City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Deborah and Jeffrey Drive Drain Tile Project, as completed by Top Grade
Excavating, Inc., in the final contract amount of $44,407.74, which is a 14.8% decrease
from the original contract amount of $50,967.21. The cost of the project was less than
anticipated because the contractor was able to limit the size of the excavation required
to install the storm sewer and drain tile.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract for the
Deborah & Jeffrey Drive Drain Tile Project.
The Deborah & Jeffrey Drive Drain Tile Project involved the extension of approximately
425 feet of storm sewer, the installation of approximately 610 feet of drain tile and three
storm sewer intakes in the Deborah and Jeffrey Drive corridor.
The project was awarded based on a competitive quotation process for public
improvements in accordance with Iowa Code, Section 26.14.
The 2009 Intake Reconstruction Project was completed by Top Grade Excavating, Inc.
of Epworth, Iowa, in the final contract amount of $44,407.74, which is a 14.8% decrease
from the original contract amount of $50,967.21. The cost of the project was less than
anticipated because the contractor was able to limit the size of the excavation required
to install the storm sewer and drain tile.
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $44,407.74 to Top Grade Excavating, Inc. for the Deborah &
Jeffrey Drive Drain Tile Project.

ACCEPTING THE DEBORAH & JEFFREY DRIVE DRAIN TILE PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Deborah & Jeffrey Drive Drain
Tile Project (the Project) has been completed and the City Engineer has examined the
work and filed a certificate stating that the Project has been completed according to the
terms of the Public Improvement Contract and that the City Engineer recommends that
the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Drain Tile Program appropriation for the contract amount of $44,407.74 Tess any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
