furnish the bond in the amount as
hereinbefore provided.
(f) The Commissioners shall orga-
nize annually as a board by the elec-
tion of one (1) of their members as
chairperson and another member as
secretary.
(g) Vacancies on the Park Board
between elections shall be filled by
the City Council for the unexpired
term of such vacancy.
Section 27-81. Meetings.
(a) The Park Board shall meet not
less than monthly.
(b) Members of the Park Board shall

cle IX to Chapter 20 thereof to pro-
vide for the establishment ofa
Rehabilitation Commission, provid-
ing for the membership and the orga-
nization thereof, providing for the
holding of meetings thereof and
defining the duties of the Director of
the Department of Community Devel-
opment and providing for the proce-
dures to be followed by the
Rehabilitation Commission in its
operations.
NOW THEREFORE BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by enacting a new Article IX
to Chapter 20 thereof as follows:
"ARTICLE IX. REHABILITATION
COMMISSION.
Sec. 20-200. Purpose and charge.
(a) The purpose of the Rehabilitation
Commission of the City of Dubuque
is to perform and provide certain
services in the field of community
development as It relates to the con-
servation, preservation and rehabili-
tation of the housing stock of the City
of Dubuque.
(b) The Rehabilitation Commission
is charged with the development and
operation of residential rehabilita-
tion and home improvement lending
programs throughout the City of
Dubuque through the involvement of
neighborhood residents, the private
sector and local government.
Sec. 20-201. Membership.
(a) The Rehabilitation Commission
shall have a membership of not less
than thirteen (13) persons, and they
shall be appointed by the City Council
of the City of Dubuque for terms of
three (3) years. Six (6) of the initial
appointments shall be for a one- (1)
year term, six (6) of such, appoint-
ments shall be for a term of two (2)
years, and the balance of appoint-
ments shall be for a term of three (3)
years. Upon completion of their term
of office, members shall continue to
serve in their full capacity until a
successor has been duly appointed
and qualified as provided herein.
(b) Membership on the Rehabilita-
tion Commission shall be limited to
residents of or to persons who are
employed in the City of Dubuque.
(e) Membership on the Rehabilita-
tion Commission shall at all times to
the extent practicable, include the
following representation:
1. A real estate broker engaged in
residential real estate;
.2. A general contractor engaged in
the production of residential struc-
tures;
3. A remodeling contractor engaged
primarily in the rehabilitation,
repair and/or renovation of residen-
tial structures;
4. A building materials supplier;
5. A representative of a building
trades labor organization;
6. An architect or an engineer;
7. A representative of the Dubuque
housing commission;
8. A representative from each of two
(2) separately identifiable neigh-
borhood organizations;
9. Citizens at large selected as
closely as possible from each of the
four quandrants of the city of
Dubuque.
(d) A vacancy caused by resignation
or otherwise on the rehabilitation
commission shall be promptly filled
by the City Council for the unexpired
term of office.
(e) Members of the rehabilitation
commission shall attend at least two
thirds (2/3) of all regularly scheduled
and held meetings within any twelve
(12) month period. If any member
does not attend the prescribed num-
ber of meetings, it shall constitute
grounds after hearing by the rehabili-
tation commission, for the said com-
mission to recommend to the City
Council that said member be
replaced. Attendance of all members
shall be entered on the minutes.
(f) No member of the rehabilitation
commission may be an employee of
the city of Dubuque.
SectiOn 20-202. Compensation.
All members of the rehabilitation
commission shall serve without com-
pensation, except for reimbursement
of necessary expenses, including
travel expenses incurred in the dis-
charge of their duties.
Section 20-203. Organization.
(a) The rehabilitation commission
shall maintain the following standing
committees, each of which shall be
responsible for, but not limited to,
the areas hereinafter described.
1. Financial and counseling com-
mittee.
Development of local and other
resources to finance rehabilitation
loans and grants through the use of
community development block
funds; general and other forms of
revenue sharing; private, public
and nonprofit foundations; Iowa
housing and finance authority; and
other public and private sources.
