SUBJECT: East 5t" Street Right of Way Dedication Plat
DATE: September 30, 2019
The current East 5th Street right of way does not have sufficient width to accommodate
the existing sidewalks and utilities on the south side of the road.
City Engineering has prepared an acquisition plat to provide right of way area for the
existing sidewalk and utilities as contemplated in the 2003 project plans. The area
being platted will be dedicated to the public for street and utility purposes.
In 2011, Flexsteel Industries Inc. was granted a pedestrian and vehicular access
easement over the proposed right of way dedication area. City staff has met with
Flexsteel to discuss the proposed right of way dedication and Flexsteel has provided
written consent to the platting. Flexsteel will continue to have the same rights within the
right of way dedication area.
City Engineer Gus Psihoyos recommends City Council approval of the Acquisition Plat
of Lot 2-1-A, Adams Company's 4t" Addition, which provides additional right of way for
the existing sidewalk and utilities on the south side of East 5t" Street from Ice Harbor
Road to Bell Street.

approval.

INTRODUCTION
This memo provides information regarding the platting of additional right of way for East
5th Street from Ice Harbor Rd. to Bell St.
BACKGROUND
In 2004 the City constructed new streets, sidewalks and utilities on 5t" Street and Bell
Street as part of the improvements to the Port of Dubuque. In several areas, the
existing street right of ways were not wide enough to accommodate the proposed
streets and sidewalks included in the project plar�s. The 2003 plans iricluded proposed
right of way acquisitions in those areas. The proposed right of way was to include the
street area and new sidewalks (to the back of the new sidewalks).
DISCUSSION
The current East 5t" Street right of way does not have sufficient width to accommodate
the existing sidewalks and utilities on the south side of the road.
City Engineering has prepared an acquisition plat to provide right of way area for the
existing sidewalk and utilities as contemplated in the 2003 project plans. The area
being platted will be dedic�ted to the public for str�et and utility purposes.

RESOLUTION APPROVING THE ACQUISITION PLAT OF LOT 2-1-A, ADAMS
COMPANY'S 4TH ADDITION, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated September 19, 2019 prepared by The City 'of Dubuque
Engineering Department describing Lot 2-1-A, Adams Company's 4th Addition in
The City of Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, B E IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated September 19, 2019 prepared by the City of
Dubuque Engineering Department, relative to the real estate hereinabove
described be and the same is hereby approved, and the Mayor and City Clerk be
and they are hereby authorized and directed to execute said plat and on behalf of

AFFIDAVIT
I, Russell N. Kieffer, being first duly sworn under oath do depose and state as follows:
1. That I am a duly registered land surveyor licensed in the State of Iowa, License No.
18128.
2. That I prepared a Plat of Survey of Lot 2-1-A of Adams Company's 4th Addition, in the
City of Dubuque, Iowa which plat of survey is recorded as Instrument Number 2019-00012577 on
October 16, 2019, in the records of Dubuque County Recorder, Dubuque, Iowa.
3. That Sheet 1 of 5 incorrectly shows that three 5/8" rebar with yellow plastic cap #18128
were set along the southwesterly boundary of Lot 2-1-A. Existing concrete pavement prevented
the placement of rebar monuments as call for in said plat of survey.
4. That chiseled "X" boundary markers have been placed instead of the three rebar
monuments described above.
