COMMUNITY DEVELOPMENT ADVISORY COMMISSION
2 -5C -1: COMMISSION CREATED; COMPOSITION:
A. Creation: There is hereby created a community development advisory commission
whose primary purpose shall be to provide for citizen participation in the
development and evaluation of the city of Dubuque's community development block
grant (CDBG) program.
B. Membership: The commission shall comprise nine (9) members; four (4) members
shall be residents of census tracts and block groups where at least fifty one percent
(51 %) of the residents are low /moderate income persons as determined by the
United States department of commerce, bureau of the census; four (4) members
shall be residents of the community at large; and one member shall be that member
of the housing commission designated by the housing commission. (2007 Code
§ 15 -46)
2 -5C -2: TERM; FILLING OF VACANCIES; COMPENSATION:
A. Term: The term of office for a commission member shall be three (3) years.
B. Removal of Member: A commission member may be removed at any time with or
without cause by a vote of two - thirds ( of all members of the city council.
C. Filling Vacancies: A vacancy occurring on the commission caused by resignation or
otherwise shall be filled by appointment of the city council for the remainder of the
unexpired term.
D. Compensation: Members of the commission shall serve without compensation
except for actual expenses, which shall be subject to approval by the city council.

2 -5C -3: ORGANIZATION:
The commission shall choose annually, at its first regular meeting of the fiscal year, one
of its members to act as chairperson, and another of its members to act as vice
chairperson, to perform all of the duties of the chairperson during the chairperson's
absence or disability. The commission shall adopt such rules and regulations governing
its organization and procedures as it may be deemed necessary, consistent with the
following:
A. Meetings: The commission shall meet as necessary to fulfill the purposes for which
the commission was created.
B. Attendance Of Members: Members of the commission shall attend at least two- thirds
( of all regularly scheduled meetings within any consecutive twelve (12) month
period. If any member fails to attend such prescribed number of meetings, such
failure shall constitute grounds for the commission to recommend to the city council
that said member be replaced. Attendance of all members shall be entered in the
minutes.
C. Minutes Filed With Clerk: The commission shall file with the city clerk a copy of the
minutes of each regular and special meeting of the commission within ten (10)
working days after such meeting. (2007 Code § 15 -51)
2 -5C-4: GENERAL DUTIES AND RESPONSIBILITIES:
The commission shall have the following duties and responsibilities:
A. To conduct public hearings in accordance with the minimum standards established in
the CDBG program's citizen participation plan to ensure meaningful citizen input in
the planning, implementation and assessment of the city's CDBG program;
B. To provide for and encourage the participation of low and moderate income persons
who reside in designated areas of slum and blight and residents of low and
moderate income neighborhoods, as defined by the city council, in the planning,
implementation and assessment of the CDBG program;
C. To identify community development needs, particularly the needs of persons of low
and moderate income;
D. To serve in an advisory role upon the request of the city council in policy decisions
regarding funding priorities and program development and implementation;
E. To monitor and evaluate program activities to advise whether identified community
development objectives have been met;
F. To undertake public information efforts to educate the citizenry of the availability of
CDBG funded programs and to provide for a greater understanding of the city's
community development efforts;
G. To assist in the preparation of the statement of community development objectives
and projected use of funds, amendments thereto and required reports including, but
not limited to, the annual grantee performance report (GPR) and the annual
comprehensive housing assistance strategy (CHAS);
H. To serve in an advisory role to the city manager in the review of complaints and
grievances received in accordance with the procedures established in section 2 -5C-
5 of this article; and
I. To support, upon request, the efforts of the city council and other city commissions in
the assessment of the general development needs of the community. (2007 Code
§ 15 -49)
2 -5C -5: GRIEVANCE PROCEDURE; REVIEW STANDARDS; APPEAL
PROCESS:
The grievance procedure for the community development block grant program shall be
as follows:
A. Right To File: Any aggrieved person may file a grievance with the city manager.
B. Contents: Grievances shall contain a concise statement of the grievance and an
explanation of the action desired.
C. Forwarding To Commission: The city manager shall forward the grievance to the
commission within seven (7) working days of its receipt.
D. Setting Date For Hearing; Notice To Complainant: The commission shall, within
fifteen (15) working days of the receipt of the grievance, set a time for a hearing. The
complainant shall be notified in writing of the time and place of the hearing. If a
grievance is resolved prior to the date of the hearing, the aggrieved party shall
request in writing that the grievance be withdrawn.
E. Hearing Procedure: The commission shall conduct a hearing to review the grievance.
The grievant may appear in person, by agent, or by attorney. All persons wishing to
appear before the commission shall have an opportunity to be heard regarding the
grievance. Minutes shall be kept of the proceedings of the hearing.
F. Recommendations Of Commission: The commission shall forward its
recommendation, in writing, to the city manager within ten (10) working days
following the hearing.
G. Action By City Manager: The city manager shall receive and review the
recommendation of the commission and shall respond to the grievant within ten (10)
working days of the receipt of the recommendation. The commission shall be
advised of the action of the city manager.
H. Compliance With Federal Regulations: The recommendations of the commission
shall comply with the regulations established by the U.S. department of housing and
urban development for the community development block grant program under title I
of the housing and community development act of 1974, as amended, and this code.
I. Appeal To Council By Grievant: If the grievant is unsatisfied with the response of the
city manager, an appeal may be made filed with the city clerk. The appeal shall be
forwarded by the city clerk to the city council. The city council may, at its discretion,
hold a hearing to consider the concerns of the grievant.
J. Council Action; Appeal To HUD: Upon review of the appeal, the city council shall: 1)
accept the response of the city manager; 2) modify the response of the city
manager; or 3) return the grievance to the city manager for further review. If the
outcome of such appeal is unsatisfactory, the complainant may file a written appeal
with the U.S. department of housing and urban development (HUD). (2007 Code
§ 15 -50)
2 -5C -6: PROCEDURES FOR OPERATIONS:
The commission shall operate in accordance with the standards and procedures set
forth in the city's community development block grant (CDBG) program's citizen
participation plan. All administrative, personnel, accounting, budgetary and procurement
policies of the city shall govern the commission in all its operations. (2007 Code § 15-

