The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the location and need for the rezoning. Staff reviewed surrounding zoning and noted that the Zoning Board of Adjustment will review a conditional use permit for the Bethany Home Addition. There were no public comments. The Zoning Advisory Commission discussed the request, having no objection to the request. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approves the request. A simple majority vote is needed for the City Council to approve the request. Total Area: 14,000 sq. ft. Physical Characteristics: The subject parcel is flat and has frontage on both Lincoln and High Bluff Streets. Concurrence with Comprehensive Plan: This Project involves the Comprehensive Plan's Land Use Element: Goal 1.1, 1.2, 1.5, 7.1, 7.3 and 7.8. Traffic Patterns /Counts: All the surrounding streets are classified as local residential streets. There are no current traffic counts available. Public Services: Existing public services are adequate to handle the proposed rezoning. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control is provided during all phases of construction. Adjacent Properties: Planning staff does not anticipate any adverse impacts to adjacent properties as a result of the proposed rezoning. Rezoning Staff Report — 921 -925 Lincoln Page 2 CIP Investments: None proposed. Staff Analysis: The requested rezoning from R -2A Alternate Two - family Residential to R -3 Moderate Density Multi - Family Residential District is intended to facilitate the construction of an addition to Bethany Home. The subject property lies to the south of the existing residential building and has frontage on both Lincoln Avenue and High Bluff Streets. The Zoning Advisory Commission reviewed a similar request in 1999 by Bethany Home to expand their existing facility. The requested rezoning is necessary as the R -2A District does not allow nursing homes as either a permitted or conditional use. The R -3 District allows nursing homes as a conditional use. If the requested rezoning is approved, the next step will be for Bethany Home to seek a Conditional Use Permit from the Zoning Board of Adjustment. At that time, property owners within 200 feet will be notified again and as part of the submittal, Bethany Home will provide a layout and elevations of the proposed addition. The Zoning Board of Adjustment will review the actual expansion and its impact to adjacent properties. The R -3 District requires a front, side and rear yard setback of 20 feet. Depending on Bethany Home's specific request, in addition to a Conditional Use Permit, the setbacks may need to be waived to accommodate the proposed expansion. The Zoning Board of Adjustment would review that at the same meeting as the Conditional Use Permit. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, is hereby amended by reclassifying the hereinafter - described property from R -2A Alternate Two - Family Residential District to R -3 Moderate Density Multi- Family Residential District, to wit: Lot 33 and Lot 34, Hooper's Addition, and to the centerline of the adjoining public right -of -way, all in the City of Dubuque, Iowa.
