SUBJECT:Disposition of Vacated Streets and Alleys - Port of Dubuque
In the past seven months the City has purchased property in the Port of Dubuque from
Dubuque Hardwoods, Miller Logging Company, Con Agra and Klauer Manufacturing.
The Dubuque Hardwoods property was immediately sold to Dubuque Initiatives, the
non-profit organization assisting the City in its redevelopment efforts.
One of the conditions of the sale to Dubuque Initiatives was that the City would take
necessary steps to vacate all the streets and alleys within the land purchased, and
convey the areas vacated, with the exception of Market Street, to Dubuque Initiatives no
later than November 1, 2003.
Economic Development Director Bill Baum recommends that the City Council vacate all
the streets and alleys within the land purchased and convey the areas vacated, with the
exception of Market Street, to Dubuque Initiatives,
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Disposition of Vacated Streets and Alleys - Port of Dubuque
INTRODUCTION
This memorandum requests City Council adopt a resolution disposing of certain streets
and alleys in the Port of Dubuque to Dubuque Initiatives.
DISCUSSION
In the past seven months, the City has pumhased property in the Port of Dubuque from
Dubuque Hardwoods, Miller Logging Company, Con Agra, and Klauer Manufacturing.
The Dubuque Hardwoods property was immediately sold to Dubuque Initiatives, the
non-profit organization assisting the City in its redevelopment efforts.
One of the conditions of the sale to Dubuque Initiatives was that the City would take
necessary steps to vacate all the streets and alleys within the land purchased, and
convey the areas vacated, with the exception of Market Street, to Dubuque Initiatives no
later than November 1, 2003.
The total area to be vacated are divided into 16 lots lettered G through V of Dubuque
Harbor Improvement Company Addition. Public utilities exist on Lots G, I, L, Q, and V.
Temporary easement rights will be reserved on those lots for maintenance of existing
utilities. These temporary easements will expire upon replatting and relocation of said
utilities. Also, an easement for access is being provided on Lot V for the property
currently owned by the Terry Weidemann (Stealth Racing).
At the April 21 City Council meeting, the Council adopted six resolutions approving the
plats of the proposed vacated streets and alleys, adopted six ordinances vacating the
streets and alleys, and set a date for public hearing on the disposition of the property to
Dubuque Initiatives.
RECOMMENDATION
I recommend the City Council, after public hearing, adopt the resolution disposing of the
City's interest to Dubuque Initiatives.

RESOLUTION NO. 149-03
RESOLUTION DISPOSING OF CITY INTEREST IN LOTS N, O, P, Q, R,
S, T, U, AND V OF DUBUQUE HARBOR IMPROVEMENT COMPANY
ADDITION IN THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, pursuant to resolution and published notice of time and place of
headng, published in the Telegraph Herald, a newspaper of general cimulation
published in the City of Dubuque, Iowa on this25th day of Apri'l ,2003,
the City Council of the City of Dubuque, Iowa met on the 5th day of
May, 2003, at 6:30 p.m. in the Public Library Auditorium, 360 West 11
Street, Dubuque, Dubuque County, Iowa to consider the proposal for the sale of
real estate described as:
Lots N, O, P, Q, R, S, T, U, and V of Dubuque Harbor Improvement
Company Addition in the City of Dubuque, Dubuque County, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and
all objections, oral or written to the proposal to sell such real estate, except for
easement as noted.
NOW, THEREFORE, BE iT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as
Lots N, O, P, Q, R, S, T, U, and V of Dubuque Harbor Improvement Company
Addition in the City of Dubuque, Dubuque County, Iowa, to Dubuque Initiatives
be and the same is hereby approved. Conveyance shall be by Quit Claim Deed.
Section 2. The City of Dubuque reserves unto itself a temporary
easement including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, television cable, fiber optics,
and electdc lines as may be authorized by the City of Dubuque, Iowa. This
temporary easement will terminate upon the replatting and relocation of said
utilities.
Section 3. That the Mayor be authorized and directed to execute a Quit
Claim Deed, and the City Clerk be and is hereby authorized and directed to
deliver said deed of conveyance to Dubuque Initiatives.
Section 4. That the City Clerk be and is hereby authorized and directed
to record a certified copy of this resolution in the offices of the City Assessor,
Dubuque County Recorder and Dubuque County Auditor.
Passed, approved and adopted this 5th day of May, 2003.