Development of a special revolving
fund for persons considered to be
high risk borrowers.
Development of a management sys-
tem to assure the maximum and
efficient use of funds.
Development of the terms and con-
ditions under which loans and
grants are to be made, including but
not limited to, determination of
income and asset limitations, peri-
ods of repayment, interest subsidies
and eligible costs.
Review board for the approval or
disapproval of applicants for reha-
bilitation loans and grants.
Development of special counseling
services for persons who are consid-
ered high risk borrowers.
2. Public information committee.
Development of a public informa-
tional brochure to interpret the
rehabilitation program to secure
the support of the total community
including, but not limited to, neigh-
borhood meetings, public media
presentations, maintenance of a
speakers bureau and the issuance of
timely news releases.
Development of community
improvement bulletins and other
means to secure participation by
homeowners in the rehabilitation
program.
3. Rehabilitation standards and
technique committee.
Development of property rehabilita-
tion standards which are consistent •
with residential qualities, physical
characteristics and other evidences
of vitality to assure that rehabilita-
tion activities will restore neigh-
borhoods to a long term sound
condition.
Review of neighborhood plans to
ascertain that blighting and
deteriorating influences which
adversely affect housing conditions
are identified and appropriately
addressed.
Development of techniques in the
use of new materials to accomplish
rehabilitation at the least cost.
Development of "sweat equity" pro-
grams.
Development of a continuing pro-
gram to maintain rehabilitated
individual properties.
(b) Each of the standing committees
shall be composed of not less than
four (4) members to be appointed by
the chairperson of the rehabilita-
tion commission from the member-
ship of the commission. The
chairperson of each standing com-
mittee shall be named by the chair-
person of the commission.
(c) There shall be an executive
committee composed of the officers
and the chairpersons of the standing
committees to develop general pro-
gram guides and coordination
among the standing committees.
(d) Each standing committee may
appoint task forces as necessary for
the purpose of carrying out one time
specific specialized assignments of
short durations. The chairpersons of
such a task force shall be a member
of that standing committee.
Appointments to such task force are
not limited to members of the reha-
bilitation commission but- remain
from the community at large.
(e) The rehabilitation commission
may adopt rules, bylaws and regula-
tions governing its., organization
and procedures as be deemed neces-
sary which are not in conflict with
this document or any other resolu-
tions or ordinances of the city of
Dubuque.
(1) All programs, projects and ser-
vices to be performed by members
of the rehabilitation commission,
either singularly or as a commis-
sion, must conform to the policies
of the city of Dubuque and to all
local, state and federal laws, rules..
and regulations.
Section 20-204. Meetings.
(a) The rehabilitation commission
shall hold an organizational meet-
ing on a date selected by the mayor
of the city of Dubuque, Iowa and a
reorganizational meeting annually
thereafter.
(b) The rehabilitation commission
shall meet not less than monthly on a
regular basis.
(c) Each standing committee shall
be appointed not more than fourteen
(14) days after the organization
and/or reorganization. of the reha-
bilitation commission. Each stand-
ing committee shall meet not less
than monthly on a regular basis.
(d) The rehabilitation commission
shall file with the City Council a
copy of the minutes of each regular
and special meeting of the commis-
sion within ten (10) working days
after each such meeting.
(e) The Rehabilitation Commission
shall also file with the City Council
from time to time, but not less than
quo terly, a narrative rNport of
their activities including financiai
and statistical data which may be
necessary for the City Council to
understand all undertakings of the
commission.
(f) All meetings shall be held in
conformance with the provisions of
the Iowa Open Meetings Law.
Sec. 20-205. Staff.
(a) The Rehabilitation supervisor
of the Department of Community
Development for the City of
Dubuque shall act as secretary to the
commission.
(b) The director of the Department
of Community Development shall
have general supervision of the
administration and affairs of the
Rehabilitation Commission subject
to the direction of the commission.
The director shall maintain the rec-
ords of the commission and shall be
charged with the overall manage-
ment, administration and operation
of all rehabilitation programs.
