Van Milligen, City Manager SUBJECT: Liquor License Renewal for Players Sports Bar DATE: February 25, 2010 Dubuque All - America City 2007 Chief of Police Mark Dalsing is recommending disapproval of the liquor license renewal application for Players Sports Bar at 1902 Central Avenue. The Police Department has been attempting to work with the Players Sports Bar ownership for over three years to reduce the calls for service, with diminishing amounts of cooperation from the owners. For the period January 1, 2009, to February 7, 2010, there were over 563 police calls for service to Players Sports Bar and in the block surrounding the bar. Many of the calls for service in the area of the bar can be attributed back to the bar as they involve large groups of mostly intoxicated persons leaving Players. To put this in context, this is almost 1% of the Police calls for service for the entire City of Dubuque. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen, City Manager FROM: Mark Da!sing, Chief of Police RE: Liquor License Renewal for Players Sports Bar INTRODUCTION The purpose of this memorandum is to recommend to the City Council that they disapprove the liquor license renewal application for Players Sports Bar, 1902 Central Avenue. BACKGROUND Players Sports Bar ( "Players ") is currently operating under an annual liquor license that was renewed in March 2009 for a one -year period. Below is the liquor license issuance history for Players: A six -month liquor license was issued to Players from September 2007 to March 2008 due a sharp increase in high impact police calls for service related to the establishment. During the six -month license term monthly meetings were initiated between the Police Department and Players. Attending the meetings were Police Chief Kim Wadding, Capt. Russ Stecklein, and Dave and Rhonda Lorenz, owners of Players Bar. The meetings were discussions on strategies to combat the growing number of high impact of calls for service to Players. It is important to note these meetings were in no way intended to diminish Players responsibility to reduce the calls for service related to the establishment or shift responsibility to the Dubuque Police Department. . Disturbances Includes physical fighting, verbal arguments, loud music and /or subjects and all other disorderly behavior not already listed Crimes Against Persons Includes Assault and Harassment Crimes Against Property Includes Burglary, Criminal Mischief and Theft Public Morals Includes Public Intoxication and Possession of Controlled Substances High impact calls for service include disturbances, crimes against persons, crimes against property, and public morals. The types are defined as: The meetings with Dave and Rhonda Lorenz began to discuss correction strategies and included the following actions the owners could consider: • Regular meetings with the Police Department to discuss calls for service to Players, • Issuing of no trespass letters to patrons involved in disturbances which prevent them from returning to the bar as customers, • Limiting the number of occupants from the rated occupancy limit of 135 people to 80 -95 people, • Upgrading the video surveillance equipment in the bar in an attempt to identify offending patrons, • Implementing a cover charge at midnight to discourage what Mr. Lorenz described as an "unruly crowd" which enters at this time frame, • Maintaining security staff Thursday, Friday, and Saturday nights, • Identifying security staff with security shirts, • Checking identification on all subjects who enter the business, and • Providing Training in Intervention Services (TIPS.) training to all bar staff. All of the above strategies were to be implemented by the owners of Players at their discretion. Chief Wadding was very clear that his only mandate was for the reduction in calls for service related to the business. Dave and Rhonda Lorenz were asked to voluntarily participate in problem solving strategy sessions aimed at reducing police service needs and ultimately, providing a safe environment at their establishment and in the neighborhood. Following the issuance of the six -month liquor license, from, September 2007 through March 2008, and implementation of the above suggestions, the calls for service to Players were reduced. When a one -year liquor license renewal was granted in March 2008, Players continued to meet with the Police Department. Players, through Dave and Rhonda Lorenz, once again agreed to continue meeting with the Dubuque Police Department in 2009. During the 2009 license period a set time was scheduled for the meetings for the 3 Wednesday of each month at 11:30 AM at the police department. Dave and Rhonda Lorenz met with the Police Department on only five (5) of the scheduled eleven (11) times during 2009. DISCUSSION As stated above, Players received a one -year liquor license renewal in February 2009 which will expire in March 2010. At the time of the application, Police Chief Kim Wadding noted in his memo regarding the application for renewal that seven (7) meetings were held between the police and the owners of Players during the 2008 -2009 license period, with additional meetings scheduled for 2009. The bar issued two no- 2 trespass letters during the previous license period, planned to continue the self- imposed limit of 80 -95 patrons in the business, expanded the security staff policy to include Wednesday nights, continued to check identification on all patrons who enter the business, and all primary bar staff received TIPS. training. It was noted that Players had not upgraded the surveillance equipment in the bar, primarily due to cost, but was still exploring this step. Surveillance video was installed in August of 2009 but experienced some problems which have since been resolved. Players requested a meeting with the City Manager, City Attorney and Police Department on February 9, 2010. At this meeting, Players' Attorney Natalia Blaskovich presented a letter outlining the steps Players has implemented and those they have declined to implement. Attorney Blaskovich also identified "Actions requested of Players that we have declined:" 1. "Play different music, i.e. not rap or R &B, to attract a different crowd." They state this has been asked repeatedly by Chief Wadding and Acting Chief Tobin. This suggestion was made in direct response to questions by Players ownership as to whether the Police Department had any ideas how to discourage the problem crowd. A suggestion was to change or supplement the style of music played in the establishment. to something less likely to incite patrons. Police Department representatives never suggested that rap or R &B should not be played. 