City Clerk's Office • 50 W. 13�h Street, Dubuque, IA 52001 • 563.589.4100 . � � d Title 8 � , Chapter 2 � HUMAN RIGHTS COMMISSION !� Amended 7-21-15 I q 8-2-1: COMMISSION CREATED: � There is hereby created the Human Rights Commission. �q j 8-2-2: PURPOSE: �{ The purpose of the commission is to hold hearings, compel the production of evidence, and I determine the merits of complaints alleging unfair or discriminatory practices in housing, '1 , employment, education, credit, or places of public accommodation; to investigate and study the � existence, character, causes, and extent of discrimination and to attempt to eliminate ' discrimination by educating the public and promoting human rights in the community; and to � take action in the community to promote civil and respectful behavior and to eliminate , discrimination based on age, race, creed, color, sex, national origin, religion, ancestry, disability, 'i marital status, familial status, sexual orientation, or gender identity. 8-2-3: INTERNAL ORGANIZATION AND RULES: � The commission may adopt rules and regulations to govern its organizational procedures as ' may be necessary and which are not in conflict with this Code of Ordinances or the lowa Code. -2-4: PRO ED F 8 C URES OR OPERATION: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern ' Ii the commission in all its operations. `;; ,i 8-2-5: MEMBERSHIP: '' � A. The commission comprises nine (9) residents of the city, appointed by the city council � from various racial, religious, cultural, and social groups within the city. 'j i B. Residents must be eighteen (18) years of age or older. � � C. Membership on the commission must comply with the provisions of lowa Code §69.16A, � relating to gender balance. No per�on can be appointed or reappointed to the commission if that ; appointment or reappointment would cause the number of inembers of one gender to be greater � than one-half ('/2) of the membership of the commission plus one (1). If the city has made a , good faith effort to appoint a qualified person to fill a vacancy on the commission for a period of 4 �: three (3) months but has been unable to make a compliant appointment, the city must utilize a � fair and unbiased method of selecting the best qualified applicants. � 8-2-6: OATH: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. 8-2-7: TERMS: � The term of office for commissioners is three (3) years or until such commissioner's successor is n appointed and qualified. g � � � � � 8-2-8: VACANCIES: � Vacancies must be filled in the same manner as original appointments. ° �� 8-2-9: OFFICERS/ORGANIZATION: �� The commissioners must choose annually a chairperson and vice-chairperson, each to serve a � term of one (1) year. The chairperson must appoint a secretary, who need not be a member of � the commission. The commissioners must fill a vacancy among its officers for the remainder of ' the officer's unexpired term. ; �� ,, �{ 8-2-10: MEETINGS: � � A. Regular Meetings. The commission must meet monthly. 4 �I u B. Special Meetings. Special meetings may be called by the chairperson or at the written �j request of a majority of the commissioners. � i� C. Open Meetings. All meetings must be called and held in conformance with the lowa ` Open Meetings Law. i { i D. Attendance. '� 1. In the event a cornmissioner has been absent for three (3) or more consecutive '� � meetings of the commission, without being excused by the chairperson, such absence '� will be grounds for the commission to recommend to the city council that the position be �declared vacant and a re lacement a � p ppointed. �k j� 2. Attendance must be entered upon the minutes of all meetings. ; �E. Minutes. A copy of the minutes of all regular and special meetings of the commission i must be filed with the city council within ten (10) working days after each meeting, or by the � next regularly scheduled city council meeting, whichever is later. �a , F. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The ! affirmative vote of a majority of the commissioners present and voting is necessary for the ;I adoption of any motion or resolution. ',� , 8-2-11: COMPENSATION: � Commissioners serve without compensation, provided that they may receive reimbursement for '� necessary travel and other expenses while on official commission business within the limits i, established in the city administrative policies and budget. i � � s 8-2-12: REMOVAL: � � The city council may remove any commissioner for cause upon written charges and after public hearing. 8-2-13: POWERS: �� The commission has the following powers, duties, and responsibilities: A. To receive, investigate, and finally determine the merits of complaints alleging unfair or discriminatory practices. � � � B. To investigate and study the existence, character, causes, and extent of discrimination � in public accommodations, employment, apprenticeship programs, on-the-job training � programs, vocational schools, other educational institutions, and housing in the city and ;� to attempt the elimination of such discrimination by education and conciliation. � ii C. To hold hearings upon any complaint made against a person, an employer, an � employment agency, a labor organization, or the employees or members fhereof, to ''i subpoena witnesses and compel their attendance at such hearings, to administer oaths il and take the testimony of any person under oath and to compel such person, employer, ',� employment agency, labor organization, or employees or members thereof, to produce � for examination any books and papers relating to any matter involved in such complaint. � The commission will issue subpoenas for witnesses in the same manner and for the ;� same purpose on behalf of the respondent upon the respondent's request. Such hearings I; may be held by the commission, by any commissioner, or by any hearing examiner i; appointed by the commission. If a witness either fails or refuses to obey a subpoena issued by the commission, the commission may petition the district court having 'urisdiction for issuance of a sub oena and the court must in a ro er case issue the J , I� pp P , �� subpoena.