Sec. 2 -178. Applicability; Provisions To Comply With Statutes:
The provisions of this Article shall apply to those persons enumerated in Iowa Code section
400.6 and shall be in accordance with the laws of the State. (1976 Code, § 2 -178)
Sec. 2 -179. Created:
A Civil Service Commission is hereby created under and in accordance with the provisions of
chapter 400 of the Code of Iowa. (Code 1976, § 2 -179)
Sec. 2 -180. Qualifications Generally:

Civil Service Commissioners must be citizens of Iowa, eligible electors as defined in chapter
39 of the Code of Iowa, and residents of the City preceding their appointment, and shall not
hold or be a candidate for any office of public trust. The Human Rights Director shall, ex officio,
be a member, without vote, of the Civil Service Commission.
Civil Service Commissioners shall not buy from, sell to, or in any manner become parties,
directly, to any contract to furnish supplies, material, or labor to the city in which they are
Commissioners. (1976 Code, § 2 -180)
Sec. 2 -181. Appointment; Term:
The Mayor, with the approval of the Council, shall appoint three (3) Civil Service
Commissioners who shall hold office, one until the first Monday in April of the second year, one
until the first Monday in April of the third year, and one until the first Monday in April of the
fourth year, after such appointment, whose successors shall be appointed for a term of four (4)
years. (1976 Code, § 2 -181; Ord. 17 -98, § 1, 3 -16 -1998)
Sec. 2 -182. Compensation:
The Civil Service Commissioners shall serve without compensation. (1976 Code, § 2 -182)
Sec. 2 -183. Chairperson; Clerk:
The Civil Service Commission shall elect a chairperson from among its members and the City
Clerk shall be the clerk of the Commission. (1976 Code, § 2 -183)
Sec. 2 -184. Council To Furnish Meeting Room, Equipment, Recorder:
The Council shall provide suitable rooms in which the Civil Service Commission may hold its
meetings and supply the Commission with all necessary equipment and a qualified shorthand
reporter to enable it properly to perform its duties. (1976 Code, § 2 -184)

The Civil Service Commission shall keep a record of all its meetings and also a complete
individual service record of each civil service employee which record shall be permanent and
kept up -to -date. (1976 Code, § 2 -185)
Sec. 2 -186. Applicants To Be Examined:
Examinations for the positions in the City civil service shall be applicable to and required of all
applicants in accordance with the Civil Service Law, namely, I.C.A. chapter 400. (1976 Code, §
2 -186)
Sec. 2 -187. Examinations To Be In Accordance With Statutes; Qualified
Persons To Be Certified:
The Civil Service Commission shall conduct examinations in accordance with the provisions of
the laws of the State relative thereto, and for the purpose of determining the qualifications of
applicants for positions under civil service and shall duly certify to the Council a list of the
qualified persons as set forth in I.C.A. chapter 400. (1976 Code, § 2 -187)
Sec. 2 -188. Procedure For Conduct Of Hearing Appeals:
Notwithstanding Sections 1 -20 through 1 -25 of this City Code, the Civil Service Commission

