City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 2019 Asphalt Overlay Access Ramp Project Three, as completed by Midwest
Concrete, Inc., in the final contract amount of $132,154.55, which is a 20.02% increase
over the original contract amount of $110,110.00. The increase in costs is due to the
addition of repaving the intersection at Pasadena Drive and Foothill Drive because the
pavement was undermined in this area due to a problem with the storm sewer intake in
the cross-walk area and very poor pavement conditions at the intersection.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
2019 Asphalt Overlay Access Ramp Project Three.
BACKGROUND
The project replaced twenty-eight non-compliant access ramps with forty-two compliant,
directional ramps as per Public Right of Way Accessibilities Guidelines (PROWAG)
specifications in conjunction with the Public Works Asphalt Overlay Program involving
the following intersections:
• Southern Ave & Oeth Court, two single ramps.
• Southern Ave & South Grandview, two singles and two double ramps.
• Pasadena Drive & Hillcrest Road (North), two single ramps.
• Pasadena Drive & Hillcrest Road (South), four double ramps.
• Pasadena Drive & Foothill Road, four double ramps.
• Pinard Street & 26t" Street, two single ramps.
• Pinard Street & 27th Street, two single and two double ramps.
• F�inard StrPPt & 28t�� Strest, two singlP and tw� �dou�le ramps.
• Pinard Street & 29t" Street, two single ramps.
DISCUSSION
The 2019 Asphalt Overlay Access Ramp Project Three was completed by Midwest
Concrete, Inc. of Peosta, IA in the final contract amount of$132,154.55. This is a
20.02% increase over the original contract amount of$110,110.00. The increase in
contract costs is due to the addition of repaving the intersection at Pasadena Drive and
Foothill Road. The pavement was undermined in this area due to a problem with the
storm sewer intake in the cross-walk area and very poor pavement conditions at the
intersection. New castings were installed and 7" PCC pavement was poured. An
additional 120 lineal feet of deteriorated curb was replaced at three other locations.

REQUESTED ACTION
The City Council is requested to adopt the attached resolution accepting the
improvements and to authorize the final payment of the contract amount of$132,154.55
to Midwest Concrete, Inc. for the 2019 Asphalt Overlay Access Ramp Project Three.

RESOLUTION NO. 290-19
ACCEPTING THE 2019 ASPHALT OVERLAY ACCESS RAMP PROJECT THREE
AND AUTHORIZING THE FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the 2019 Asphalt Overlay Access
Ramp Project Three, (the Project) has been completed by the Contractor, Midwest
Concrete, Inc. (Contractor), and the City Engineer has examined the work and signed a
certificate stating that the Project has been completed according to the terms of the
Public Improvement Contract and that the City Engineer recommends that the Project
be accepted; and
WHEREAS, the final contract amount for the Project is $132,154.55; and
WHEREAS, the Contractor has previously been paid $125,546.82, leaving a balance
of $6,60T73; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Curb Ramp Program CIP appropriations for the contract amount of $132,154.55 Tess
any retained percentage provided for therein as provided in Iowa Code.
Section 3. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $6,607.73 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