Sec. 20-206. Procedure.
All administrative, personnel,
accounting, budgetary and procure-
ment policies of the City shall gov-
ern the Rehabilitation Commission
in all of its operations."
Section 2. That Resolution No. 280-75,
Resolution No. 77-76 and Resolution
No. 351-76 be and the same are hereby
repealed and of no further force and
effect.

thereof, providing for the fixing of
the powers and duties of the Board of
Trustees of the Transit Authority; by
repealing Section 36-80 thereof and
enacting a new Section 36-80 in lieu
thereof, requiring the approval of
contracts and agreements by the City
Council; by repealing Section 36-81
thereof and enacting a new Section
36-81 in lieu thereof, providing for
the manner of conduct of meeting of
the Board of Trustees of the Transit
Authority; and enacting a new Sec-
tion 36-82 thereof, providing for the
procedures governing the action of
the Transit Board of Trustees in Its
operations.
NOW THEREFORE BE• IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ordinances
of the City of Dubuque, Iowa be
amended by repealing Section 36-74
thereof and by enacting a new Section
36-74 in lieu thereof as follows:
"Sec. 36-74. Organization, election of
officers; adoption of rules, terms.
(a) The Board of Trustees of the
Transit Authority shall organize for
its transaction of business, elect
from its own number a chairperson
and a secretary who shall serve for
such terms as the board snail deter-
mine, not exceeding their terms of
office as members to the board, and
abide by all rules and regulations that
govern the proceedings of the board.
Members of the board shall hold
office for four -(4) years or until their
respective successors have been
appointed and have qualified.
,(b) All appointments made after
November 19, 1979 shall be for a
period of three (3) years."
Section 2. That the Code of Ordinances
of the City of Dubuque, Iowa be
amended by repealing Subsection (3) of
Section 36-78 thereof and enacting anew
Subsection (3) of Section 36-78 in lieu
thereof as follows:
"Sec. 36-78. Powers, duties of board.
(3) The office of transit manager is
hereby created, who shall be
appointed by and serve at the plea-
sure of the City Manager. The trust-
ees of the Transit Authority shall
serve as the personnel advisory com-
mittee to the City Manager in the
selection of a transit manager."
Section 3. That the Code of Ordinances
of the City of Dubuque, Iowa be
amended by repealing Section 36-80
thereof and by enacting a new Section
36-80 in lieu thereof as follows:
-"Sec. 36-80. Contracts and agree-
ments.
Contracts, grant applications and
agreements entered into wherein the
City Transit Authority is a party
shall be subject to review and
approval by the City Council."
Section 4. That the Code of Ordinance
of the City of Dubuque, Iowa b<
amended by repealing Section 36-81
thereof and by enacting a new Section
36-81 in lieu thereof as follows:
"Sec. 36-81. Meetings.
(a) The Transit Authority shall hold
at least one (1) official meeting per
month which shall be held in the City
Council chambers at the City Hall. A
designated monthy meeting day shall
be the second (2nd) Thursday of each
month.
(b) Members of the board of trustees
of the Transit Authority shall attend
at least two-thirds (2/3) of all regu-
larly scheduled meetings within any
twelve (12) month period. If any
members does not attend such pre-
scribed number of meetings, it shall
constitute grounds for the board to
recommend to the Dubuque City
Council that said member be
replaced. Attendance of all members
shall be entered on the minutes.
(c) Ail meetings shall he held in con-
formance with the provisions of the
Iowa Open Meetings Law.
(d) The board of trustees of the Tran-
sit Authority shall file with the
Dubuque City Council a copy of the
minutes of each regular and special
meeting of the board within ten (10)
working days after each such meet-
ing."
Section 5. That the Code of Ordinances
of the City of Dubuque, lowa be
amended by enacting a new Section 36-
82 thereof as follows:
"Sec. 36-82. Procedures.
All administrative, personnel,
accounting, budgetary and procure-
ment policies of the City shall govern
the Transit Board of Trustees in all of
its operations."
