Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant's representative spoke in favor of the request, reviewing the location, access and number of parking spaces for the proposed parking lot addition. Staff reviewed the requirements for amending an Institutional District, access and storm water control for the proposed parking lot. Staff noted that the Unified Development Code has specific landscape requirements for parking lots. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the proposed parking lot helps address the need for parking on the University of Dubuque campus. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approves the request. A simple majority vote is needed for the City Council to approve the request. Property History: The subject property was originally platted for single - family homes and over the years, the University of Dubuque has acquired the properties. The subject parcels were rezoned from R -1 to ID Institutional District in August 2009. Physical Characteristics: The property generally slopes toward the north. Conformance with Comprehensive Plan: This project involves the Comprehensive Plan's Land Use Element: Goal 1.5, 5.3, and 9.2 Staff Analysis: Total Area: 2 acres Existing Street Access: Yes Sanitary Sewer: Yes Planned District Staff Report — University of Dubuque Parking Lot Page 2 Streets: The proposed parking lot expansion will have access to Finley Street. Finley Street as well as the surrounding roadways are designated as residential streets. There are no traffic counts available. Sidewalks: Sidewalks will be required to be built along both Finley and West Street frontages. Parking: The proposed expansion will create approximately 89 additional stalls. Lighting: New outdoor lighting will be required to be 72- degree cut -off Tight fixtures. Signage: No signage has been proposed as part of this ID Plan Amendment. New signage shall be subject to Article 15 of the Unified Development Code. Bulk Regulations: The layout of the proposed parking lot will be constructed in substantial compliance with the submitted campus development plan. Permeable Area ( %) & Location (Open Space): Approximately 20% of the site remains permeable. Landscaping /Screening: Planning staff recommends that screening be added along the north and east sides of the parking lot adjacent to West Street and Finley Street. Planning staff would recommend that the screening utilize shrubs and trees to provide an aesthetic buffer. Phasing of development: None. Impact of Request on: Utilities: Existing utilities are adequate to handle the proposed project. Traffic Patterns /Counts: No traffic counts are available for either Finley or West Streets. Both streets are classified as residential streets. Planning staff anticipates that the proposed new parking lot will generate an increase in traffic on Finley Street. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impacts to the environment provided that adequate erosion control is provided in all phases of construction and adequate storm water control is provided as part of the development of the proposed project. Planned District Staff Report — University of Dubuque Parking Lot Page 3 Adjacent Properties: The proposed new parking lot will create a small increase in traffic on Finley Street and McCormick Street, and represent a visual change along West Street. CIP Investments: None proposed. Staff Analysis: The University of Dubuque is requesting an amendment to the Institutional District to allow for the construction of a new 93 -space parking lot at the corner of Finley and West Streets. Amendments to the ID Institutional District are required when either an Institutional District's boundaries are being expanded or a significant on- campus expansion is taking place. The proposed parking lot, while not a large project in comparison to recent University of Dubuque projects, is located near existing single - family homes on the northwest side of the campus, and this should be reviewed by the Zoning Advisory Commission and City Council as an institutional district amendment. The proposed parking lot will take access from Finley Street and provide an additional 93 off - street parking spaces. This number of parking spaces may be slightly reduced depending on the detention requirement for the site. The City Engineering Department has reviewed the location of the proposed access drives to Finley Street and has no objections to these curb cuts. Planning staff would note that the residential structures on the other side of Finley Street are currently owned by the University of Dubuque and zoned Institutional District. The proposed construction of the new parking lot will require that sidewalks be constructed along both Finley and West Streets adjacent to this property. Planning staff would also note that additional screening will be necessary along both Finley and West Streets to buffer the proposed parking lot from adjacent residential structures. Planning staff would recommend a mixture of shrubs and trees to break -up the visual appearance of the parking lot. Planning staff recommends the Zoning Advisory Commission review Section 5 -22(D) that establishes the criteria for review of institutional district amendments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, be amended by providing for the approval of an amended campus development plan for the University of Dubuque ID Institutional District, a copy of which is on file with the City of Dubuque Planning Services Department. Section 2. Institutional District Regulations. A. Use Regulations The following regulations shall apply to all uses made of land in the above - described ID Institutional District: 1. Principal permitted uses shall be limited to: a. Offices for administrative personnel or other institutional employees and affiliates. b. Churches, libraries, and museums. c. Classrooms, laboratories, lecture halls, and similar places of institutional assembly. University of Dubuque — parking lot at West and Finley Streets Page 2 d. Off - street parking and loading. e. Recreational or athletic facilities for the primary use and benefit of institutional residents or affiliates. f. Single- family, two - family or multi - family dwellings for the housing of institutional residents or affiliates. 2. Accessory Uses. The following uses shall be permitted as accessory uses in the above - described ID Institutional District. a. Located entirely within a principal building, bookstores, or bars seating not more than seventy -five (75) persons at one time and located not closer than two hundred feet (200') from the nearest Residential or Office Residential District. b. All uses customarily incidental to the principal permitted uses in conjunction with which such accessory uses operated or maintained, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. [ ] Parking requirements as per Section D of this Ordinance. B. Lot and Bulk Regulations Development of land in the ID Institutional District shall be regulated as follows: The proposed parking lot at the corner of Finley and West Streets shall be constructed in substantial conformance with the attached amended campus development plan and all final site plans are to be approved in accordance with provisions of the ID Institutional District regulations. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 5 -22 of the Unified Development Code and the following standards: 1. The storm water control shall be designed and built in accordance with City Regulations subject to review and approval by the City of Dubuque Engineering Department. 2. That appropriate erosion and sediment control will be installed prior to commencement of any land disturbing activity related to the subject project, including all required state and city permits related to erosion control. Landscaping shall be provided in compliance with Article 13 of the Unified Development Code. 5. All utilities, including telephone and cable television, shall be installed underground. 6. Final site plans shall be submitted in accordance with Articles 12 and 13 of the Unified Development Code. D. Parking Requirements The off - street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows. 1. Any significant expansion or reduction in the number of off - street parking spaces must be reviewed by Planning Services staff for compliance with the adopted Institutional District regulations. E. Sign Regulations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Article 15 of the Unified Development Code. F. Additional Standards That all previously approved campus development plans are hereby amended to allow for the attached campus development plan. G. Transfer of Ownership Transfer of ownership of property in this ID Institutional District requires rezoning of the property to an appropriate zoning district. H. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Article 9 of the Unified Development Code. I. Recording A copy of this ordinance shall be recorded at the expense of the property owner(s) with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval within thirty (30) days of the adoption of this ordinance.
