Maintenance of the detention facility will become the responsibility of the of the City, with the costs for same being assessed to the property owners within Pebble Cove Subdivision Phase 1. Van Milligen, City Manager �. _- _ �� � FROM: Gus Psiho os Cit En ineer ���---`--�� Y , Y J _....,✓ DATE: August 5, 2019 SUBJECT: Acceptance of Storm Water Detention Facility Improvements in Pebble Cove Subdivision — Phase 1 INTRODUCTION The enclosed material provides for City Council acceptance of the public storm water detention facility improvements that the developers, Kivlahan Farms L.C., have recently completed in Pebble Cove Subdivision Phase 1. BACKGROUND , Pebble Cove Subdivision includes two phases of residential lots off of David Drive. As a condition of subdivision plat approval through Resolution No. 171-08, the developer of Pebble Cove Subdivision Phase 1 was required to install certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and storm water detention facilities and to dedicate said improvements to the City upon completion. In 2016, all public improvements were completed by the developer and accepted by the City except for the storm water detention facility. DISCUSSION Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On August 5, 2019, the owners requested City's acceptance of the storm water detention basin improvements in Pebble Cove Subdivision Phase 1. As a condition of subdivision plat approval through Resolution No. 171-08, the developer of Pebble Cove Subdivision Phase 1 was required to own and maintain the storm water detention facility until all of the following were complied with: 1. The detention basin has been fully completed. 2. 80�/0 of the platte� subdivision lots have been developed. 3. Adequate erosion control measures, as approved by the City, have been installed on the remaining 20% of the lots. Upon review and inspection by the City, it has been determined that the above described conditions from Resolution No. 171-08 have been met and that the public improvements required by Resolution No. 171-08, have been completed in accordance with plans approved by the City Council and in conformance with City specifications. Maintenance of the detention facility would become the responsibility of the City with the costs for same being assessed to the property owners within Pebble Cove Subdivision Phase 1. RECOMMENDATION I would, therefore, recommend that the City Council accept the public storm water detention facility improvements as described above. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public storm water detention facility improvement� in Pebble Cove Subdivision Phase 1. Dean Mattoon, Engineering Assistant RESOLUTION NO. 293-19 ACCEPTING PUBLIC STORM WATER DETENTION FACILITY IMPROVEMENTS IN PEBBLE COVE SUBDIVISION (PHASE 1), IN THE CITY OF DUBUQUE, IOWA Whereas, pursuant to Resolution 171-08, certain public storm water detention facility improvements were installed by the developer of Pebble Cove Subdivision (Phase 1) in the City of Dubuque, Iowa; and Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public storm water detention facility improvements in Pebble Cove Subdivision (Phase 1) be and the same is hereby accepted.