Mechanical Code Board
14 -1f -2: International Mechanical Code Amendments:
Section 203, "Board Of Appeals" is hereby amended by repealing such section and
replacing such section with a new section in lieu thereof as follows:
Section 203. Mechanical Code Board.
(a) Board Established. In order to determine the suitability of alternative materials and
methods of installation, to provide for reasonable interpretations of the mechanical
code, to serve as an appeal body for the decisions of the building official, to advise the
city council on all heating, ventilating, air conditioning and refrigeration regulations and
procedures, and to provide for examining applicants for certification of competency and
issuing certificates of competency and registration, there is hereby created the
mechanical code board.
(b) Membership. The mechanical code board shall consist of seven (7) members
appointed by the city council. Each member shall have a background or experience in
sheet metal contracting, hot water and steam fitting contracting, hot water and steam
fitting work, refrigeration contracting, refrigeration work, or mechanical engineering.
(c) Term Of Office. The term of office of all board members shall be three (3) years.
(d) Rules And Regulations. The board shall make such rules and prescribe such
procedures as may be reasonably necessary for its operation, except that such rules
shall include the following:
(1) The chairperson of the board shall be elected annually by a majority of the board.
(2) The building official, or the building official's designee, shall be secretary of the
board. The secretary shall arrange for meetings and prepare and keep such minutes
and records and perform such other clerical work as the board may direct.
(3) Four (4) members of the board shall constitute a quorum. The affirmative vote of four
(4) members of the board shall be necessary to adopt any motion.
(4) Upon completion of the term of office, a member of the mechanical code board shall
continue to serve until their successor has been duly appointed.
(5) The mechanical code board shall meet at least once every three (3) months upon
call of the chairperson, secretary or city manager. A member of the mechanical code
board shall attend at least two- thirds (/ of all scheduled meetings within a twelve-
month period. If any member does not attend such prescribed number of meetings, it
shall constitute grounds for the board to recommend to the city council that said
member be replaced.
(6) The attendance of all members shall be entered on the minutes by the secretary.
(7) All meetings shall be held in conformance with the provisions of the Iowa open
meetings law.
(8) The mechanical code board shall file with the city clerk a copy of the minutes of each
meeting of the board within ten (10) working days after such meeting.
(9) All administrative, personnel, accounting, budgetary, and procedural policies of the
city shall govern the mechanical code board in all of its operations.
(10) Any person who is aggrieved by a decision of the building official resulting from the
enforcement of the mechanical code may appeal from such decision to the mechanical
code board, and said board shall serve as an appeal board. In case the aggrieved party
is a board member, said member shall be disqualified as a member of the board acting
as an appeal board until the person aggrieved has been heard and a decision rendered.
The appeal shall be made by the person aggrieved giving written notice of such appeal
to the building official at the building official's office within seven (7) days. The building
official shall, within seven (7) days thereafter, notify the board of the appeal. The
mechanical code board shall meet within seven (7) days after receiving such notice and
shall render a decision within five (5) days thereafter. Any interested party, including the
building official, may have the right to present such party's case to the appeal board,
whose decision shall be final unless appealed to the district court as provided by law.

5 -3.1. Establishment of Board:
Zoning Board of Adjustment
A Zoning Board of Adjustment is hereby established pursuant to chapter 414 of the
Code of Iowa, 1975. The word "board" as used in this Ordinance shall mean the Zoning
Board of Adjustment.
(A) Membership of the Board: The Board shall consist of five (5) members appointed by
the City Council.
(B) Term Of Office: Members of the Board shall be appointed for a term of five (5)
years, excepting that when the Board shall first be created, one member shall be
appointed for a term of five (5) years, one for a term of four (4) years, one for a term
of three (3) years, one for a term of two (2) years, and one for a term of one year.
(C) Removal: Board Members may be removed for cause by the City Council upon
written charges and after a public hearing.
(D) Vacancies: Vacancies on the Board shall be filled for the unexpired term of any
member whose term becomes vacant.
(E) Appointment to Airport Zoning Board of Adjustment: Two (2) members of the Board
shall be appointed by the City Council to serve on the Airport Zoning Board of
Adjustment. A member shall serve out the term on the Airport Zoning Board of
Adjustment even if the member's term on the Zoning Board of Adjustment has
expired.
5 -3.2. General Procedure:
(A) Meetings: Meetings of the Board shall be held at the call of the chairperson and at
such other times as the Board may determine. Such chairperson, or in the
chairperson's absence, the acting chairperson, may administer oaths and compel
the attendance of witnesses. All meetings of the Board shall be open to the public.
The Board shall keep minutes of its proceedings, showing the vote of each member
upon each question, of if absent or failing to vote, indicating such fact, and shall
keep records of its examinations and other official actions, all of which shall be
immediately filed in the office of the board and shall be a public record. The board
may in addition adopt general rules of procedure not inconsistent with the provisions
of this ordinance.
(B) Vote of the board. The concurring vote of three (3) members of the board shall be
necessary to reverse any order, requirement, decision or determination of any
administrative official, or to decide in favor of the applicant on any matter upon which
it is required to pass under this ordinance, or to effect any variation in such
ordinance, or to adopt, repeal, or amend any rule of procedure adopted pursuant to
this section.
5 -3.3. General Powers:
The board shall have the following powers:
(A) Appeals from the administrative official. To hear and decide appeals where it is
alleged there is error in any order, requirement, decision, or determination made by
an administrative official in the enforcement of this ordinance,
(B) Conditional uses. To hear and decide applications for conditional use permits upon
which such board is required to pass under this ordinance.
(C) Variances. To authorize upon appeal in specific cases such variance from the bulk
regulation provisions including parking and sign requirements of the ordinance as
will not be contrary to the public interest, where owing to special conditions a literal
enforcement of the provisions of the ordinance will result in unnecessary hardship,
and so that the spirit of the ordinance shall be observed and substantial justice done.
(D) Special exceptions. To hear and decide applications for special exceptions to the
terms of this chapter, in accordance with the general regulations of the zone in which
the property is located and specific standards contained herein.
