I have also included a list of actions requested by Dubuque officials that we have declined to take due to concerns that the requests were discriminatory against their African- American patrons. Voluntary crowd reduction The Dubuque Fire Marshall allows a maximum crowd capacity of 135 people, but Dave and Rhonda always limit the crowd to 80 -95. 2. Regular meetings with the Police Department Our agreement has always been every 6 -8 weeks, which we have substantially complied with since January 2008. 3. Review No Trespass letters to patrons for criminalacts This has never been asked by any other bar owner in Dubuque. The only time this has been an issue was when bar staff kept the ID of a woman who had been issued a No Trespass letter. The officer "handled" the incident, no arrest was made and it counted as a "call to service" against Players. (June 6, 2009) 4. Upgraded video surveillance to "identify offenders" Dave has shown the police department how his system operates in case they need to subpoena any videotape related to an investigation. 5. Maintain clearly identifiable security staff 6. Maintain a high profile for checking all id's Players has never been cited for underage patrons. 7. Provide TIPS training to bar staff 8. Dave bought a metal detector for bar staff to use. Action requested of Players that we have declined: 1. Play different music, i.e. not rap or R &B, to attract a different crowd. This has repeatedly been requested by Chief Wadding and Acting Chief Tobin. We feel this request is discriminatory and censors their speech. 2. Clothing brand restrictions We feel this is discriminatory and have provided information to the police department regarding legislation and articles that reiterate the concerns we expressed. 3. Charging a cover charge after a certain hour to limit patrons that arrive after midnight, which the police department has identified as a primarily African - American crowd. 4. Closing the bar at midnight to discourage the late night crowd, which the police department has identified as a primarily African - American crowd. Repeated concerns voiced by Dave and Rhonda at meetings with the Police Department: 1. Most of the "calls to service" happen outside or down the street from the bar. At our meeting on August 21, 2009 Jeremy Jensen informed us that all of the reports for calls to service from June 12 to August 15 were involving ONLY incidents outside on the street. - Example: May 18, 2009 - on 18 Street male suspect stole the purse of two women. This incident was linked to Players because the women had left the bar before walking to 18 Street. - The Police Department has never offered suggestions on what they expect Dave and Rhonda to do to address this fact. 2. We have stated concerns that bar staff have observed disparate treatment against African- American patrons and citizens. J- walking citations Public Intox citations 3. So will other Kansas City area people denied access to the $85 million entertainment district because they were wearing long, white t- shirts, or other clothing trends, many considered standard attire in the hip -hop, urban culture. The couple's yearning for the Power & Light District experience may soon be fulfilled, whether Jones dons a long t -shirt or not. The council next week will consider a recommendation by Kansas City's Planning and Zoning Committee intended to pre -empt the existing Cordish Company dress code rules, currently posted just inside the district entrance. While the committee - approved recommendations don't specifically name the Power and Light District, and its controversial dress code, it is aimed at eliminating aspects of the code that some Kansas Citians complained constitute profiling, according to City Councilman Ed Ford, a member of the Planning and Zoning Committee. Ford summarized the new code. "For legal reasons, we couldn't specifically target the Power and Light District." Ford added that he believes the council will support the recommendation. "I voted for it, and I think the council will pass it next week." If approved, the new code could enable Jones, 28, a production assistant at KSHB -TV, to experience the P &L District. Jones, who was accompanied by Tarah Townson, 24, tried in vain to spend a recent Friday night at the P &L District, but couldn't get past security. The Kansas City couple, who are black, said a security guard, charged with enforcing the district's dress code, told them that Jones' t -shirt was too long. Officials with the Cordish Company, developer of the downtown district, drafted the dress code, which forbids, among other things, long t -shirts and baggy pants. Some blacks who have not been allowed into the district have voiced and written complaints at City Hall, many charging racial discrimination. Cordish officials have vehemently denied racial discrimination in their dress code. Power & Light District President Jon D. Stephens said, in an e- mailed statement, that Cordish officials are aware of the proposed ordinance and "believe that it is poor public policy and bad business practice. Stephens continued, adding that the P &L District might be the target of this proposal. "If our elected officials were sincere about ensuring that all businesses have specific dress codes they would enact an ordinance that applies to all businesses in the city and not just target specific developments. Under this ordinance the majority of businesses in the city would not have to comply." The newly proposed code explicitly prohibits establishments from arbitrarily assigning length or style of headgear, hair, clothes, shoes or jewelry. The proposal states that such actions could be taken as profiling. The rules allow for requiring patrons to wear certain clothing, such as collared shirts, jackets, business suits and formal footwear, as long