2. "Clothing brand restrictions." During a meeting held on August 14 2007, Mr. Lorenz said this was a policy he started. His policy prohibited hats not worn straight forward, doo -rag head coverings, and sunglasses being worn after sunset. At no point did the Dubuque Police Department make this request. 3. "Charging a cover charge after a certain hour to limit patrons that arrive after midnight, which the police department has identified as a primarily African — American crowd." During the initial meetings with Dave and Rhonda Lorenz, Mr. Lorenz made statements that he had no problems in the bar until the crowd changed at midnight and he identified this crowd as "unruly subjects ". Mr. Lorenz identified this group as primarily African - American. He asked for suggestions to deal with this problem crowd indicating that he was not making any money with the group and would find numerous small alcohol bottles illegally brought into his bar after the group left. It was suggested that a cover charge may discourage this problem. This was a suggestion implemented by Players after the May 5, 2007 meeting and Mr. Lorenz subsequently reported this effort was successful in reducing calls for service to his establishment. Mr. Lorenz then reported during a meeting held on September 25, 2007, he was relaxing this step due to a decline in business. 3 4. "Closing the bar at midnight to discourage the late night crowd, which the police department has identified as a primarily African - American crowd." Again, during the problem solving discussions, Mr. Lorenz identified his problem crowd as a group of patrons who arrived at midnight and typically spent nothing in the bar. It was merely suggested that an option to reduce calls for service may be to close at midnight if he was not making any money at that point of the evening. Attorney Blaskovich also indicated during this meeting that Dave and Rhonda Lorenz continued to cooperate with all requests made by the Dubuque Police Department staff. There has been some cooperation with no- trespass letters and attendance at some meetings. However, the night shift officers and staff of the Dubuque Police Department report less than desirable cooperation from both Players' staff and owners when responding to calls for service to the establishment. This lack of cooperation by Players' owners and staff has ranged from name - calling, interfering with investigations, and refusal to call police for disturbances occurring inside the bar. Attorney Blaskovich also detailed "Repeated concerns voiced by Dave and Rhonda Lorenz at meetings with the Police department:" 1. "Most of the "calls to service" happen outside or down the street from the bar." Many of the calls for service around the bar are generated by the police who frequently will generate a "10 -61" call for service because of the need to be outside of the bar as a preventative measure. If a call for service is deemed to be a police - generated call for service, the call is not held against Players. Many of the "10 -61's" will generate additional calls for service based on activities the officers observe. Many of the calls for service in the area of the bar can be attributed back to the bar as they involve large groups of mostly intoxicated persons leaving Players. 2. "We have stated concerns that bar staff have observed disparate treatment against African - American patrons and citizens — J- Walking citations & Public Intox citations." As the City of Dubuque does not have a jaywalking ordinance, for purposes of this statement it is assumed that Attorney Blaskovich means crossing a street in a spot other than a crosswalk. Citations have been written in the area of Players for disorderly conduct for intentionally obstructing vehicle traffic by walking in the traffic lanes. Public intoxication charges are often the end result of an investigation. Individuals may call attention to themselves by fighting or otherwise acting unruly. When an officer has contact with the individual after he or she has drawn attention to them, they are often found to be intoxicated. No formal complaints or referrals for disparate treatment have been received by the Dubuque Police Department. Any and all complaints are taken very seriously and aggressively investigated. "The police sit outside the bar routinely, despite the crowd size or incidents that occur." As with the first point above, the officers are expected to be readily visible and available in areas of the heaviest activity or calls for service. This is primarily to prevent crime and calls for service and to provide a sense of security for Players patrons, people living in, visiting, or passing through the neighborhood. STATISTICAL DATA Players has held a liquor license since September 2002. The following is a comparison of calls for service related to Players from January 1 through December 31 for the years of 2006, 2007, 2008 and from January 1, 2009 through February 7, 2010. PLAYERS SPORTS BAR -2006 Between the dates of January 1, 2006 and December 31, 2006, there were 153 calls for service to the establishment. Of those 153 calls there were 40 disturbances, 13 crimes against persons, 10 crimes against property, and 15 public morals calls. Additionally, there were 74 individual violations and no violations against the business. Additionally, there were 76 individual violations. 21 COMPARISON WITH OTHER LICENSED ESTABLISHMENTS Dave and Rhonda Lorenz, the owners of Players, claim to have a higher density of problem patrons due to Players geographic location in Dubuque. They Lorenz' feel there are situations Players deals with that other bar owners in Dubuque are not experiencing. Mr. Lorenz has commented on several occasions during our meetings that he was looking for a location on the west end to open a sports bar and close his current location. If the city council disapproves an application for a license or permit, Iowa Code § 123.32(6) provides the applicant may appeal from the disapproval to the administrator of the alcoholic beverages division. In the appeal the applicant is allowed the opportunity to demonstrate in an evidentiary hearing that the applicant complies with all of the requirements for holding the license or permit.
