City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 2019 Asphalt Overlay Access Ramp Project One, as completed by Drew Cook &
Sons Excavating Co. Inc., in the final contract amount of $141,684.93, which is a
26.65% increase from the contact amount of $111,875.00. A large quantity of curb was
included in this contract. The 180 linear feet of curb was in very poor condition and
needed to be replaced. The concrete base under the asphalt pavement on Forest Lane
was another unexpected expense which was a result of the poor roadway condition that
was encountered.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclos�c! resc�lutic�n provic�es for th� a�ce�tance o# the canstruction contrac# and
establishment of the Final Schedule of Assessments for the 2019 Asphalt Overlay
Access Ramp Project One.
BACKGROUND
The project replaced thirty non-compliant access ramps with thirty-five compliant,
directional ramps as per Public Right of Way Accessibiiities Guidciii��s (PROvJA�j
specifications in conjunction with the Public Works Asphalt Overlay Program involving
the following intersections:
• Forest Lane & Delhi Street, one single ramp.
• Forest Lane & Glen Oak, two single and two double ramps.
• Forest Lane alley between Glen Oak & N. Booth, two single ramps.
• Forest Lane � N. �ooth Street, two single and twQ dol�ble ram�s.
• Forest Lane & Nevada Street, two single ramps.
• Needham Place & 7t" Street, two single ramps.
• Needham Place & Prospect Street, two single ramps.
• Needham Place & 5�h Street, two single r�mps.
• Winona Street at alley south of W. 5t" Street, two single ramps.
• Winona Street at alley north of W. 3�d Street, four single ramps.
• Winona Street & W 3�d Street, two single ramps.
• Melrose Terrace & Paulina Street, two single ramps.
• Melrose Terrace & Alpine Street, two single ramps.
DISCUSSION
The 2019 Asphalt Overlay Access Ramp Project One was completed by Drew Cook &
Sons Excavating Co. Inc. of Dubuque, IA in the final contract amount of $141,684.93.
This is a 26.65% increase over the contract amount of $111,875.00. A large quantity of
curb was included in this contract. The 180 linear feet of curb was in very poor condition
and needed to be replaced. The concrete base under the asphalt pavement on Forest
Lane was another unexpectea expense wnich was a resuii oT tne pr�nr roadway
condition that was encountered.
SPECIAL ASSESSMENTS
Two of the properties on Needham Place had severely deteriorated sidewalk that
needed to be replaced. When City staff reviewed the pedestrian ramps to be replaced,
these sidewalks were inspected and marked up. City staff worked with the abutting
property owners and they agreed to a voluntary assessment to replace their sidewalks.
City staff shared the financial assistance availability with the property owners. Both
property owners qualified for financial assistance based on HUD guidelines. The total
assessment for the sidewalk replacement was $1,433.80. After applying the financial
assistance, the assessment to the property owners totaled $180.72.

REQUESTED ACTION
The City Council is requested to adopt the attached resolutions accepting the
improvements and to authorize the final payment of the contract amount of $141,684.93
to Drew Cook & Sons Excavating Co. Inc. for the 2019 Asphalt Overlay Access Ramp
Project One.

RESOLUTION NO. 288-19
ACCEPTING THE 2019 ASPHALT OVERLAY ACCESS RAMP PROJECT ONE AND
AUTHORIZING THE FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the 2019 Asphalt Overlay Access
Ramp Project One, (the Project) has been completed by the Contractor, Drew Cook &
Sons Excavating Co. Inc. (Contractor), and the City Engineer has examined the work
and signed a certificate stating that the Project has been completed according to the
terms of the Public Improvement Contract and that the City Engineer recommends that
the Project be accepted; and
WHEREAS, the final contract amount for the Project is $141,684.93;
WHEREAS, the Contractor has previously been paid $134,600.68, leaving a balance
of $7,084.25; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Curb Ramp Program CIP appropriations for the contract amount of $141,684.93 Tess
any retained percentage provided for therein as provided in Iowa Code.
Section 3. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $7,084.25 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter, 573 or Iowa
Code chapter 26.13.

Project has been performed in compliance with the terms of the Public Improvement
Contract, and that the total cost of the completed work is $162,9:37.67.