as enforced in a non - discriminatory way. Dress codes, including prohibited items, should be posted and should include the telephone number of the City Human Relations Department and a representative of the establishment who will take complaints during all business hours. Jones said he's not sure why security officials working that night denied him access. They told Jones it was because his shirt was too long, but, Jones, who knew they had a strictly enforced dress code, said he tried to conform. His shirt, which was not white, but gray, extended just below the pockets of his jeans. However, Jones said he wondered if his overall look caused security guards to turn him and his date away that night. Jones wears a corn -row hairstyle, has two earrings in his left ear, and wears a grill on his front top teeth, which, he explained, is a form of jewelry. "This just kind of seems like it's targeted at African Americans," Jones said, adding that it seemed as if the security guards were looking for a reason to keep him out. Townson said she was shocked that they couldn't enter. "I still can't believe it," she said. "I think it's just profiling." If adopted, the new code will apply to all public entities receiving city tax money. The nine - city -block area including retail, entertainment, office and residential space, was developed using tax - increment financing from the city of Kansas City. Jones was encouraged when told of the recent planning and zoning action. "It sounds like that's much - needed," Jones said, adding that the Cordish dress code has the feeling of a private club in what should be an all- inclusive downtown area. However, he's also a bit skeptical that the new code will be followed. "It sounds wonderful, but I'd love to see if it's implemented the way the city intends." The Kansas City district is not the only Cordish Company property receiving dress code complaints. A recent Internet search of Cordish properties revealed a flurry of complaints concerning dress code enforcement at the company's establishments throughout the country. The Cordish code bans long, white t- shirts and other fashion staples of the urban look, including excessively baggy clothing, shorts that fall below the top of the calf, shirts that hang below pant pockets, exposed necklaces on men, towels and Timberland boots. State Rep. Wayne Ford has proposed a bill that would prohibit businesses from discriminating based on the type of clothing people are wearing. Ford, a Des Moines Democrat, said the measure is most applicable to hip -hop generation youngsters who wear popular brands such as Pelle Pelle and FUBU. While nightclubs can't keep people out because of their race, Ford said they've made discriminary clothing rules to do just that. His bill states that it's an unfair or discriminatory practice for any business that charges a fee for services, facilities or goods to discriminate based on the brand of a person's apparel. If such discrimination occurs, the measure would allow for the Iowa Civil Rights Commission to investigate and possibly award damages. House File 221, specifically prohibits discrimination based upon brand names. While nightclubs or other businesses could make a rule completely banning garments like hooded sweatshirts, they would be unable to ban a Nike sweatshirt over another brand like Hanes. The proposal is needed to help combat discrimination, advocates of the bill said. It comes roughly seven years after the death of Charles Lovelady. Lovelady, a black man, died after a scuffle with two white bouncers at a Des Moines club. Lovelady initially was kicked out of the club in a dispute over the dress code. His death started a heated debate about race. Lovelady's mother, JoAnn Hughes, said the proposal is a step in the right direction although she doesn't think it will completely end problems. She now works with a group known as Concerned Citizens for Justice and helps investigate allegations of discrimination. She said Des Moines area nightclubs continue to turn African - American patrons away for alleged dress code violations on a regular basis. "They just discriminate, period," Hughes said. "They'll find something wrong so you can't be admitted. If they don't want you in there, they'll find a reason." Des Moines, after Lovelady's death, enacted an ordinance requiring bouncers to undergo training. City leaders, however, acknowledge that the places that have bouncers typically contract their security which exempts them from the training. Rep. Wayne Ford, a Des Moines Democrat who is spearheading the law, told lawmakers today that Lovelady's death will never be forgotten and that the law is needed to prevent more violence. "They know they cannot discriminate because you are black or Hispanic or Asian so they now use a brand of clothing popular with minorities to keep people out," Ford said. House File 221 passed the House Human Resources Committee today, making it eligible for debate by the House. It must pass the House and the Senate before it would make its way to the governor to become a law. The Iowa Civil Rights Commission would investigate complaints and businesses found in violation could face fines. Several representatives expressed support for the proposal Wednesday but some worried that it doesn't clearly spell out exemptions. For example, lawmakers said, it might prevent a clothing business from prohibiting employees from wearing a competitor's brand while at work. "I understand what you're trying to do with this bill, I just feel there are some questions that haven't been answered," said Rep. Pat Grassley, a New Hartford Republican. Tad Wilks, editor of Nightclub & Bar Magazine, said most businesses probably wouldn't object to the proposal. The magazine is associated with the National Bar & Restaurant Management Association.
